AN ORDINANCE
AUTHORIZING THE VACATING AND CLOSING OF THE ALLEY
LOCATED IN BLOCK NO. 53 OF TIE tiORTH ADDITION TO THE CITY OF
BE ;U EO T .
WHEREAS, a petition duly signed by Ers . C. W. Emmer,
owner of, all the property abutting on the alley located in Block
No. 53 of the north Addition to the City of Beaumont has been pre—
sented to the City Commission of the City of Beaumont requesting
that such alley be closed and vacated.
NOW, THEREFORE) BE TT ORDAINED BY TITh CITY COivIMISSIOIv
OF THE CITY OF BFAUEONT :
That the alley located in Block No. 53 of the worth A—
dition to the City of Beaumont, ba and the same is hereby authorized
to be vacated and closed, and that. the tt.le...-te • such alley shall re—
vert to and become the property of the respective owner of the
land',in said Block bordering on said alley, as provided by law;
provided, however, that the closing of this alley shall in no way
affect the- rights oi' the--City—os placing an_d maintaining there—
in of any sewer or water lines or any other service or utility of
-the City, or owner of property in said Block, all of which rights
are hereby reserved.

Gentlemen
I am the owner of property in Block -53 of the
North addition to the City of Beaumont, Texas, through
which an alley runs, as per map attached: I now have a
buyer for one portion -of my property but cannot sell un-
less said alley is closed,
I have attempted to go about the closing of
this alley by petition.in the customary manner, but the
only other property owner in this block refused to sign
the petition on its presentation. She at first said she
was willing, but made the provision that she be allowed
to trim one tree and out down another, both of which bor-
der her property but are on mine: I agreed to her trim-
ming both trees but asked that neither be destroyed.
This seemed satisfactory but before the petition could
again be presented, she made the statement to my buyer
that she had no intention of allowing the alley to be
closed and gave as her reason that at some remote date
we had asked her to "remove her geese from our garden.*
It is apparent from such trivialities that she
has no particular objection to the alleys being closed
but merely harbors resentment. Therefore, since I can-
not accomplish the closing of the alley in the usual way
and since I feel that -its being closed in no way inconven-
ienaps-anyone_since it_touches on no property but my own;
and;- most important -of all,-sinee---i-t-vis-so essential- to=me
to make this sale, I'trust that some means can be found to
close the alley other than by petition: This alley has
been closed to the public.by a fence for at least ten years
and I understand from the City.Engineer that an alley clos-
ed for a period of ten years is automatically a closed al-
ley, and may go. on record as. such.
I therefore put this matter before your honorable
body, trusting that you will give it your consideration and
see your way clear to grant my request, as it is a matter
of vital importance to me. Hoping to hear favorably from
you, I am

FOR THE ISSUANCE of serial bonds of the City of Beaumont
in the sum of $400,000.00 for the purpose of improving,
extending and repairing streets and highways of the City
of Beaumont.
AGAINST THE ISSUANCE of serial bonds of the City of
Beaumont in the sum of $400,000.00 for the purpose of
improving, extending and repairing streets and highways
of the City of Beaumont.
SECOND PROPOSITION
FOR THE ISSUANCE of serial bonds of the City of Beaumont
in the sum of $200,000.00 for the purpose of improving,
extending and repairing the sewerage system of the City
of Beaumont.
AGAINST THE ISSUANCE of serial bonds of the City of
Beaumont in the sum of $200,000.00 -for the purpose of
improving, extending and repairing the sewerage system
of the City of Beaumont.
THIRD PROPOSITION
FOR THE ISSUANCE of serial bonds of the City of Beaumont
in the sum of $100,000.00 for the improvement and ex-
tension of the Department of Public Saftey, including
fire alarm system, police telephone and traffic signal
system and general improvement and repair of buildings
and equipment and purchase of equipment.
AGAINST THE ISSUANCE of serial bonds of the City of
Beaumont in the sum of $100,000:00 for the improvement
and extension of the Department of Public Safety, includ-
ing fire alarm system,, police telephone and traffic signal
system and general improvement and repair of buildings
and equipment and purchase of equipment.
FOURTH PROPOSITION
FOR THE ISSUANCE of serial bonds of the City of Beaumont
in the sum of $50,000.00 for the improvement and exten-
sion of public parks and the purchase of equipment for
same,
AGAINST THE ISSUANCE of serial bonds of the City of
Beaumont in the sum of $50,000.00 for the improvement
and extension of public parks and the purchase of equip-
ment for same.
FIFTH PROPOSITION
FOR THE ISSUANCE of serial bonds of the City of Beaumont
in the sum of $50,000.00 for the purchase of Magnolia
Baseball Park Site.
AGAINST THE ISSUANCE of serial bonds of the City of
