Singletary, Chief of Police MEETING DATE: June 4, 2019 REQUESTED ACTION: Council consider a resolution authorizing the City Manager to execute all documents necessary to apply for and accept grant funding for the continuation of the SETX Auto Theft Task Force. BACKGROUND, The Southeast Texas Auto Theft Task Force is a multi jurisdictional agency comprised of six personnel from the Beaumont Police Department, and one each from.the Jefferson County Sheriff s Office, Port Arthur Police Department and Hardin County Sheriff s Office. Since the inception of the Task Force in 1993, motor vehicle thefts have decreased in Beaumont by more than 80%. The Task Force currently covers Jefferson, -Orange,. Hardin, -and Jasper Counties. The Task -Force focuses efforts in two areas: investigations, which target vehicle burglaries and vehicle thefts, and public awareness, which uses media campaigns, training and public presentations to promote prevention techniques and awareness. Title 43, Part III,: Chapter 57 of the Texas Administrative Code, allows local government agencies to apply for funding through a grant or an extension of a grant from the Texas Automobile Burglary and Theft Prevention Authority. The City of Beaumont has been the grantee for the Southeast Texas Auto Theft Task Force since 1993. The total budget being requested is $913,974, with state funds in the amount of $549,418. The Beaumont Police. Department will provide $24.2,081 as a cash match in the form of personnel salaries, benefits, fuel, and vehicle maintenance, while other agencies will provide an additional $122,475 in cash match. An "in-kind" match of $261,547- will also be provided in the form of salaries and. vehicle related expenses. The - upcoming grant cycle will begin on September 1, 2019 and will end on August -31, 2020. FUNDING SOURCE The City's required match of $242,081 is included in the Police Department's Operating Budget in the General Fund. RECOMMENDATION Approval of the resolution. Southeast Texas Auto Theft Task Force Which type of grant are you -applying for? Continued Grant - Only available to agencies that have a 2019 grant. These are annual competitive grants for the program described in the application. The program must be submitted for substantially the same program as the previous year. The 'requested funds, match funds, and in-kind match must be within 5% of the previous year but in any event may not go below the 20% minimum cash match requirement. The number of staff positions must be within 5% of the total positions. Awarded activities are funded on a reimbursement basis. To be eligible for consideration for funding, a program must be designed to support one or more of the following ABTPA program categories. • Law Enforcement, Detection and Apprehension • Reduction of the Sale of Stolen Vehicles or Parts • Education Programs and Marketing Grant Participation and Coverage Area • Other Coverage (Describe): Jefferson, Hardin, Orange, and Jasper counties and all municipalities therein. • Law Enforcement Grant Participating and coverage agencies below. Participating Agencies: agencies that will materially participate in the grant application through the use of interlocal agreements. The agencies selected in this list only includes agencies that will receive or provide funding and/or resources. The interlocal agreements do not need to be submitted with the application. Interlocal agreements will need to be executed prior to the first payment being made if selected for a grant. Letters of support with the application from the participating agencies are strongly recommended. Coverage Agencies: agencies that will be covered by the grant but not materially participating in the grant application. These agencies will not be covered by a grant interlocal agreement but as law enforcement agencies may have jurisdictional coverage agreements unrelated to the grant. The agencies selected in this list only includes agencies that will be covered or where the chief of police or county sheriff indicates that their agency will coordinate or call upon the taskforce. These will not directly receive or provide funding and/or resources. Letters of support with the application from the participating agencies are strongly recommended. WHEREAS, under the provisions of the Texas Revised Civil Statutes Article 4413(37) and the Texas Administrative Code Title 43, Part 3, Chapter 57, entities are eligible to receive grants from the Automobile Burglary and Theft Prevention Authority to provide financial support to law enforcement agencies for economic automobile theft enforcement teams and to combat motor vehicle burglary in the jurisdiction; and, WHEREAS, this grant program will assist this jurisdiction to combat automobile burglary and theft; and, WHEREAS, the City of Beaumont has agreed that in the event of loss or misuse of the grant funds, the City of Beaumont assures that the grant funds will be returned in full to the Automobile Burglary and Theft Prevention Authority; NOW, THEREFORE, BE IT