Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on May 21, 2019, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m., to consider the following: OPENING * Invocation Pledge of Allegiance Roll Call Presentation and Recognition * Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Gerald Smith with Greater Love Zion Church gave the invocation. Kerwin Stone, President of the Southeast Texas Vietnam Veterans, Chapter 292 led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. CONSENT AGENDA Approval of minutes — May 14, 2019 Confirmation of committee appointments — None A) Authorize the settlement of the claim of Donald Winfrey — Resolution 19-104 B) Approve a resolution accepting maintenance of the street, sewer, and water improvements in Wooten Oaks Phase II — Resolution 19-105 C) Authorize the Chief Financial Officer to execute all documents necessary to accept funding from the Texas Department of State Health Services for Tuberculosis Prevention and Control — Resolution 19-106 D) Authorize the Chief Financial Officer to execute all documents necessary to accept funding from the Texas Department of State Health Services for Regional & Local Services System/Local Public Health Services — Resolution 19-107 Councilmember Jordan moved to approve the Consent Agenda. Councilmember Pate seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, FELDSCHAU, PATE AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider amending Section 2.04.003 of the Code of Ordinances to increase the amount of paid time off (PTO) leave carried into the following calendar year. Minutes — May 21, 2019 Currently, the Code of Ordinances allows employees to carry over a maximum of 960 hours of PTO leave into the following calendar year (1,344 hours EMT/paramedic employees). After analyzing employee accruals, 41 employees have more than 960 hours of PTO. It would be appropriate to increase the maximum hours of PTO carried into the following year to 1,280 hours (1,792 hours EMT/paramedic employees). The proposed changes to the Code of Ordinances would only be applicable to civilian. employees and would be effective May 21, 2019. Approval of the ordinance. Councilmember Jordan moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 2.04.0003 (C), SECTION 2.04.003(6) AND SECTION 2.04.003 (L) OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS TO MAKE CHANGES RELATING TO EMPLOYEE PAID TIME OFF (PTO) LEAVE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, FELDSCHAU, PATE AND SAMUEL NAYS: NONE MOTION PASSED Ordinance 19-026 WORK SESSION Review and discuss a request from Mardi Gras Southeast Texas, Inc. Laura Childress, President of the Mardi Gras of Southeast Texas, Inc., and Lennie Caballero, Director of the Events Facilities spoke to Council regarding the Mardi Gras of Southeast Texas, Inc., moving to Beaumont. Laura Childress stated that the Mardi Gras of Southeast Texas, Inc., (MGSET) is a volunteer non-profit organization, chartered in 1992. The Krewe of Aurora was formed simultaneously and is the founding Krewe. Ms. Childress stated that the MGSET is a four-day event that includes multiple parades, live entertainment, a carnival, food and other attractions for all to enjoy. Mardi Gras, which is French for Fat Tuesday, always falls 46 days before Easter. Here in Southeast Texas, Mardi Gras is celebrated the weekend before Fat Tuesday. The dates were given for the next five (5) years: 2020 — February 20 - 23 2021 — February 11 - 14 2022 — February 24 - 27 2023 — February 16 - 19 2024 — February 08 - 11 MGSET requested the City of Beaumont consider being the host City for the next five years, beginning in February 2020 which will be MGSET's 28th annual event. Ms. Childress stated that they would like to form a partnership with the City of Beaumont which includes the use of the following facilities and areas in downtown Beaumont: Minutes — May 21, 2019 Great Lawn Downtown Event Centre Event Centre parking lots Beaumont Civic Center parking lot Various City streets for the parade route Various City street closures For rain -out weather related issues, MGSET requested to also use the following facilities: Beaumont Civic Center Jefferson Theatre Julie Rogers Theatre It was stated that the parade routes are to be determined with guidance from the event facilities management and City staff. MGSET operates this annual four-day event with 500+ volunteers and have no paid staff. They will pay for expenses such as police, security, health permits, event production, rentals, and more.
