Whereas.. the City Commission of the City of Beaumont,,
has deemed it -advti-sable=-to -change the class of -pavement -ta- be.
constructed on Avenue C from the- Nor--th side of Crockett Street
to the North side. of Franklin Street. from Class "A" pavement
to Class. "B." pavement and to, reduce the width of the saidpave-
ment from. 36 feet to. 30 feetin order to conform to the wishes
of the property owners upon said street affected by the Ordinan-ce
referred to in the caption of this ordinance and to substitute in
lieu of said Class 4'Alr pavement Class rcBtr pavement 30 feet wide-;
and
Whereas, it is necessary in orde.r to relle-ve the: owners
thereof and the property abutting, upon said Avenue C, between the
North side of Crockett. Street and the South side of Irma.. Avenue and
the property of the Eastern Texas Electric Company on said Avenue. G
and the. owners thereof from the assessment of the coast of the pavement
etc., provided far in said ordinance -of the 6th day of July 1926
in order that (upon the passage: of a new Ordinance assessing,as a
tax upon said property and the owners thereof two-thirds (2/3) of
the cost of said Class "B" paving and gutter and incidental drainage:
and all the cost of burbing said Avenue C from the North side of
Crockett Street to the South side of Irma Ave.nue, apportionable to
said property.., and levying and assessing as a.tax upon the tracks
of -the-Eastes'n Texas Electric Company and the `owners thereof on said
Avenue C, between the North side of Crockett Street and the South .
side of Irma Avenue., all the cost of paving between and two feet on
each side of the tracks and railways of said Company;) the two-thirds
of the cost of the proposed Class "B" pavernent, may be assessed as a.
tax --upon the lots, parts of lots, blacks or tracts of land when not
divided. into lots or blocks, fronting or abutting, upon avenue C from
the North side of Crockett Street to the South s.ide--of Irma Avenue

Section I..

That that part of the Ordinance passed heretofore, an
the- 6th day of July 1926 a_s_s.essing as a tax upon the logs, parts
of lots., blocks or tracts. of land where not divided into. lots- or
blocks fronting or abutting on Avenue C from North side; of
Crockett Street to the South sidd of Irma Avenue, two thirds of
the cost of the: paving and gut-te:r and incidental. drainage and all
the cost. of curbing said Avenue C from the North side of Crockett
Street -t -o the South side: of Irma Avenue apportionable -to --said pro-
perty, levying and assessing as. a tax upon the tracks. of the Eastern
Texas Electric Company on.Avenue C between the: North side of
Crockett Street and the South side' of Irma.Avenue, all the cost of
paving between and two feet on each side: of the tracks and railways
of said Companyt and declaring said tax a lien upon. said.property
and a.personal debt upon the owner or owners thereof and providing
a time when said tax shall become due and payable, providing for
the collection of same and all cost incurred if not paid at the
time it becomes due, and payable.1 and providing the rate. of interest
said tax shall -bear -from the time if becomes due until paid and
declaring an emergency;, be and the same is hereby repealed.
Section 2..
That this Ordinance repealing a portion of said
Ordinance of July 6.,-1926 is not intended in -any manner to affect
said Ordinance: of July 6, 1926 except as -to the property abutting
upon said Avenue G between -the North side of Crockett: Street and
-the South side. of Irma. Avenue and except -as to the property of the
Eastern Texas Electric Company situated. --upon Avenue C between the
North side of Crockett, Street and the South side of Irma Avenue,
and said --Ordinance of July '62 -1926- W th the exception in this
Section indicated,. is hereby declare:d to be and remain in full
force and effect.
Section 3.,
The fact that the portions- of the above named Street
as indicated are in bad condition and jeopardize the safety of
the public traveling thereon and that the. repeal of the portion of
the Ordinance hereinabove indicated is necessary in order to per-
mit of further proceedings by the City Commission of the City of
Beaumont necessary for the improvement of said S:tree-t., creates an
emergency and an impe.ra-tive public necessity, necessitating the
suspension of the rule requi=ring ordinances to -be read on three_
several -days before their passage, said rule is 'therefor -e hereby
suspended and this Ordinance shall take -effect and be= in full force:
and effect from and after its- passage and publication.