RESOLVED'BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the City Manager, Kyle Hayes, is designated as the Authorized Official to apply for, accept, decline, modify, or cancel the grant application for the Automobile Burglary and Theft Prevention Authority Grant Program and all other necessary documents to accept said grant; and, BE IT FURTHER RESOLVED that the Southeast Texas Auto Theft Task Force Commander, Lt. BACKGROUND Liquid Chlorine is used to purify the City's water supply and to treat sewage discharge. The Water Utilities Department expects to purchase approximately one hundred fifty (15 0) tons of this material during the term of this contract. Bids were requested from six vendors and two responses were received. Brenntag Southwest, Inc. responded with a bid of $780.00 per ton with a total estimated cost of $117,000. This represents about an 8.5% increase in the price of this material over last contract. Specifications allow for a six month contract with the option of two renewals of six month terms at the same pricing as the awarded contract. Brenntag Southwest, Inc., has the current contract. LA\i11V 1\V V1\L On September 24, 2013, by Resolution No. 13-211, City. Council awarded a- contract to H. W. Lochner, Inc., of Kansas City, Missouri for the Beaumont. Municipal Airport -Development Plan Update to assess existing'conditions, evaluate future. aviation demands, and provide the framework needed to guide the City in developing the airport aviation demand. , The City agreed to update the Beaumont Municipal Airport Development Plan and ALP as part of the application approval process for the release of oil and gas revenues. An Airplane. Development Plan is a 20 year master and capital improvement plan which also includes the Airport Layout Plan (ALP) that defines all runways, taxiways, obstructions, and boundaries of the airport. The final report of the Beaumont Municipal Airport Development Plan Update has been completed and is ready for acceptance. A copy of the final report is available in the Executive Office. Lochner, Inc., of Kansas City, Missouri, in the amount of $141,600 to update the Beaumont Municipal Airport Development Plan. This plan will provide the framework needed to guide the City of Beaumont in developing the airport that will cost-effectively satisfy aviation ,demand while . considering potential environmental and socioeconomic impacts. This planning effort updates the previous Airport Development Plan and associated Airport Layout Plan (ALP) drawings accepted by TxDOT Aviation Division on July 22, 2008, due to changes in operational activity, airport safety and design standards, and receipt of mineral revenues to fund capital infrastructure needs. The preparation of this update is evidence that the City of Beaumont is committed to the airport's economic role and its importance in the local, state, and national system of airports. GOALS AND OBJECTIVES The Airport Development Plan Update provides an objective look at the development needs of the airport over the next 20 -year period. This update will provide the City and local stakeholders with information. and budgeting documentation to guide growth at the airport. This plan should also be used as a resource for the development of other community planning documents; such as the City's Comprehensive Plan, in order to maintain compatible land uses with existing and future airport development. This document and associated ALP drawings will also be utilized by the Federal Aviation Administration (FAA) and Aviation Division of the Texas Department of Transportation (TxDOT). Development Plan Update Final Report Page i As with any planning document, it is prudent to identify goals and objectives for the overall success of the plan. Through a review of background information and discussion with City officials, airport personnel, TxDOT and FAA, the following goals and objectives have been established for the Beaumont Municipal Airport Development Plan Update: + Develop the airport's physical facilities. to meet FAA and TxDOT requirements and future needs. » The airfield configuration will adhere to the latest airport design standards to the fullest extent possible. » Terminal area facilities (or landside facilities) and hangars will be planned to maximize available space in a constrained airport environment. + Establish a realistic capital improvement schedule and financial plan. » Develop a -capital improvement plan (CIP) that utilizes local and federal funds to.design and construct airport improvement projects. » Quantify available funding resources for the mid- and long-term planning periods and the priority of project implementation. + Provide an airport that is safe and reliable. » To the maximum extent possible, remove, obstructions to approach surfaces and runway protection zones, improve instrument approach capability, and protect the airport from future obstructions to navigable.airspace.. » Maintain airfield pavements and safety areas in good condition. + Preserve the environment, be sustainable, and address land use