LEVYING AND ASSESSING AS A TAX UPON THE LOT, LOTS, PARTS OF LOTS,
BLOCKS, OR TRACTS OF LAND WHERE NOT DIVIDED INTO LOTS OR BLOCKS FRONTING
OR ABUTTING ON'
Euclid Avenue from west line of Port Arthur Road to
east line of Sabine & East Texas Railroad right -of way;
Avenue A from south line of Washington Bout evard to
south line of Elgie Street;
TWO-THIRDS OF THE COST OF THE PAVING, GUTTER, ANDINCIDENI'AL DRAINAGE AND
ALL THE COST OF CURBING SAID STREETS APPORTIONABLE TO THE HEREINAFTER RE-
FERRED TO PROPERTY, AND DECLARING SAID TAX A LIEN UPON SAID PROPERTY AND A
PERS (SIAL DEET UPON THE OWNER OR OWNERS TBEREOF, AND PROVIDING A TIME 1F,TIEN
SAID TAX S HhLL BECOME DUE A.ND PAYABLE, PROVIDING FOR THE COLLECTION OF SANTE
AND ALL COSTS INCURRED IN COLLECTING SAME IF NOT PAID AT THE ' TIFF IT BECOMES
DUE AND PAYABLE, AND PROVIDING THE RATE OF INTEREST SAID TAX SIIALL BEAR
FROM THE TANTE IT BECOMES DUE UNTIL PAID, AND DECLARING ADT EMERGENCY.
WHEREAS, pursuant to the requirements of Subdivision (h) of
Section 68 of the Charter of the City of Beaumont, the City Commission_ of
the City .of Beaumont caused to be published for the time and in the manner
required therefor by tl� City C1-arter, a notice of the Resolution of said
Commission, passed on the l8th day of -November, A,D, 1930, ordering a hear-
ing to be given to the persons, firms, corporations., and estates, their -
agents or attorneys owning property abutting on the above named streets,
and calling upon all persons interested in said matter to appear and show -
cause, in conformity with the provisions of the Charter above referred to,
why the assessment in said notice should not be made against said property
and. against the oNners thereof, which hearing was to be held in the Council
Zh.amber of the City Hal1 of Beaumont, Texas, at 9:00 o 1 clock A.M. on the
9th day of December,,, A.D. 1930; and
WHEREAS, a full and fair hearing in conformity with the Charter and
law in such cases having been had in conformity with said notice and the
Commission having inquired into and determined all facts necessary to the
adjudication of all special benefits accruing to such owners by means of
such improvements, and said hearing having been duly closed; and,
It appearing that the assessment as proposed in the above mentioned
Resolution passed on the 18th day of November, A.D. 1230, with the excep-
tions hereinafter noted, are in all respects fair and equitable and that
there will be a full and adequate and special benefit to the abutting pro-
perty and the owners thereof from and by reason of the proposed pavement
and improvement in excess of the amount assessed against the abutting pro-
perty and the respective owners thereof:
NOW, THEREFORE, BE IT ORDAINED BY THE ' CITY COr.' JISSION OF THE
CITY OF BEAUMONT:
Section 10
That there- is hereby assessed: against tl� several owners of property
and against their respective property abutting on Euclid Avenue from west
line of Port Arthur Road to east line of Sabine & East Texas Railroad right
of way; and Avenue A from south line of Washington Boulevard to south line
of Elgie Street as a tax two-tY-.rds of the cost of paving gutter and
incidental d_cainage of said streets, exclusive of the whole cost between
curb lines of improving said streets at their intersections with other
streets and alleys, and all the cost of curbing said streets;"

Section 2:

That said stuns of money so assessed as aforesaid against
said respective parcels of property and the re-spective owners thereof,
shall be -payable to the contractor or his assigns, in the following
manner:
All cash upon the completion and acceptance of said improve-
ment by the City; provided however, that in lieu of such cash payment,
if the owner or owners of said -property -have entered.into a written
contract with the contractor agreeing to make payment of one-fifth
in cash within thirty (30) days after such completion and acceptance,
and one-fifth thereof each year for one, two, three and four years,
respectively, after such completion and acceptance, such deferred
payments -be --evidenced by -c oupons attached to certificates herein
Provided for, signed by -the fac simile. signatures of the Mayor and
City Clerk of . said City; where -the privilege of such deferred payments
has been contracted for, and where it has -not been contracted for
such coupons are not executed.-

Said. assessments shall bear interest at the rate of seven
per cent (7%) per -annum -from the date -of, said completion and acceptance
of . said improvements until paid, payable annually as it accrues, and
all past due interest on ,said assessments -shall bear interest from its
maturity until paid at the rate of seven per cent (7f) per annum,
payable annually as it accrues. Said owners shall have the right to -
pay the amoutt -of said assessment in full or any installment thereof,
as evidenced by said coupons, before maturity, with accrued interest
-Said assessments, with interest' as aforesaid, and costs of
collection and reasonable attorneys fees, if incurred, are hereby
declared to be a personal liability of said. respective ocvne-rs, and if
said owners are not correctly named above, then. against th✓ _real and
true owner or owners thereof; and a lien is -hereby fixed .6n said respect
ive parcels of property to .secure the payment of' said assessments
aforesaid, which lien shall be superior to all other liens, claims or
titles, except city, county and state taxes, and said personal liability
may be sued -upon and' said lien foreelm ed in any court having jurisdiction
thereof'. -

:If default shall be made- in the payment of any installment
of principal or interest when due, then at the option of the ' legal
ovmer and holder of said obligation and lien, said obligation shall
at once mature -without notice,- and - t1i full amount of principal thereof,
together with accrued interest,, costs of collection and reasonable
attorneys fees, if incurred, shall be collectible'.
Upon the completion of said improvement as aforesaid., and
its acceptance. by--othe City, the City Commission -of the City of Beaumont
shall by resolution accept said improvement as being complet6d and
shall by said resolution provide for the execution and delivery of
special assessment certificates -in -favor of Scott Shambaugh, the
contractor, or his assigns, against said respective parcels of property,-
describing the same by lot and block number, -addition, or such other
description _as may be sufficient to properly identify- the same,
naming the owner or ovmers thereof, if known, and providing tI-e time
and terms of pa,ment in =conformity with the provisions of this ordinance
and said certificates shall evidence the personal liability of said
owners to pay said obligations, and -shall also evidence the lien on
said respective parcels of property, and shall recite the date of.
this ordinance. as well as the date of the contract under which said

laws applicable thereto and that all prerequisites to tl:e fixing of
the lien and claim of personal liability evidenced by such certificate
have been performed, and such .recitals shall be prima facie evidence of
the facts so recited. Said_ certificates shall not be in the exact
language recited above, but may be in any language which is in substance
and effect the same or which embrace the facts above provided for
Section 3*
The fact that tIB portions of the above named streets
as indicated are in bad condition and jeopardize the safety of tl�B
people travelling thereon creates an imperative public emergency
necessitating the suspension of the rule requiring ordinances to be
read on three several days before their passage, wherefore, such
rule is hereby suspended, and this ordinance shall be in tall force
and effect from and after its passage and publication:
Passed by the affirmative vote of all members of the City
Commission, this the 9th day of 'December, A.D. 1930:
