PROVIDING THE RATE OF INTEREST SAID TAX SHALL HEAR FROM THE TIME. IT
BEC0MES DUE UNTIL PAID, AND DECLARING AN EMERGENCY
WHEREAS, pursuant to the requirements of Subdivision (h)
of Section 68 of the Charter of the City of Beaumont., the City
Commission of the City of Beaumont caused to be published for the
time and in the manner required therefor by the City Charter, a
notice of the Resolution of said Commission passed on the 23rd
day of February, A. D. 1931, ordering a hearing to be given to tYje
persons, firms, corporations and estateq their agents or attorneys
owning property abutting on the above named streets, and calling upon
all persons interested in said matter to appear and show cause, in
conformity with the provisions of" the Charter above "referred to why
tr-e assessment in said notice should not be made against said property,
and', against the owners thereof, which hearing was to be held in the
Council Chamber of the City Hall of Beaumont, Texas, at 9:00 o'clock
A.M. on the 10th day of March, A.D. 1931; and
11alEREAS, a full and fair he-aring in conformity with the Charter
and law in such cases having been had in conformity with said notice
and t1B Commission having inquired .into and determined all facts
necessary to the adjudication of .all special benefits accruing to
such owners by means of such improvements, and said hearing having
been duly closed; and.
It appearing that the assessment as propos ed' in the above men-
tioned resolution passed on tl-B 23rd day of February, D. 1931,
with the exceptions hereinafter noted.. are in all respects fair and
equitable and that there will be. a full and adequate and special
benefit to the abutting property and the owner thereof by reason
of 'the proposed pavement and improvement in excess of the amount
assessed against the abutting property and the -respective otic. ers
thereof;
NOW.9 THEREFORE, BE IT ORDAINED BY THE CITY COM1VIISSION
OF THE CITY OF BEAUMONT:

That there is hereby assessed -against the several owners of
property and against their respective property abutting on Kenneth
Avenue from south line of Harriot•t Street to north line of Woodrow
Avenue; Avenue G from south line of Blanchette Street to north line
of Cartwright m Avenue; Avenue H -,fn south line of Franklin Street to
;
north line of Cartwright Avenue" Joacm, himi Street from south line of
Blanchette Street to west line of Avenue H; Royal Street from east line
of Avenue F to west line of Avenue D; and Royal Street from east line
of Avenue B to west line of Pennsylvania Avenue, as a tax two-thirds
of the cost of paving, gutter and incidental drainage of s,jid street9
exclusive of the whole cost between .curb lines of improving said streets
at their intersections with other streets and alleys, and all the, cost of
curbing said streets
The lot, lots, parts of lots, blocks or tracts of land on
which said tax is levied and assessed are hereinafter described,
A_ with the number of front feet on such lot, lots, parts of
lots, or blocks or tracts of land, the name or names of the owner
or owners thereof, and t1iD proportionate amount of the cost of said
paving and gutter, and the cost of said _curbing to be borne and paid
for _by such owner or owners as khowmx by the statement 'prepared by
the City Engineer of the City of BeaUrnont,, which said amount is
hereby levied and assessed as a tax upon such lot, lots, parts of
lots, blocks of tracts of land as shown, to wit:
Section 2®
That said sums of money so assessed as aforesaid against
said respective parcels of property and the respective oiners there-
of, shall be payable to the contractor or his assigns in the following
mariner:
All cash upon the completion and acceptance of said improvement
by the City; provided, however, -that in lieu of such cash payment'
the. owner or owners of said property may enter into a written contract
wi th 'dae c ontr ac t or agte e ing to make pay me nt o f one -f if th in c a s h
within thirty (30) days after such completion and acceptance,. and ones -
fifth thereof each year for one, two, three and four years, respectively,
after such completion and acceptance, such -deferred payments to be
evidenced by coupons attached to certificates herein provided -for.,
signed by- the fac simile signatures of the Tdayor and City Clerk of
said City, where the privilege of such deferred payments has been
contracted for, and where it .has not been contracted for, such coupons
shall not be executed..
Said assessments shall bear interest at the rate of seven per
cent (7%) per annum f rom the date of said completion and acceptm ce
of said improvements until paid, payable annually as it accrues, and
all past due interest on said assessments shall bear interest from. its
maturity until paid at the rate of seven per cent (7%) per annum,
payable annually as it accrues. Said owners shall have the right to�
pay the amount of said assessment in full or any installment thereof,
as evidenced by said coupons, before maturity, with accrued interest'#
Said assessments, with interest as aforesaid, and costs of
collection and reasonable attorneys fees, if incurred, are hereby
declared to be a personal liability for said respective o freers, and if
said owners are not correctly named above, then. against the re al and
true owner or owners thereof, and a lien is hereby fixed on aaid
respective parcels of property to secure the payment of aaid assess-
ments aforesaid, which lien shall be superior to all other liens,
claims, cr titles, except city, county -and state taxes, and .said
personal liability may be sued upon and said lien foreclosed in any
court having jurisdiction thereof:
If default shall be made in the payment of any installment
of principal or interest when due, then at the option of the legal
owner and holder of said -obligation and lien, said obligation shall
at once mature without notice, and the full amount of principal thereof,
together with accrued interest, costs of collection and reasonable
attorneys fees, if incurred, shall be . collectible'.
Upon the c omple ti on of said improvements 'as aforesaid, and,
their acceptance by the City, the City Commission of the City of Beaumont
shall by resolution accept said. improvement as being completed and
shall by said resolution provide for the execution and. delivery of
special assessment certificates in favor of Uvalde`-Ro:c�-_As:ol;.alt Company,
the contractor, or their assigns, against said respective parcels of
prop erty'9 describing the .same by lot and block number, addition, or such
other description as shall be sufficient -to properly identify the
same, naming the owner or owners thereof ,if known, and providing the
time and terms of payment in conformity with the provisions of this
ordinance and. said certificates'' shall evidence the pei-sonal liability
of said owners- to' pay said obligations, and- shall also evidence the
lien on said respective parcels of property, and shall recite the
date of this ordinance, as well as the date of the contract under which
said work was done, and thv date of completion and acceptance thereof®
regularly had in-coampliance with the. Charter of- said City and all
laws applicable thereto, and that all prerequisites to the fixing of
-the lien end claim cf personal liability evidenced by such certificate
have been performed; and such recitals -sl-m11 be prima facie evidence of
the facts so recited;- Said certificates. '.shall: not be in tI exact
language recited above, but may be in en.y language which is in sub-
stance and effect the same 'or which embrace the. facts above provided
for:
Section 3:
The fact that the portions of the above .named streets as
indicated are in -bad condition and jeopardize the safety -of the
people travelling thereon creates an imperative public emergency
necessitating the suspension of , the rule requiring - ordinances - to
be read on three several days before their passage, wherefore, such
rule is hereby suspended, and this ordinance shall be in full force
and 'effect from anal after its passage and publication..