compatibility. » Protection and preservation of the local environment are essential when implementing projects. » Wherever prudent, make use of existing facilities through renewal or modernization to meet future demand. » To the extent possible, protect the airport's operating environment to avoid land use conflicts.,- + Provide a plan that meets the needs of the region. » Seek input from tenants, users, and various stakeholders regarding their concerns how to best meet transportation needs and enhance relationships. » Establish and maintain an effective working relationship with local planning agencies, TxDOT, and FAA to ensure the continued economic success of the airport. These goals and objectives help establish direction, track progress, and allow the City to recognize when and if changes may be needed. It is important that this plan remain flexible when conditions warrant. Development Plan Update - Final ReDort DEVELOPMENT PLAN ELEMENTS AND PROCESS The Beaumont Municipal Airport Development Plan Update utilizes a prescribed FAA planning process that will aid the decision-making efforts by the City of Beaumont towards implementing the recommendations in this plan. The following elements of this plan will include: Chapter One - Existing Conditions. An inventory of existing facilities, current_ conditions, airport activity and socioeconomic data. Previous plans as well as issues related to the airport will be used throughout the planning process. Chapter Two - Demand Forecasts. An analysis of aeronautical demand over the short-, intermediate-, and long-term planning period to include based aircraft and fleet mix, annual operations, air taxi/ charter operations, annual instrument approaches, and the future critical design aircraft. Chapter Three - Facility Requirements. Assesses the ability of the airport in its existing layout to support forecasted demand. The analysis identifies demand levels that will .trigger the need for airfield and landside facility additions or improvements and estimates the extent of new facilities.that may be required to meet that demand. Chapter Four - Development Alternatives. Based on upon the recommendations in the facility requirements analysis, the development, evaluation and confirmation of airfield and landside alternatives to meet aviation demand will be presented. These proposed alternatives will be evaluated by the City of Beaumont from which a selected airfield and landside development alternative will emerge for further refinement. Chapter Five- Capital Improvement Program (CIP). A comprehensive schedule and costs of recommended capital improvement projects over the short-, mid- and long-term planning periods will be completed. Projects identified in the short-term will be outlined by year and be based on a CIP generated by the City of Beaumont, TxDOT, andTAAregarding the use of mineral revenues. Projects occurring in the intermediate- and long-term periods will be based on proposed development alternatives and needs of the airport. An evaluation and confirmation of various funding sources and cash flow analysis describing how the City of Beaumont will finance projects recommended will be in . this plan. Appendix A - Airport Plan Drawings. As a result of selecting the preferred airside and landside development alternatives, a set of drawings that provides agraphic representation of existing and ultimate development will be made. This airport layout plan set is a legal requirement for a federally obligatedairport and will conform to the ALP guidelines established by the TxDOT Aviation Division and FAA. Appendix B - Airport Drainage Evaluation. This includes an evaluation and confirmation of the drainage improvements completed since the previous Airport Development Plan and to be completed at the direction of the Sponsor, if needed, as the facility, needs are established. The facility needs will potentially impact the stormwater management as facilities are built and/or improved in -order to meet projected aviation demand (e.g., hangar, taxilane and apron construction).. 1� Development Plan Update Final Report Page 2.iii I n t r o d u c t i c r1OORD11,14TIOM Overall, the Airport Development Plan Update is an effort tailored to be responsive to local issues, while at the same time, remain inclusive of broader regional issues. -It is an important process that provides a comprehensive evaluation of the airport in order to meet development objectives while being mindful of impacts to the environment and incorporating sustainable best practices. This plan will serve as a medium for assembling community opinion and concurrence. Coordination with stakeholders and incorporating their input is an essential process for the success of the plan. Throughout the Development Plan Update process, stakeholder surveys will be conducted in order to obtain relevant insight and opinions into the development of the airport. The City -of Beaumont, TOOT, and the FAA will also be provided with working .papers at established milestones in order to provide input and address