AN ORDINANCE
ENTITLED An Ordinance levying and assessing as a tax upon
the lot, lotno. parts of lots, blocks or tracts of land where not
divided into lots or blocks fronting or abutting on Center Street
from the North side of Broadway to the South side of Hazel Avenue;
two thirds (2/3) of the cost of the paving and gaiter and inci-
dental drainage and all the cost of curbing said Center Street from
the Borth side of Broadway to the South side of Hazel Avenueeppor-
- tiona,ble to ..the hereinafter referred -to -property, -and dealaring-
said tax a lion upon said property and a. personal debt upon the
owner or owners thereof and providing a time when said tax shall
become'due and payable, providing for the collection of same and
all costs incurred in collection of same if not paid .at the time
it becomes due and payable,, and providing the rate of interest
said tax shall bear from the time it bocomes due until paid and
declaring an emergency.
Whereas, pursuant, to the requirements of sub -division (h) of
Section 68 of the Charter of the City of Beaumont, the City Commis-
sion of the City of Beaumont. caused to be published for the time
and in the manner required therefor by the City Charter, a notice
of a resolution of said Commission pabsed heretofore on the 25th
day of January, A. D. 1927, ordering a hearing to be given to the
persons, firms, corporations and estates, their agents or attorneys,;.
owning property abutting on Center Street between the Borth side
of Broadway and the.South side of Haze. Avenue, and calling upon
all persons interested in said matter to appear and show cause, in
conformity with the provisions of the Charter above referred to,.
why the assessment in said notice should not .be made against said
property and against the owners thereof, whi-eh hearing was to be
held in the Council Chamber of the City Sall of Beaumont, Texas,
at 4 O'clock P M on the 15th day of February, A.D. 1927; and
Whereas., a full and fair hearing in conformity with. the Charter
and law in such cases having been had in conformity with said no-
tiee, and the Commission having inquired into and determined all
facts nedessary to the adjuaioation of all special benefits aceru-
Ing to such owners by means of such improvements, and said..hearing
having been duly closed; and.
It appearing that the assessment as proposed in the above
mentioned resolution passed on the 25th day of January, A.D. 19.27,
with the exceptions hereinafter noted, are in all respects fair
and equitable, and that there will be a hall and adequate and
special benefit to the abutting property and the owners thereof
from and by reason of the proposed pavement and improvement in
excess of the amount assessed against the abutting property and
the respective owners thereof.
NOWT, THEREFORE,BE IT ORDAINED BY THE CITY

SECTION 1.
That there is hereby assessed against the several owners of
property and against their respective ,property abutting on. Center
Street from the North side o' Broadway.. to: the South side of Hazel
Avexaue, as a tax two-thirds (2/3 ") o f the, cost of paving and. gutter
and incidental drainage, except'�tbe cost,of paving between curb
The lot,, lots, parts of lots, blocks or tracts of land on which
said tax is lefied and assessed is hereinafter described together
with the number of front feet on each lot, lots, parts of lots, blocks
or tracts of land, the names of the owner or owners -thereof, and the
proportionate amount of the cost of said paving and gutter, and the,
cost of said curbing to be borne and paid for by such owner or
owners as shown by the statement preparea by the City Engineer of
the City of Beaumont, which said amount is hereby levied and assessed
as a tax upon such lot,, lots,, parts of lots, b1beks or tracts of

That there is hereby assessed against the several owners of pro-
perty and against their respective property abutting on center Street from
the North ?ide of Broadway to the 14outh side of Hazel Avenue; as a tax

Street with other Streets and Alleys, and &11 the cost of curbing said
Street from the North. side of Broadway to the Sogth Side of Hazel Avenue .

said tax is levied and assessed is hereinafter described together with the
namber of front feet on such lot, lots, paxts of lots, blocks or tracts of

SECTION Z.
That said amounts so levied and assessed shall become due•and
payable upon the eo-rzpletion of the .paving upon the poxtion of said street
upon which sai d lot , lot s , paxt-s of lots, blocks or tracts of land, fro n.t
and abutt, and the amount of the tqx hereby levied and .ass-essed together
with the cost of collecting and interest at seven ('leo) per cent per annum
from the date same is collectable --until paid is hereby declared a lien
against said lots, lot, parts of lots, blocks or tracts of land, superior
to all,ohhar leins, claims, or titles except City, vounty and. State taxes,
and constitute a personal charge or claim against the owner or owners of
said lots, parts of lots, blocks or tracts of lard..
SECTION 3.
The fact that the portions of the above named Street as indicated
is in bad condition and jeopardize the safety of the people traveling
thereon creates an emergency and an imperative public, necessity, necessi-
t4ting the -suspension of the Tale requirting ordi.nanees to be read on three
(3) several days before their passage, said rule is therefore hereby .sas-
pended and this Ordinance shall take effect and be in full force aid effect
from and after its passage and-pdblication.
Passed this the' 15th Pay of February1927 by the affirmative 'vote
of all members of. the Commission.
