AN ORDINANCE
F,
Authorizing and directing the issuance of serial bonds
of the City of Beaumont, bearing interest at the rate of five
per cent (5%) per annum, interest on all bonds payable annually
on the first year and semi-annually on each year thereafter, in
the sum of $400,000.00 to be issued for the purpose of improvirg,
extending and repairing streets and highways of the City of Beaumont,
providing for the levying and collecting of the necessary taxes to
pay the interest and create a sinking fund for the redemption of
said bonds, and further authorizing and directing the issuance of
seri bonds of the City of Beaumont, bearing interest at the rate
of 57o per annum, interest payable annually on the first year and
semi-annually on each year thereafter, in the sum of Q200,000.00
to be issued for the: purpose of improving, extending and repairing
the sewerage system of the City of Beaumont, providing for the
levying and collecting of the rs oessary taxes to pay the interest
and create a sinking fund for the redemption of said bonds, and
further authorixing and directing the issuame of serial bonds of
the City of Beaumont, bearing interest at the rate of 5% per annum,
interest payable annually on the first year and semi-annually on
each year thereafter, in the atm of $100,000.00 to be issued for
the improvement and extension of the Department of public Safety,
including fire alarm system, police telephone and traffic signal
system and general improvement and repair of buildings and equip-
ment and purohase of equipment, providing for the levying and ao 1-
lecting of the necessary taxes to pay the interest and create a
sinking hind for the redemption of said bonds, and farther authoriz-
ing and directing the issuance of serial bonds of the City of
Beaumont, bearing interest at the rate of 5;; per annum, interest
payable annually on the first year and semi-annually on each year
thereafter, in the sum of y�50,000.00 to be issued for the improvement
and extension of public parks and the purchase of- equipment for the
same, providing for, the levying and collecting of the necessary
taxes to pay the interest and create a sinking fund for the redemption
of said bond s, and providing that said ordiname shall take effect
on the date cf, its passage and lawful publication, and declaring an
emergency.
<!HF.R' .Es' S, on the 10th day of November, A. D. 1925, an ordinance
was duly passed by the affirmative vote of all members of the City
Commission of the City of Beaumont, whereby a bond election was
ordered to be held in said City on the 12th day of uecember, A. D.
19 25 , and
.i MOREAS, due notice of said election was given in the
manner and for the length of time re -mired by lgw, and
.JHIMEAS, in said election held in the city of Beaumont
on the 12th day of December, A. D. 1925, the voters of the City c£
Beaumont oualified to vote at said election did authorize the City
Commission of the City of Beaumont to issue bonds of said City
payable serially in from one (1) to forty (40) years from date,
to bear interest at the -rate of five per cent (5") per annum,
interest on all bonds payable annually on the first year and semi-
annually on each year thereafter, said bonds to be in the following
mount and the money to be derived ,therefrom to be used for the
following purposes, to wit:

For the purpose of improving, extending and

AND, WHSTMS, it is deemed expedient and advisable at this
time to issue bonds in the amount and for the purposes above set
forth under and by Virtue of the authority conferred by said
election of date December 12, 1925, and
'IHMEAS, the streets and highways of the Oity of Beaumont
are badly in need of improving, extending and repairing so as to
facilitate the movement of traffic within the City, and
WHEREAS, the sewerage system of the City of Beaumont is
now *holly inadequate for the demands placed upon it, causing
congestion of the sewer mains and result in stagnation which is
injurious to the health and lives of the people. of the vitt' of
Beaumont; and
WHEREAS, the present equipwnt ce. the Department of
Public. Safety of the City is wholly inadequate to meet the demands
of lave enforcement and fire protection within the city, and the
present traffic signal service used upon the principal business
streets of the City is wholly inadequate to handle the crowded
traffic conditions upon such streets, each and all of which
conditions endanger the lives and limbs of the people of the
City of Beaumont., and
HEREAS, the public parks of the city and equipment therein
are vh.olly inadequate to provide the proper recreation, amusement
and training of the ohildren: that frequent as ch p rks, resulting,-
in
esulting;in improper kind of recreation, amusement and training for such
children, each and all of which conditions create an imperative
public necessity requiring this ordinance to take effect immediately
as an emergency measure.
NOW, `1.'HERMRE, BE IT ORDAINED BY THE CITY COIAMISSION
OF THE CITY OF BEAUMNT:
Section 1.
That the City of Beaumont shall issue bonds as hereinafter
described for and on behalf of and upon the credit of the Uity Cf
Beaumont to borrow to the extent of Seven Hundred Fifty Thousand
Dollars (750,000.00) to be devoted to and expended for the 2)1 -
lowing purposes, to wit:
Four Hundred Thousand Dollars (400,000.00) for the
purpose of improving, extending and repairing streets
and highwaSs of the City of BgAL
-j wo Hundred izhou sand Dollars ($200,,000.00) for the
purpose of improving, extending and repairing the
sewerage sy tem cf the City of Beaumont.
One hundred Thousand Dollars (0.100,000.00) for the
improvement and extension of the Department of Pub-
lic Safety, including fire alarm system* police
telephone and traffic signal system and general
improvement and repair of buildings and equipment
and purchase of equipment.
Fifty ehousand Dollars ($506000.00) for the improve-
ment and extension of public parka and the purchase
of equipment for same,
That said bonds provided for herein shall be and are issued
under and by virtue of the constitution and laws of the State of
Texas and the Charter of the City of Beaumont adopted the 30th day
of veoembex, 1919, and the power and authority granted by Sections
18 and 71 of said City Charter, aitl all other provisions in said
charter pertaining to the issuance of bonds, and by Johapter 147
of the General Laws of the ;;tate of Texas passed by the Mrd
Legislature at its regular session, granting said powers to cities
of more than five thousand inhabitants, and by Chapter 9 of the Acts
of the Regular Session of the 37th Legislature and all amendments
to said Acts, and all other laws of the State of Texas pertaining
to and authorizing the issuance of said bonds.
Section 2.
That said bonds in said sum of Seven Hundred Fifty Thousand
Dollars (;750,000.00) shall be divided into, four series and each
series divided into forty (40) equal installments and said series
of said bonds shall be known and called each respectively as
"atreet and Highway Bonds". t'Sewerage Bonds 'T, "Department of Public:
Safety Bonds" and "'Public.Park Bonds", and tbD _Liayor of the City
of Beaumont is hereby authorized and , directed to have prepared and
executed a set of bonds for each of said purposes as follows:
STREET AND HIGEUAY BONDS. Four Hundred Thousand Dollars
(400,000.00) Street and highway Bonds to be divided into four
hundred ( 400) bonds afl the denomination of One Thousand Dollars
($1,000.00) each and numbered from one (1) to four hundred (400),
inclusive, payable as follows, respectively:

Said bonds to be payable in lawful money of the United States
of America and each dated the first day of February, 19 26, eaoh bond
to bear interest at the rate of five per cent (5%) per annum, interest
for the first year payable annually on the first day of February,
and for all years thereafter payable semi-annually on the lst day
of February, and the first day ofAiig>of each year, according to
the tenor of the interest coupons to be attached to said bonds.
The Mayor shall sign said bonds, and they shall be counter-
signed and attested by the City Clerk, and registered by the Direc-
tor of the Department of Finance and the seal of the City shall
be impressed upon each one of them. !!he coupons shall be executed
with the lithographed signatures of the Mayor 'and City Clerk. Said
bonds and interest coupons shall be payable upon presentation and
surrender to the office of the Director of Finance of the City of
Beaumont, or at the office of tha National City Bank in the City
of stew York, at the option of the holder.

That the City of Beaumont, a municipal corporation in the
County of Jefferson, State of Texas, hereby acknowledges itself to
owe,, and for value received hereby promises to pay to bearer ONE
THOU SAND DOLLARS . . . . . . . . . . . . . . . . . (19 000:00 )
in lawful money of the United States of America, on the 1st day of
February, 1927, with interest on said stun from date of this bond at
the rate of five per cent (5) per annum, interest for the first year
payable annually on the let day of February, and for each year there-
after payable semi. -annually on the lst day of February and let day of
xugii*t of each year, in lawful money of the United tates of america,
as efidenced by and upon presentation and surrender of the annexed
interest coupons as they severally become due. Both principal and
interest cf' this bond are payable at the office of the Director of
Finance of the City of Beaumont, or at the office of the .National
City Bank cf New York City, New York.
This bond is one of a series of 400 bonds of the denomination
of UNE TI]DUSAND DOLLARS (1,000.00) each, known and called "STREET
AND HIGH'S+AY BORDS" of like tenor and date, except as to maturity,
numbered from one (1) tolbiaT hundred (:4001 inclusive aggregating
in amount FOUR HUNDRED THDUSIIND DOLLARS (V400,000,001, said bonds
issued by the City of Beaumont for the purpose of making permanent
city improvements, to wit-. For the purpose of improving, extending
and repairing streets and highways of the City of Beaumont. Said
bonds issued under and by virtue of the Constitution and laws of the
State cf Texas, and the Charter of the City of Beaumont adopted the
30th day of December, A. D. 1919 ; and the power and authority granted
by Sections 18 and 71 of said city charter, and a31other -provisions
in said Charter pertaining to the issuance of bonds, and by Chapter
147 of the General Lavers of the State of Texas p<-ssed by the 33rd
Legislature at its regular session, grating certain po:.ers to cities

issuance of municipal bonds pursuant to an Ordinance duly adopted by
the City Commission of the City of Beaumont on the 10th dry, of November,
1925, ordering an election on the 12th day of December, 1925, and a
Resolution of the City Commission of the City of Beaumont duly m seed
on the 15th day of ueoember, 1925, declaring the result of said election
and in pursuance of an ordinance duly and regularly passed by the City
Commission of the City of Beaumont on the 15th day of December, z.D.

The date cf this bond is let day of February, 1926, and it is
hereby certified, recited and declared that all acts, conditions and
things required to be done and precedent to and in the issuing of
these bonds have been. properly done, have happened and been r erformed
in regular and due form as required by law, and that the total in-
debtedness of the City, including the total indebtedness contracted
by the issuance of these bonds, does not exceed the constitutional

It is further ordered that the Mayor be authorized and he
is hereby directed to take and have charge of the above described

and parts of Resolutions inconsistent with the provisions of this

The fact that the streets and highways of the City of
Beaumont are badly in need of improving, extending and repairing
so as to facilitate the movement of traffic within the City; and
the sewerage system of the City of Beaumont is now Wholly inadequate
for the demands placed upon it, causing congestion of the sewer mains
and result in stagnation which is injurious to the health and lives
of the people of the City of Beaumont; and the present equipment &
the Der,artment of Public Safety of the City is wholly inadequate to
meet the demands of law enforcement and iire protection within the
city, and the present traffic signal service used upon the principal
business stre its of the City is wholly inaderuate to handle the
crowded traffic conditions upon such streets, each and all of which
conditions endanger the lives and limbs of the people of the City of
Beaumont; and the public -parks of the city and equipment therein
are wholly inadequate to provide the proper recreation, amuser.,ient and
training of the children that frequent such B -w rks, resulting in
improper kind of recreation, Mmsement and t-aining for such children,
each and all of which conditions crate an imperative public emergency
requiring the suspension of the rule requiring ordinances to be read
on three separate days before their pass.age, and Laid rule is hereby
suspended and this ordinance shall take effect from and after the date