concerns. This effort will be completed prior to scheduled meetings throughout the process. Because it is expected that only minor changes from the 2008 Beaumont Airport Development Plan will be made, the scope of this plan update and anticipated changes did not necessitate the formation of a review committee of aviation community members or interest groups. Successful completion of the Beaumont Municipal Airport Development Plan Update occurs when the City of Beaumont adopts the plan and it is accepted by the TOOT Aviation Division and FAA. WHEREAS, The City of Beaumont has established an emergency alerting system, and; WHEREAS, SETRPC has contracted with Blackboard Connect to provide cost effective Emergency Notification Services on behalf of participating local jurisdictions, and; WHEREAS, the purpose of this system is to alert large numbers of citizens within a specific geographic area of important information for public safety purposes, and; WHEREAS, in the event of a large-scale emergency or incident, the alerting system would benefit the citizens of The City of Beaumont by providing critical information in a timely fashion, and; WHEREAS, The City of Beaumont has agreed to act as the single point of contact with West for access to the 9-1-1 Data Base for emergency alerting purposes, and; WHEREAS, the South East Texas Regional Planning Commission 9-1-1 Emergency Network agrees to this arrangement regarding the use of the 9-1-1 Data Base for this purpose; NOW, THEREFORE, BE IT HEREBY RESOLVED: That SETRPC and the City of Beaumont hereby agree to the following terms of use of the Blackboard Connect Emergency Alerting System and the 9-1-1 Data Base. The City of Beaumont has unlimited use of Blackboard Connect at no cost to the City of Beaumont during the contract year. Unlimited non -emergency messages may be sent using the non -9-1-1 data provided by Blackboard Connect. The City of Beaumont agrees to use the 9-1-1 West database only for the purpose of Interlocal Agreement Between SETRPC and the City of Beaumont EXHIBIT "A" emergency notification purposes. The City of Beaumont understands that the data contained in the 9- 1-1 Database is to be used for the purpose of warning or alerting citizens to an emergency situation as defined by the Federal Communications Commission (FCC) as a 'situation posing an extraordinary threat to the safety of life and property" and that this data is to be maintained as confidential and not subject to public inspection in accordance with Texas Health and Safety Code, Section 771.062(a). In general, factors to be considered in determining whether an emergency situation is warranted are: 1. Severity—will aid in reducing loss of life or reducing substantial loss of property 2. Timing -requires immediate public knowledge to avoid adverse impacts 3. Other means of disseminating information are inadequate to ensure rapid delivery. In order to maintain the confidential nature of the 9-1-1 data base information and the rights and privacy of citizens with unlisted and unpublished numbers, The City of Beaumont will be responsible for and agrees to create two separate account log -ins for the alerting system. One log -in will allow the City of Beaumont to use commercially available information for non -emergency messages. The City of Beaumont will determine who shall have access and under what conditions to this non -emergency messaging capability. Another, greatly restricted access log -in will be created by the City of Beaumont for the purpose of solely disseminating emergency alert messages as defined above and utilizing the 9-1-1 database information. The Emergency Management Coordinator for the City of Beaumont and/or his deputy or designee will be the only persons allowed access to the restricted emergency alert messaging log -in. Due to the confidential nature of the 9-1-1 data base information and privacy of citizens with unlisted and unpublished numbers, SETRPC retains the right to withdraw their assistance if the City of Interlocal Agreement Between SETRPC and the City of Beaumont Beaumont does not maintain the confidentiality of the information or for misuse of the emergency alerting system. The SETRPC 9-1-1 Network will not be liable for any costs associated with the emergency alerting system including costs associated with the extract of data from the 9-1-1 data base. Associated costs for the unpublished West data will be covered by SETRPC Criminal Justice and Homeland Security Division through grant funds. Charges for the activation and features specified in the Blackboard Connect contract shall be the responsibility of the SETRPC Criminal Justice and Homeland Security Division (CJHSD) for a period not to exceed twelve months from the initiation date reflected in the contract between SETRPC CJHSD and Blackboard Connect beginning August 1, 2019 and ending September 30, 2020. The contract/service agreement between SETRPC and Blackboard Connect may be renewed indefinitely and this Interlocal Agreement between the City of Beaumont and SETRPC shall