Street from the West side of Park Street to the East side of Victoria Street; Mariposa Street -r-�.. from the North side of Crockett Street to the South side of Liberty Street; and calling upon all persons interested in said matter to appear and show cause, in conformity with the provisions of the Charter above referred to, why the assessment in said notice shoud not be made against said property and or the owners thereof, which hearing was to be held in the Council Chamber of the City Hall of Beaumont, Texas at 3.00 o'clock P.M. on Aptj 28th day of April 1925; AND, WHEREAS, a full and fail hearing in conformity with the Charter and the law in such cases having been had in oonfor.. mitt' with said notioe, and the Commission having inquired into and determined all facts necessary to the adjudication of all special benefits accruing to such owners by means of such improvements, and said hearing having been duly closed; And it appearing that the assessments as proposed in the above mentioned Resolution passed on the 7th day of April A.D. 1925 with the exceptions hereinafter noted, are in all respects fair and, equitable, and that there will be a full and adequate and special benefit to the abutting property and the owners thereof from and by reason of the proposed pavement and improvement in excess of ` the amount assessed against the abutting property and the respec- tive owners thereof. NOW, THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAIIMONT: SECTION 1. That there is hereby assessed against the several owuere to South side of College Street; Hazel Street from East side of Forrest Street to East side of Center Street; Neches Street from North side of Crockett Street to the South line of the right of wap of the T & N 0 R R Co.; Emma Street from the West side of Park Street to the East side of Victoria Street; Mar_�sa Street from the North side of Crockett Street to the South side of Liberty Street; as a tax two thirds (2/3) of the cost of paving and gutter and incinehtal drainage, and all the cost of curbing on said Magnolia Avenue from North side of Wiese Street to the City limits; Shamrock Street from West side of Turon Street to East side of Irving Samek; Railroad Avenue from West side of Sabine Pass Avenue to South side of College Street; Hazel Street from East side of Forrest Street to East side of Center Street; Neches Street from North side of Crockett Street to South line of the rightof way of the T k N 0 R R Co,; Emma Street from the West side of Park Street to the East side of Victoria Street; Mariposa Street from the North side of Crockett Street to the South side of Liberty Street; The lot, lots part of lots, blocks or tracts of land on which said tax is levied and assessed is hereinafter described, togeather with the number of feet front on such lot, lots, parts of lots, blocks or tracts of land, the name or names of the owner or owners thereof and the proportionate amount of the cost of said paving and gutter, and the cost of said curbing to be borne and paid for by such owner or owners as shown by the statement prepared by the City Engineer of the City of Beaumont, which said amount is hereby levied and assessed as a tax upon such lots, parts of lots, blocks or traotsof land as shown, to -wit I* I t 6 SECTION #2* tag so levied and assessed shall become due and payable upon the compAetion of the paving upon the portions of said streets, upon which said lot, lots, parts of lots, blocks or tracts of land front and abut, and the amount of the tax hereby levied and assessed togeuther with the cost of collecting same and seven per cent per annum from the date same is collectible until paid is hereby declared a lAin against the said lot, lots, part of lots, blocks or tracts of land, superior to all other liens, claims or title except City, county and state taxes, and shall constitute a personal charge or claim against the owner or owners of the said lots, blocks or tracts of land. SECTION #3. That all the costs of grading and paving that portion of Shamrock Street between the West Side of Turon Street and East side of Irving Street, Railroad Avenue between West side of Sabine pass Avenue and South side of College Street, Markposa Street between North side of Crockett Street and South sideof liberty Avenue, as is occupied by the a hereinafter named companies respectively between the rails of the Eastern Texas Electric Company, Texarkana & Ft Smith -Railway Company, Beaumont Wharf & Terminal Company, Gulf Beaumont & Kansas City Railway Company, Gulf & Interstate Railway Company of Texas, and the Beaumont Sour Lake & Western Railway Company, and a space twenty four inches beyond the outer edge of the rails of said companies located on said streets and all the cost of constructing the headers along bhth sides of the tracks of tb.e pastern Texas Elect -r_--3 on Magnolia Avenue from Wiess Street to the City limits, shall be borne by the said Eastern Texas Electric Company, Texarkana & Ft Smith Railway Company, Beaumont Wharf & Terminal Cpmpany, Gulf Beaumont & Kansas City Railway Company, PZn7f & Interstate Railway Company of Texas, and the Beaumont Sour Beaumont Wharf & Terminal Company, Gulf Beaumont & Kansas City Railway Company, Gulf & Interstate Railway Company of Texas, and the Beaumont Sour Lake & Western Railway Company, respectively, and shall be collected as other assessments levied under this ordinance, provided such work shall be done in accordance with the city ordinanoes regulating the construction of the railroads in the streets of the city of Beaumont, and the paving of such streets traversed by the same. SECTION ##. The fact that the portions of the above named streets as indicated are in bad condition and jeopardize the safety of the people travelling thereon creates ank emergency and imperative public necessity, necessitating the suspension of the rule re- quiring ordinances to be read three several days before their passage, said rule is therefore, hereby suspended and this ordin- ance shall take effect and be in fall force and effect from and after its passage and publication.
