GRANTING TO the Texarkana and Fort Smith L�ailway Comp any,
its successors or assigns, the right and privilege to re -locate
certain tracrzs in and across Railroad Avenue, College Street, Nall
Street, . Viotoria Avenue, Forsythe Street and the alley in Block
689 Van 1;former Addition, with the right to maintain such tracks
and operate its trains and cars thereover for a period of twenty-
five year2, and prescribing the conditions to be talfilled before
said ordinance shall go into effect, and the time limit for the
removal of said tracks and the period for which the ordinance shall
remain in effect.

Section I.
That the Texarkana and Fort Smith Railway Company, its
successors and assigns, is hereby granted the right and privilege
to take up and remove those certain standard gauge railroad tracks
now located in and across Railroad Avenue, College Street, !fall
S Teet, Victoria Avenue, Forsythe Street and the alley in BloIk 68,
Van dormer Addition, the locations of which tracks are indicated
by broken red lines upon the attached blue print which is made a
part hereof; also the right and privilege to re-lay and construct
said tracks at new locations in and across said streets and a�jeye
as indicated by solid red lines upon said blue print, and the right
and privilege to maintain said tracks as relocated and constructed,
and to operate its trains and cars thereover for a period of
twenty-five years, the changes in said tracks being more definitely
described as follows;
The westerly track in Railroad Avenue at the intersection of
College Street to be moved westerly a distance of thirteen (13 )
feet, more or less, as measured along the center line of the Eastern
Texas Electric Company's track in College Street.
A track to be constructed in Railroad avenue, breaking out
southeasterly from the westerly track abcwe mentioned at a point
near the southerly line of College Street and em ssing Railroad

The middle track at the intersection of College Street and
Railroad Avenue to be moved southerly a distance of ten (10) feet,
more or less, as measured along the westerly line of Railroad
Avenue.
On Wall Street, crossing from Block.7 to Block 68, Van
?dormer addition, the westerly track to be- moved westerly ten (10)
feet, more or less, as measured along the southerly line of Nall
Street. The four easterly tracks to be removed and replaced by
three tracks crossing Wall Street between the said westerly track
and a point one hundred and twenty (120) feet westerly from the
westerly line of Railroad Avenue. The easterly track to be a cross—
over track to connect with the B.S.L. & W. track and to extend out
across the alley in said Block , 68 sixty—five (65) feet, more or
less, easterly from the easterly line of Victoria Avenue. The
trach immediately west of said crossover track to be for interchange
with the B.S.L. & Wo Railway; said track to cross alley in Block
F
68 forty (40) feet east of the east line of Victoria Avenue. The
trac� immediately west of said interchange track in Wall Street to
be a ladder track connecting with the yard tracks to the west.
On Victoria Avenue and Forsythe Street the northerly track
now crossing from Block 66, Van :dormer Addition, across Forsythe
Street to Block 69 and then crossing Victoria Avenue to Block 68#
to be moved so as to cross in a straight line from Block 66 across
Porsythe Street, thence across Victoria Aveme to Block 68; this
track to be. a continuation of above mentioned interchange track.
The yard track crossing Victoria Avenue, being the present
fourth track southerly from Forsythe Street, to be moved southerly
f fifteen (15) feet, more or less, as measured along the easterly line
of Victoria Avenue aril' will be the continuation of the above mentioned
ladder track extended westerly. The yard track crossing Victoria

Section Ile
The right and privilege to take up and remove said tracks
and re -locate the same, and thereafter to maintain and operate said
tracks in said non locations, is granted upon the following express
conditions; First. That said Railway Company, shall within twelve
` (12) months from and after the passage of this ordinance take up and
remove the tracks above specified to be removed. Second. That said
FRailway J'ompsny shall, within twelve (12) months after the final
passage of this ordinance, put in and construct permanent grade
crossings at all of the streets above named, according to the Mans
and specifications on file in the Engineer's office of. the City
of Beaumont, as per blue print hereto attached, marked Exhibit "B",
and under the direction and supervision of the City Engineer. Third.
That said Railway Company shall, within thirty (30) days ^fter the
final passage of this ordinance, file with the City411"�of the
City of Beaumont, its written acceptance of this ordinance.
g S esti on III.
Unless the grantee, its successors and assigns, shall
accomplish the construction of said tracks to be changed within
twelve (12) months after the final passage, acceptance and publica-
tion of this ordinance, the same as to the work which shall remain
unfinished, shall be null and void and of no force and effect except
as to the taking up and removing of the tracks to be taken up and
removed, and the failure of the ?railway Company to take same up
within twelve (12) months, shall forfeit all of the Railway Company's
rights under this franchise.
Section IV.
This ordinance is passed subject to all the terms and
provisions of the Charter of the City of Beaumont.
Section V.
This ordinance shall go into effect sixty days after its
and publication, and shall continue in full force and effect for
a period of twenty-five years thereafter•
