LEVYING AND ASSESSING AS A TAX UPON THE LO`:C', LOTS, PARTS
OF LOTS, BLOCKS OR TRACTS OF LAND WM-iE NOT DIVIDED INTO LOTS
OR BLOCKS, FRONTING OR ABUTTING ON
Ewing Street from north line of Harrison Avenue
to south line of Gladys Avenue;
Ewing Street from south line of Laurel Avenue to
north line of ,T & N 0 right of way;
,McFaddin Avenue from east line of Magnolia Avenue
to west line of VTillow Street;
Oakland Street from south line of Laurel Avenue
to north line of T & N 0 right of way;
Willow Street from north line of Calder Avenue to
south line of Long Avenue;
TWO-THIRDS OF THE COST OF THE PAVING, GUTTER, AND INCIDENTAL
DRAINAGE, AND ALL THE COST OF CURBING SAID STREETS APPORTIONABLE
TO THE HEREINAFTER REFERRED TO PROPERTY, AND DECLARING SAID TAX
A LIEN UPON SAID PROPERTY AND A PERSONAL DEBT UPON TBE OWNER OR
OWNERS THEREOF, KIND PR OV ID ING A TIME WHEN SAID TAX SHALL BECOME
DUE AND PAYABLE, PROVIDING FOR THE COLLECTION OF SAPS; AID ALL
COSTS INCURRED IN COLLECTING SAME IF NOT PAID AT TIM TIME IT
BEC (ITES DUE AND PAYABLE, AND P ROVIDING THE RATE OF INTEREST SAID
TAX SHALL BEAR FROM THE TIME IT BECOMES DUE UNTIL PAID, AND
DECLARING AN EMERGENCY.
WHEREAS, pursuant to tYve reLiuirements of Subdivision (h)
of Section 68 of the Charter of the City of Beaumont., the City
Co-nnission of the City of Beaumont caused to be published for
the time and in the manner required therefor by the City Charter,
a notice of - the Resolution of said Commission passed on the 15th
day of July, A. D. 1930, .ordering a hearing to be given to the
persons, firms, corporations and estates, their agents or attor-
neys owning property abutting on the above named streets, and
calling upon all persons interested in said matter to appear and
shover cause, in conformity with the provisions of the Charter
above referred to, why the assessment in said notice should not;
be made against said property, and against the owners thereof,
which hearing was to beheld in the Council -Chamber of the City
Hall of Beaumont, Texas, at 9 o'clock A. M... on the 5th day of
August, A. D. 1930;-nd
WHEREAS, a full and fair hearing in conformity with the
Charter and law in such cases having been had in conformity with
said notice and the Commission having inquired into and determined
all facts necessary to the adjudication of all special benefits
accruing to such owners by means of such improvements, and said
hearing having been duly closed; and
It appearing that the assessment as proposed in the
abb)ve mentioned resolution passed on the 15th day of July, A -D,
1930-9 with the exceptions hereinafter noted, are in all respects
fair and equitable and that there will be a full and adequate and
special benefit to the abutting property ard the owners thereof
from and by reason of the proposed pavement and improvement in
excess of the amount assessed against the abutting property and
the respective owners thereof:

That there is hereby assessed against the several owners
of property and against their respective property abutting on
Ewing Street from north line of Harrison Avenue - to south line
of Gladys Avenue;. Ewing Street from south line of Laurel Avenue
to north line of T & N 0 right of way; McFaddin Avenue from
east line . of Magnolia -avenue to west line of Willow Street;
Oakland Street from south line of Laurel Avenue to north line of
T & N 0 right of way; and Willow Street from north line of
Calder Avenue to south line of Long Avenue, as a tax two-thirds
of the cost of paving, gutter and incid.entul' drainage of said
street, exclusive of the whole cost between curb lines of im-
proving said streets at their intersections with other streets
and alleys, and all the cost of curbing said streets:
The lot, lots, parts of lots, blocks or tracts of
land on which said tax is levied and assessed are hereinafter
described, together with the number of front feet on' such
lot; lots, parts of lots, or blocks or tracts of lands `the
name or names of the owner or owners - thereof, and the propor-
tionate amount of the cost of said paving and gutter, and
the cost of said curbing to be borne and paid for by such
owner or owners as shown by the statement prepared by the
City Engineer of the City of Beaumont, which said amount is
hereby levied and assessed as a tax upon such lot, lots., parts
of lots, blocks or tracts of land as shown, to wit:

That said amounts so levied and assessed shall become
due and payable upon the completion of the paving upon the
portion of said streets upon which said lot, lots, parts of lots,
blocks or tracts of land front and abut^ and the amount of the
tax hereby levied and assessed, together with the cost of collect-
ing and interest at seven per cent (7%) per annum from the date
same is collectible until paid is hereby declared a lien against
said lot, lots, parts of lots, blocks or tracts of land superior
to all other liens, claims, or titles except city, county and
state taxes, and c onsti tute. a personal charge or claim against
the owner or owners of said lot, lots, parts of lots, blocks
or tracts of land;
Section 3:
The fact that the portions of the above named streets
as indicated We in bad condition and jeopardize the safety
of the people travelling thereon creates an imperative public
emergency necessitating the suspension of the rule requiring
ordinances to be read on three several days before their
passage, wherefore, such rule is hereby suspended, and this
ordinance shall be in full force and effect from and after
its passage and publication.
Passed by the affirmative vote of all members of the
City Commission this the 5th day of 'August., A.D. 1930

REPEALING ALL PROCEEDINGS, RESOLUTIONS AND ORDINANCES,
AND CANCELLING ALL CONTRACTS WITH REFE REN CE TO THE PAVING OF
OAKLAND STREET FROM SOUTH LINE OF LAUREL AVENUE TO NORTH LINE OF
T & N 0 RIGHT OF MAY; AND DECLARING AN EMERGENCY.
WHEREAS, by resolution dated the 3rd day of June1930,
Oakland Street from south line of Laurel Avenue to north line of
T & N 0 Right of Way was ordered paved, and thereafter plans and
specifications were duly adopted and approved and bids were adver-
tised for and received and a contract was duly _awarded to Uvalde
Rock Asphalt Company for the paving thereof'. said contract being
dated June 19, 1930, and a hearing was thereafter held and an
ordinance passed dated August 5, 19305, assessing the cost of such
paving against abutting property owners along such street; and
WHEREAS, said paving Company was thereafter unable to
secure contracts from a sufficient number of property owners abut-
ting on said street to justify said paving and it has become im-
practical to proceed therewith, and said Uvalde Rock Asphalt Company
has requested that it be relieved from said contract and contractorts
construction and -maintenance bonds given thereunder:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BEAUMONT:
Se cti on 1:
That all resolutions, ordinances and proceedings hereto-
fore enacted or passed with reference to -the paving of Oakland
Street from south line of Laurel Avenue to north line of T & N 0
right of_way be and the same_ are hereby repealed insofar as the
same apply to or of feet the paving of said portions of said street,
and that certain contract between the City of Beaumont and Uvalde
Rock Asphalt Company dated June 19, 1930, for the paving of said
street, together with contractorts construction and maintenance
bonds executed thereunder, be and the same are hereby cancelled
and annulled insofar as they apply to the.above named street, and
are declared to be of no further force and effect;
Section 2;
The fact that the above mentioned paving proceedings
have created an apparent lien on: the property abutting. the above
named street, and the fact that the paving contractor is desirous
of being relieved from its obligations under said contract and under
the construction and maintenance bonds executed thereunder, creates
an imperative public necessity and emergency necessitating the
suspension of the rule requiring ordinances to be read on three
several days before their Im ssage, and said rule is hereby suspended
and this ordinance shall take effect and be in force from and
after its passage.
Passed by the affirmative vote of, all members of the
City Commission, this the 14th day of April.. A.D. 1931-a