remain in full effect for the duration of the contract/service agreement with Blackboard Connect unless SETRPC or the City of Beaumont cancels this Interlocal Agreement in in writing. SETRPC CJHSD will not be responsible for any costs other than the activation fee for the initial twelve-month period reflected in the contract between SETRPC CJHSD and Blackboard Connect and any subsequent contract renewals. SETRPC CJHSD does not make any promise, guarantee or other obligation for continued activation of the Blackboard Connect system beyond the initial twelve-month period. Continued activation of the emergency alerting system will be the sole responsibility of the City of Beaumont after the expiration of the initial twelve-month period unless additional funding is acquired for the regional project. INDEMNIFICATION BY The City of Beaumont, Texas: The City of Beaumont agrees, only to the extent allowed Interlocal Agreement Between SETRPC and the City of Beaumont by applicable law, to at all times indemnify, hold harmless and defend the SETRPC against any and all claims, causes of action, liabilities or losses, directly or indirectly arising as a result of the City of Beaumont's use of any Emergency Notification System services pursuant to the terms of this Agreement. Nothing herein will be deemed a waiver of governmental immunity other than per Texas Local Government code Chapter 271. BACKGROUND Zulag Properties, L.L.C., requested a Specific Use Permit for the property located at 7155 Calder Avenue. They are requesting permission to establish a multiple -family dwelling complex in the form of townhomes. These townhomes will be for lease only and will not be available for individual ownership. The complex will consist of sixteen (16) buildings with four (4) townhomes in each building, for a total of sixty-four (64) units. At a Joint Public Hearing held on April 15, 2019, the Planning Commission recommended 7:0 to deny the request for a Specific Use Permit.to allow a multiple -family development in a GC -MD -2 (General Commercial -Multiple Family Dwelling) District located at 7155 Calder Avenue with the following conditions: 1. Engineering requires five (5) handicap parking spaces with a minimum of one (1) van accessible parking space 2. Provide a five (5) foot wide sidewalk along Calder Avenue. The Zoning Ordinance states, "The City Council shall not amend, supplement, change, modify or repeal any regulation, restriction or boundary or approve a Specific Use Permit where a protest against such change (has been filed); signed by the owners of twenty percent (2091o) or more either of the area of the lots included in such proposed change or of the lots or land immediately adjoining the same and extending two hundred (200) feet therefrom, except by the favorable vote of three-fourths (3/4) of all the members of the City Council." Protest against this request was received from 30.8% of the lots and land immediately adjoining the subject property. Therefore a favorable vote of three-fourths (3/4) of all the members of the City Council shall be required to approve the requested Specific Use Permit. Given the extensive discussion of traffic concerns related to this proposed development during the public hearing, the Public Works Department conducted a supplementary analysis (see attached). This analysis supports the original recommendation in that while the additional dwelling units will add congestion, it will not be enough of an impact to downgrade the "Level of Service" of the roadway. This holds true even with the additional traffic associated with the recent expansion of Calder Woods. Due to concerns raised at the public hearing, engineering staff recommend adding and/or altering the following conditions: 2. Provide five (5) foot wide sidewalks along Calder Avenue and Pinchback Road. 3. Remove all driveways entering and exiting from Pinchback Road. FUNDING SOURCE Not applicable. RECOMMENDATIONS Approval of the request with the following conditions: 1. There must be a minimum of one van accessible handicap spot. However, it is preferable to provide one at each building. The southernmost building must have a designated parking area. 2. Provide five (5) foot wide sidewalks along Calder Avenue and Pinchback Road. 3. Remove all driveways entering and exiting from Pinchback Road. Preliminary Traffic Impact Evaluation for a . Proposed Townhome Complex at 7155 Calder Avenue Level of Service The Highway Capacity Manual (a worldwide reference for transportation engineers) uses a concept called level of service (LOS) to quantify and evaluate traffic delay and congestion. © Levels A, B, C: Acceptable Conditions Level D: Approaching unstable conditions, consider further evaluation ® Level E: Unstable with congested conditions e Level F: Bumper -to -Bumper traffic Standard Per the HCM, Calder Avenue is categorized as a 2 -lane, undivided street with left turn lanes at busy intersections and coordinated signals. This type of roadway is considered to be almost congested when the volume is 8,900 to 18,300 