AN ORDINANCE
ENTITLED AN ORDINANCE LEVYING AND ASSESSING AS A TAX UPON THE
LOTS, PARTS OF LOT S. BLOCKS, CR TRACTS OF LAND WHERE N(T DIVIDED
INTO LOTS OR BLOCKS, FRONTING OR ABUTTING ON
Victoria Street from the North side df Bolivar Street to
the North side of Washington Boulevard;
Victoria Street from the South side of College Street to
the North side of Franklin Street;
Avenue B from the South side of College Street to the North
side of Franklin Street:
Easy Street from the West side of Railroad Avenue to the
East side of Avenue A:
Milan Street from the West side of Park Street to the East
side of Trinity Street:
Milan Street from the West side of Main Street to the East
side of Pearl Street
Franklin Street from the West side of Main Street to the
East side of Pearl Street:
Milani. Street in front of Lots 144 and 145, Block 35, of the
Beaunont Townsite;
Langham Street from the West side of Pennsylvania avenue to
the East side of Neches Street;
TWO-THIRDS OF THE COST (F THE PAVING, GUTTER, AND INCIDENTAL DRAINAGE,
AND ALL THE COST OF CURBING SAID STREETS APPG? TIONABLE TO THE HEREIN-
AFTER REFERRED TO PROPERTY, AND DECLARING SAID TAX A LIEN UPON SAID
PROPERTY AND A PERSONAL DEBT UPON THE OWNER OR OVISTERS THEREOF, AM
PROVIDING A TIME WEEN SAID TAX SHALL BECOME DUE AND PAYABLE, PROVID-
ING FOR THE COLLECTION (F SAME AND ALL COSTS INCURRED IN COLLECTING
SAME 1F NOT PAID AT THE TIME 7P BECOMES DUE AND PAYABLE, AND PROVIDING
THE RATE OF INTEREST SAID TAX SHALL BEAR FROM THE TIME IT BECOMES DUE
UNTIL PAID, AND DECLARING AN EMERGENCY:
WHEREAS, pursuant to the requirements of Subdivision (h) of
Section 68 of the Charter of the City of Beaumont, the City Commission
of the City of Beaumont caused to be published for the time and in the
manner required therefor by the City Charter, a notice of the Resolution
of said Commission, passed on the 26th day of November, A. D. 1929#
ordering a hearing to be given to the persons, firms, corporations,
and -estates, their agents or attorneys owning property abutting on
the above named streets, and calling upon all persons interested in said
matter to appear and show cause, in conformity with the provisions of the
Charter above referred to, why the assessment in said notice -should not
be made against said property and against the owners thereof which
hearing was to be held in the Council Chamber of the City Hall of Beaumont
Texas, at 9:00 o1clock A. M. on the 17th day of December, A. D. 1929; and,
WHEREAS, a full and fair hearing in conformity with the Charter
and law in such cases having been had in conformity with said notice
and the Commission having inquired into and determined all facts,
necessary to the adjudication of all special benefits accruing to
such owners by means of such improvements, and said hearing having
been duly closed; and,
It appearing that the assessment as proposed in the above mentioned
Resolution passed on the 26th day of November, A. D. 1929 with the
exceptions hereinafter noted are in all respects fair ands equitable
and that there will be a full and adequate and special benefit to
the abutting property and the owners thereof from and by reason of
the pio posed pavement and improvement in excess of the amount assess-
ed against the abutting property and the respective owners thereof:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COPJMISSION C1' THE
CITY OF BEAUMONT:
Section 1;
That there is hereby assessed against the several owners of pro-
perty and against their respective property abutting on Victoria Street
from the North side of Bolivar Street to the North side of Washington
Boulevard; Victoria Street from the South side of College Street to the
North side of Franklin Street; Avenue B from the South side of College
Street to the North side of Franklin Street; Easy Street from the West sid
of Railroad Avenue to the East side of Avenue A; Milam Street from the
Wdst side of Park Street to the East side of Trinity Street; Milam
Street from the West side of Main Street to the -East side of Pearl
Street; Franklin Street from the West side of Main Street to the East
side of Pearl Street; Milam Street in front of Lots 144 and 145, Block
35, of the Beaumont Townsite; Langham Street from the West side of
Pennsylvania Avenue to the East side of Neches Street; as a tax two-
thirds of the cost of paving, gutter, and incidental drat nige of
said streets, exclusive of the whole cost between curb lines of improve-
