Entitled an ordinance providing that persons named herein
shall provide themselves with and use closed metal garbage and trash
receptacles, proof against flies, rats, mice and vermin, fixing penalty
for the violation thereof, repealing all ordinances in conflict herewith,
BE IT ORDAINED BY THE CITY COLUVIISSION OF THE
CITY OF BEAUMONT:
Section 1.
That from and after the passage of this ordinance and
its lawful publication, all house -holders, house -keepers, restaurere,
restaurant keepers, hotel keepers, grocers and proprietors of grocery,
stores, fruit stands, candy shops and factories, and all and every
dealer in any food and meat stuffs and food and meat products of
every description and produce of all character, and every person
and proprietor of an establishment conducting any business of any
description wh c_h:.att.racts, or is calculated to attract flies, ra.-ts,
mice, insects and vermin of any kind, and all proprietors of any
business -establishment which accumulates trash -of any character-,
shall provide himself or themselves with one or more closed metal
garbage receptacles, of sufficient capacity to securely house and
contain all and every particle of garbage, trash and refuse matter
of every description accumulating in, on, or about all premises
from food and meat stuffs and food and meat products, groceries of
all description, produce of all character, or from any other source
whatsoever, or constituted of any raw material whatsoever, or any
trash; provided that all closed metal garbage receptacles provided
for herein shall be of 28 gauge galvanized iron.or heavier, but in
no case of a lighter material, which shall be of sufficient size for
the purpose; and shall be fitted with a tightly fitting top, and
said receptacles shall be kept in good repair.
Section 2.
Persons collecting garbage for the. Uity of Beaumont shall

From and after the passage of this ordina ace and its
lawful publication, all garbage and t2ash of the character referred
to and described in Section l hereof accumulating in, on or about
any premises in the City of Beaumont of whatever description shall,
as it accumulates, without any delay whatever, be placed. in said
✓ metal receptacle or receptacles; and said metal receptacle or
receptacles shall never be opened except when .necessary to place
said garbage, trash and refuse matter therein, and shall then be
promptly closed and kept closed until said garbage, trash and refuse
matter is removed therefrom by the city garbage man, or other duly
authorized agent of the city.
Section 4.
Every person in the City of Beaumont coming within the
intendment of this ordinance, as set forth in Section 1 hereof,
who shall fail or refuse to comply with all and every provision
of this ordinance, as provided herein, shall be deemed and held to
be guilty of a misdemeanor and upon conviction thereof shall be fined
in any sum of money not exceeding the sum of Two Hundred ($400.00)
Dollars; and each and ' every 12 -hour half-day, or part thereof, that
any person named herein shall fail to have, possess end use said closed
metal garbage receptacle or receptacles sufficient to contain all such
garbage, trash, and refuse matter accumulating in, upon ar about his or
their premises, as herein provided, shall constitute a separate
offense; and whenever said metal garbage receptacle or receptacles
are opened for any other purpose than herein provided for, or left
open longer than necessary for the purposes herein provided for, the
person or persons responsible therefor, shall be deemed guilty of a
separate offense each and every time such infraction is committed;
and every such person who shall have and possess such metal garbage

receptacles for or during any 12 -hour half-day or part thereof, shall
be deemed guilty of a separate offense.
Section 5.
Should any portion o f this ordinance be declared invalid ,
such invalidity shall not affect the remaining valid portions thereof.
Section 6.
All ordinances or parts of ordinances in conflict herewith
are hereby repealed.