RESCINDING an Ordinance entitled "AN ORDINANCE LEVYING
AND ASSESSING AS A TAX UPON THE LOT, LOTS, PARTS OF LOTS, BLOCKS
OR TRACTS OF LAND WHERE NOT DIVIDED INTO LOTS OR BLOCKS FRONTING
OR ABUTTING ON KENNETH AVENUE FROM SOUTH LINE OF HARRIO TT STREET
TO NORTH LINE OF WOODROW AVENUE; AVENUE G FROM SOUTH LINE OF
BLANCHETTE STREET TO NORTH LINE OF CARTWRIGHT AVENUE; AVENUE H
FROM SOUTH LINE OF FRANKLIN STREE T TO NORTH LINE OF C AR TWR IGHT
AVENUE; JOACHIMI STREET FROM SOUTH LINE OF BLANCHETTE STREET TO
WEST LINE OF AVENUE H;- ROYAL STREET FROM EAST LINE OF AVENUE- F TO
WEST LINE OF AVENUE D; ROYAL'STREET FROM EAST LINE"OF AVENUE B-TO-

AND - DECLARING SAID TAX A LIEN UPON SAID PROPERTY AND A PERSONAL
DEBT UPON THE OWNER OR OWNERS THEREOF, AND PROVIDING FOR THE COL-
LECTION OF SAME AND ALL COSTS INCURRED IN COLLECTING SAME IF NOT
PAID AT THE TIME IT BECOMES DUE AND PAYABLE, AND PROVIDING THE
RATE OF INTEREST SAID TAX SHALL BEAR FROM THE TIME IT BECOMES- DUE
UNTIL PAID, AND DECLARING AN EMERGENCY"; passed by the ' City Commission
of the City of Beaumont on the 10th day of March., 1931, insofar as
said Ordinance affects the paving of Avenue G from south line of
Blanchette Street to north line of Cartwright Avenue; and declaring
an emergency:
WHEREAS, under date of February 3,,-1931,. the City Com-
missibn of the City of Beaumont ordered the improvement of certain
streets or portions thereof i -n said City, and among the portions of
streets .so ordered to be' improved, was the following: AVENUE G
FROM S OUTH LINE OF BLANCHETTE STREET TO NORTH LINE OF CARTWRIGHT
AVENUE; and
WHEREAS, the contract for paving said streets has been
made and entered into with Uvalde Rock Asphalt Company, and the said
Uvalde Rock Asphalt Company has executed and -delivered to the City
of Beaumont proper construction and maintenance bonds under sai d
contract, which bonds have been -approved by the City Commission of
tre City of Beaumont; and
WHEREAS, it has been determined by the unanimous vote of
the City Commission of the City of Beaumont that it is not practical
to proceed with the improvement of- Avenue G from t1W- north line of
Cartwright Avenue to the north line of Corley Avenue, and that it is
necessary to eliminate that portion of Avenue G from said paving
contract and order; and
WHEREAS, .The Uvalde Rock Asphalt Company, contractor, 2m.d
the -surety carrying the construction and maintenance bond of said
contractor, have consented to the change in the paving of said street
so that the same shall be paved from south line of Blanchette Street
to north line of Corley Avenue"s and eliminating therefrom the portions
hereinabove set forth:
NOVI THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BEAUMONT :

The fact that the portion of Avenue G lying between
the south line of Blanchette Street and the north line of Corley
Avenue is in bad condition and -endangers the safety of the people
travelling thereon and it is necessary to rescind the portion of
the ordinance described above in order that a new hearing of the
property owners may be called, creates an imperative public emergency
necessiating the suspension of the rule requiring Ordinances to be
read on three several days before their passage, tivnerefore, said
rule is hereby suspended and this Ordinance shall be in full force
and effect fran and after its passage and publication'

the said Uvalde Rock Asphalt Company
has executed and delivered to the City
Of Beaumont proper construction and
maintenance bonds under said contract,

City Comiuission of the City of Beaumont;
and, Whereas, It has been determined by
the un_animcus vote of the City"Commis-

not practical to proceed with the ' im-
proVement of Avenue G from north line.