ing said streets at their intersections with other streets and alleys,
and all the cost of curbing said streets';
The lot, lots, parts of lots, blocks or tracts of land on which
said tax is levied and assessed are hereinafter described, together
with the number of front feet on such lot, lots, parts of lots, or
blocks or tracts of land, the name or names of the owner or owners
thereof, and the proportionate amount of the cost of said paving and
gutter, and the cost of said curbing to be borne and paid for by such
owner or owners as shown by the statement prepared by the City Engineer
of the City of Beaumont, thich said amount is hereby levied and assessed
as a tax upon such lots, parts of lots, blocks or tracts of land as
shown, to -wit:

Section 24-
That saL d amounts so levied and assessed shall become due and pay-
able upon the completion of the paving upon the portion of said streets
upon which said lot, lots, par is of lots, blocks, or tracts of land front
and abut, and the amount of the tax hereby levied and assessed, together
vitt th the cost of collecting and interest at seven per cent (7%) per
annum from the date same is collectible until paid is hereby declared a
lien against said lot, lots, parts of lots, blocks or tracts of land
superior to all other liens, claims, ar titles except city, county, and
state taxes, and constitute a personal charge or claim against the owner
or owners of said lot, lots, parts of lots, blocks or tracts of .land;
Section 3,;
The fact that the portions of the above named streets as indicated
are in bad condition and jeopardize the safety of the people travelling
thereon creates an imperative public emergency necessitating the suspen
sion of the rule requiring ordinances to be read on three several days
before their passage: Wherefore, such rule is hereby suspended, and
this ordinance shall be in full force and effect from and after its
passage and publication.
Passed by the affirmative vote of all members of the Commission

AN ORDINANCE
ENTITLED AN ORDINANCE REPEALING THOSE PORTIONS OF THE
HEREINAFTER REFERRED TO RESOLUTIONS AND PI EEDINGS IN SO FAR
AS THE SAME AFFECT THE PROCEEDINGS BY THE CITY OF BEAUMONT
TAKEN TO CAUSE THE PAVING OF EASY STREET FR -CM THE WEST SIZE OF
RAILROAD AVENUE TO THE EAST SIDE OF AVENUE A, AND DECLARING
AN EMERGE 1CY.
WHEREAS, it appears that the proceedings heretofore
taken to effect the paving of the above named street and to
assess a lien upon the abutting property owners has been made
inoperative and impracticable as to that portion of Easy Street
from the west side of Railroad Avenue to the east side of
Avenue A by reason of the fact that a sufficient number of
the property owners owning property abutting on a portion of
said street would not sign separate paving liens, and -thereby
causing a large number of unsightly gaps in the paring, and it
is deemed advisable by the City Commission of the City of
Beaumont to advertise for bids and to relet contracts with
reference to the paving of said street between the West side
of Railroad Avenue and the east side of Victoria Street, and
it is necessary to institute proceedings for fixing the liens
against the abutting property owners on said street for the
paving of s ane ;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BEAUMONT:
Section 1:
That all resolutions and proceedings heretofore
enacted or passed with reference to the paving of Easy Street
from west side of Railroad Avenue to east side of Avenue A
be and the same are hereby repealed insofar as the same affect
the paving of said street, but this Ordinance shall not affect
the resolutions or proceedings enacted or passed with reference
to any streets not mentioned herein:
Section 2:
Whereas, Easy Street from west side of Railroad Avenue
to east side of Victoria Street is in bad condition and is badly
in need of paving in order to facilitate the havy traffic over
the same, and whereas it is necessary to institute new proceed-
ings for assessing costs of paving said street against the
abutting property owners thereon, therefore an imperative public
necessity exists creating an emergency requiring the suspension
of the rule requiring ordinances to be read on three (3) several
days before their passage, said rule is hereby suspended and this
ordinance shall take effect from and after its passage and
publication.
Passed this the 8th day of April, A. D. 1930, by the
affirmative vote of all members of the City Commission.
