Whereas, pursuant to the re-uirments of sub -section "h" of Section 68 of the Charter of the City of Beaumont, the City Commission of the City of Beaumont, caused to be published for the time and the manner required therefor by the City Charter, a notice of the Resolution of said Commission, passed heretofore on the 6th day of August, A.D. 1924, ordering a hearing to be given to the persons, firms, corporations or estates, their agents or attorneys ovining property abutting on Victoria Street from Craig Street to Irma Street and from Easy Street to Bolivar Street; and calling upon all persons interested in said matter to appear and show cause, in conformity with the provisions of the Charter above referred to, why the assessments in said notice should not be made against said property and the owners thereof, which hearing was to oe held in the Council Ch^mbero of the City Hall of Beaumont,Texas at 3.00 August, A.D. 1924. OT clock P.M. on the 26th day of AND u1iHCREAS9 a full and fair hearing in conformity with the Charter and the law in such cases having been had in conformity with said notice, and the Commission having inquired into and determined all facts necessary to the adjudication of all special benefits accruing to such owners by means of such improvements, and said hearing having been closed; I , l l And it appearing that the assessments as proposed in the ,Ibove mentioned Resolution passed otthe 6th day of August,, A.D. 1924, with the exceptions hereinafter noted, are in all respects fair and equitable, and that there will be a f*11 and adequate and special benefit to the -butting property and the owners thereof from and by reason of the proposed pavement and improvement in excess of the amount assessed agai= t the abutting property and the respective owners thereof. NoWt THEREFORE be it ordained by the City Commission of the City of Beaumont; Section 1 That thereis hereby assessed against the sever• -1 owners of property and against their respective property abutting upon Victoria Street from Craig Street to Irma Street and from Easy Sjrreet to Boliw-ir Street, as a tax two thirds (2/3) of the cost of paving and gutter and incidental drainage, and all the cost of curbing on said portion of said street. The lot, lots,parts of lots,blocks or tracts of 1"-nd on which said tax is levied and assessed is hereinafter deseribed,together with the number of feet front on each lot,pa its of lots,blocks, or tracts of land, and the name or names of the owner or owners thereof and the proportionate amount of the cost of said paving and gutter, and the cost of said curbing to be borne and paid for by such owner or owners as shorn by the statement preparded by the City .engineer of the City of Beaumont, which sa-id amount is hereby levied and assessed as a tax upon such lots, parts of lots,blocks or tracts of land as shown, towit, Section 2. That siZd tax so levied and assessed shall become due and payable upon completion of the paving upon the portion of said streets, upon whish said lot,lots,parts of lots,blocks or tracts of land front and -,but, and the amount of the tax hereby levied and assessed together with the cost of collecting same and seven percent (7)% per annum from the date sa4ie is collectible until paid is hereby declared -.a lien against the laid lot, lots, parts of lots,blocks or tracts of land, superior to all other liens, claims or title$ except city,county and state taxes, and shall constitute a personal charge or claim against the owner or owners of said lots,parts of lots,blocks or tracts of land. Section 3. The fact thEl't the foregoing portions of the streets are in bad condition and badly in need of paving in order to facilitate the heavy traffic over same ernates an emergency and an imperative public necessity necessitating the suspension of the rule re wiring ordinances to be read on three seperate meetings, said rule is=therefore, hereby suspended and this ordinance shall take effect from and after its passage and publication.