vehicles per day. Pinchback Road is classified as a 2 -lane residential road. Residential roads with a volume of less than 1,000 vehicles per day are considered comfortable for residents based on livability. Results The 2016 TxDOT Urban Saturation Maps indicate a volume of 6,422 vehicles per day on Calder Avenue, just east of Pinchback Road. The townhomes are expected to generate 351 total daily trips (see table in Appendix A.) A worst-case scenario can be assumed by placing all new traffic onto Calder Avenue, increasing the volume to 6,773 vehicles per day. The level of service, currently level C, is unaffected by the increased volume. BACKGROUND Impact Waste, LLC has repeatedly failed to pay its financial obligation in a timely manner in accordance with the requirements of the franchise agreement passed by City Council on March 21, 2017. In the past two years, Impact Waste, LLC has only paid timely on two (2) occasions. Currently, Impact Waste has past due reports for the months ending January, February, March and April of 2019. They have failed to report monthly receipts and franchise fees due as well as make payments for this time period. Based on historical data, it is estimated the City is owed approximated $9,000. In addition, Impact Waste owes the City $3,299 in past due landfill charges. City staff has made numerous attempts by email and letter to notify them of said delinquency without any success. In accordance with Section 11 of Ordinance 17-017, written notice was sent to Impact Waste LLC on May 13, 2019, notifying them that they had ten (10) days from the mailing of the notice to settle their past due account with the City. To date, these charges are still outstanding. FUNDING SOURCE Not Applicable. RECOMMENDATION To hold a public hearing and approve an ordinance to terminate the franchise agreement. RESOLUTION NO. WHEREAS, on March 21, 2017, the City Council of the City of Beaumont, Texas passed Ordinance No. 17-017 approving the transfer of a franchise agreement from Industrial Transportation Waste, LLC (ITW) to Impact Waste, LLC for solid waste collection and transportation services in the City of Beaumont; and, WHEREAS, Impact Waste, LLC has failed to report monthly receipts and franchise fees and currently has failed to make full payment for the amounts due for January 2019, -February 2019, March 2019 and April 2019; and, WHEREAS, such failure to pay the required franchise fees is a violation of its franchise ordinance; and, WHEREAS, City Council is of the opinion that it is in the best interest of the City to terminate the franchise agreement with Impact Waste, LLC; . Additionally, this structure has deteriorated to a condition that it is no longer considered suitable for repair and has collapsed onto the neighboring property. Given the concern for additional damage, this structure should be considered for emergency demolition. WHEREAS, the accessory structure at 2458 San Jacinto Street in the City of Beaumont has been inspected by the Building Codes Division and found to be an unsafe structure as defined by the City of Beaumont's Code of Ordinances Chapter 24, Article 24.04 Unsafe Substandard Structures as well as Division 1, Section 14.04.001 of the 2009 International Property Maintenance Code; and, WHEREAS, this structure has deteriorated to a condition that is no longer considered suitable for repair and has collapsed onto the neighboring property constituting a clear and present danger to said property and the public safety; and, WHEREAS, the City Council for the City of Beaumont is of the opinion that the demolition of said structure is necessary for the preservation of life and property in the City of Beaumont; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this ordinance are hereby, in all things, approved and adopted; and, Section 1. After a public hearing, the structure located at 2428 San Jacinto Street is hereby found to be a public nuisance in that said building violates Chapter 24, Article 24.04 of the Code of Ordinances of the City of Beaumont and is for want of repairs, or by reason of age or dilapidated, decayed, unsafe or unsanitary condition, or otherwise unfit for human habitation, or otherwise likely to endanger the health, safety or general welfare of the citizens of the City. Section 2. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Chapter 24, Article 24.04 of the Code of Ordinances of Beaumont, Texas, it is hereby ordered that the owner or owners of the above described building demolish and remove said structure within ten (10) days of the effective date of this ordinance. If the property owner(s) fail(s) to comply within ten (10) days, Council orders that the property be demolished without further notification to the property owners or City Council action. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1.01.009 of the Code of Ordinances of Beaumont, Texas. Section 6. This ordinance shall become effective from and after its passage The meeting at which this ordinance was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.
