AN ORDINANCE
AUTHORIZING and directing the issuance of the serial
bonds of the City of Beaumont authorized at an election held in
said City on the 28th dq of March, A.D. 1931, said bonds to be
known. and ' de s ignated as Fair Park Bonds" for the purpose of
improving, repairing, extending and equipping the Public Fair
Park of t1 -D City of Beaumont and acquiring additional sites there-
for, in the sum of v 100,000:00, bearing interest at the rate of
four and one half per cent (42,�) per annum., interest on all bonds
payable annually on the first year and semi-annually on each year
thereafter, providing for the 1e vying and collecting of the necessay
taxes to pay the interest and. create a sinking fund for the redemption
of said bonds; and providing that said ordinance shall take effect
on the date of its passage and lawful publication, and declaring
an emergency
ViIHERE AS, on the 17th day of February, 2..D. 1931, an
ordinance was duly passed by the affirmative vote of all members of
the City Commission of the City of Beaumont., whereby a bond election
eras ordered to be held in said City on the 28th day of March, 1931; and
Vff-ILEEREAS, in said election held in the City of Beaumont
on the 28th day of March, 1931, the voters of the City of Beaumont
qualified to vote at said election did authorize the City Commission
of the City of Beaumont to issue bonds of said City payable serially
in from one (1) to forty (40) years from date, all bonds to bear
interest at the rate of four and one half (42%) per cent per annum,
interest on all bonds payable annually on the first year and' semi-
annually' on each y .ar thereafter, said bonds to be in the amount of
X 100, 000:00 and the omoney to be derived therefrom to be used for
the purpose of improving, repairing, extending and equipping the
Public Fair Park of the City of Beaumont and acquiring eddit ional
sites therefor; and
VTIEREAS, it is deemed expedient and advisable at this time
to issue said bonds under and by virtue of the authority conferred
by said election of date March 28th, 1931, to be known and called
"Fair Park Bonds"
The fact that the public perks of the City of Beaumont
and the equipment therein are wholly inadequate to provide the proper
recreation, amusement and training of tl-- children that frequent
such parks, resulting in improper kind of recreation, amusement and
training for such children, and tle fact that Public Fair Park is
badly in need of repairs and improvements for the protection of the
health and welfare of the citizens of Beaumont who desire to use such
Park, creates an imperative public emergency requiring this ordinance
to take effect immediately as an emergency measure.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY CODWII SSION
OF THE CITY (F BEAUMONT:
Section 1'o
That tln City of Beaumont shall issue bonds as l-nereinafter
described for and on behalf of and upon the credit of the City of
Beaumont to barrow money to the extent of ONE HUNDRED THOUSAND
DOLLARS ($100,000000), to be devoted to and expended for the follow-
ing purposes., to T"nit :

The said bonds provided for herein shall be and are issued
under and by virtue of the Constitution and laws of tYe State of
Texas -and the., Charter of the -City. of Beaunont adopted the 30th day
of December; 1919, and the power and auth�'it�y granted by Sections
18 and 71 of said City Charter' .and all other provisions in said
Charter pertaining to the issuance of bonds, and by Chapter 147 of
the General Laws of the. State of Texas passed by the 33rd Legislature
et its regular session, granting said powers to cities of more
than five thousand inhabitants., and by Chapter 9 of the Acts of
the Regular Session of -the 37th Legislature and all amendments to
said Acts; and all other laws of the State of Texas pertaining to
and authorizing the .issuance of said bonds:
Section 2.
., The said bonds in the sum of One Hundred Thousand, Dollars
($100,000'400) shall be known and called ";Fair_'4Park Bonds« and
shall be divided into forty-C40installments, and the Mayor of the
City of Beaumont is hereby authorized and- directed to here prepared
and executed a set of bonds for said purpose as follows:

of America- and each dated the first day of May, 1931, each bond to
bear interest at the rate of four and one-half per cent (42%) per
annum, interest for the first year payable annually on the first
day of May, 1932, and • for all years "thereafter payable semi-annually

signed and attested by the City Clerk, and registered by the Director
of Finance and the seal of the City shall be impressed upon each one

shall be payable upon presentation and surrender to tle office_ of
the Director of Finance of the City of Beaumont, or at tlbe office of
the National City Bank in the City of New York, at the option of the

granting certain powers to cities of more than 5000 inhabitants and
by Chapter 9, Acts of the Regular Session of the 37th Legislature,
and all amendments thereto, and all other laws of the State of Texas
pertai ning to and authorizing the issuance of municipal bonds pursuant
to an Ordinance duly adopted by the City Commission of -the City of
Beaumont on the 17th day - of February, . x..1931, ordexing an election
bn the 28th day of March, . 1931, and a Resolution of the City Commission
of the City of Be-aumont duly passed on the 31st day of March, 19315,
declaring the result of said election and in pursuance of an Ordinance
duly and regularly passed by the City Commission of the City of Beaumont

indebtedness. of the City, including the .total indebtedness contracted
by the issuance of these bonds, does not exceed the constitutional'
or• statutory limitation*
And it is hereby recited, certified and declared that the
additional tax levied and made necessary to be levied in order to
provide for the interest and principal of this issue of bonds,
together with the rate of . tax existing at, the time of -the issuance
of these bonds, is within the limitations of the Constitution and
laws of the State. of Texas, and Charter of the City of Bealuriont.

Section 4:
It is further ordained that the Mayor be authorized and he
is hereby directed to take and have charge of t1B above described
bonds pending their investigation by the Attorney General of the -
;tate of Texas, and upon their approval and registration he shall
proceed to sell the s:.me .at no less -than their face vdtue and accrued
interest, at public or private sale, and the proceeds of such sale
shall be deposited with the Director. of Finance of the City of
Beaumont, and tl-L- proceeds of said bonds shall be used for the
purpose of making permanent city improvements, to wit:

equipping the Public Fair Park of the -City of Beaumont
and acquiring additional sites therefor'.
Section 5.
It is fir they ordained that- for the purpose of paying t�.ie
interest on said Fair Park Bonds, as well as tre various installments
of principal an the same shall respectively mature, there is hereby
levied for the year 1931, and for each year thereafter, so long as.
the same may be necessary to provide the interest and annual install-
ment's of p rinc ipal of said bonds., on all property in the City of
Beaumont subject to taxation., an additional tax of one and one -f oa-bbh
cents (n:01) on each One Hundred Dollars valuation of all taxable
property within the City of Beaumont, or so much thereof or such other
rate of tax as shall be necessary and the same .shall be so annually
assessed, collected and applied, and said tax, or so much thereof
or such other tax as may be necessary is hereby levied for each year
hereafter while said bonds or any number thereof are outst�a diied to the
