Section 1.

Section 3.
The following named persons are appointed presiding judges
of their respective voting boxes with the authority to select anti
appoint their own clerks:

At the Averill School Building - J. R. Edmonds.
At the Central Fire Station - J. G. Fuqua.
At the City Hall - S. E. Bigha.m.
At the Jefferson County Court House - Mrs. R. M. Maery.

Section 4.
The question as to whether the existing Charter of the City of
Beaamont snali oe amenaea in the hollowing particulars saall ue suo-
muted in nine (9) propositions am there shall ue printed on the ballot
used in said election 'the full text of said amenaments aril after each
amendment there shall be printea the words "Yes" and "Non, in the

FIRST PROPOSITION
Shall the existing Charter of the City of Beaumont be
amended, so as to add thereto a new section with reference to
opening and widening streets, etc., to be known as Section 72,
to read as follows:
Section 72:
(1) The City of Beaumont shall have the power to open;
extend, straighten, widen, repair, or otherwise improve the
streets, alleys, or public ways within its limits, and to provide
that the cost of making any such improvements shall be paid for
by the property owners owning property in the territory specially
benefitted in enhanced value by reason of making such improvements,
and a personal charge shall be made against such owners, as well
as a lien shall be fixed by special assessment against any such
property, and the City may issue assignable certificates or
negotiable certificates, as it deems advisable, covering such
cost, and may provide for the pEyment of such costs in deferred
payments, and fix the rate of interest not to exceed seven per
cent per annum, and may provide for the appointment of special
commissioners or otherwise for the making or levying of such
special assessment, or may provide that the same shall be done by
the governing authorities, and such rules and regulations may be
adopted for a hearing, and other proceedings had as may be deemed
advisable by the gov-,ruing body of the City, and said powers shall
be cumulative of and in addition to and alternative pavers to
those now existing in the Charter of the City of Beaumont.
.(2) All the powers conferred by Articles 1179 and 1180
of the Revised Civil Statutes of Texas of 1925, relating to im-
provement districts, are hereby adopted, and power is conferred
upon the City in connection therewith, to issue assignable cer-
tificates, and to appoint special Commissioners for the making or
levying of special assessments, and to provide that tin governing
authorities may make such rules and regulations concerning the
same as may be deemed advisable. Power is further conferred upon
the City for the condemll�.tion of all the land necessary to

effectuate the amendment hereby adopted, which condemnation
proceedings, as well as the assessment proceedings, shall be
held as nearly as practicable in accordance with the law govern -
in 'the opening and widening of public streets, and the issuance
of certificates therefor, as well as the applicable provisions
of the City Charter relating thereto -, or other laws, and these
powers shall be cumulative of and in addition to, and alternative
powers to those now existing in the Charter of the City of
Beaumont.

SECOND PROPOSITION
Shall the existing Charter og the City of Beaumont be
amended so as to add thereto & new section with reference to a
revolving street improvement fund to be known as Section 731,
to read as follows:
Section 73:
(1) The City shall have power to borrow money on its
credit and may issue bonds, as provided by the existing Charter;
and general laws governing the same, for the purpos# of providing
a revolving street improvement fund. By "revolving street im-
provement fund" is meant a fund to be used in paying for any
character of street improvement, or part thereof, the cost of
which may be assessed against persons and property benefitted,
such fund to be used merely to advance in connection with the
payment of the costs of such improvements, until the special
assessments shall have been collected, and such revolving street
improvement fund shall be recompensed from such special assess=
ments, and such funds shall be and may be used over and over for
various street improvements, as may from time to time occur.
The term T°revolving street improvement fund" shall include
a fund to be used in paying for any character of street improve -
meat, or part thereof, the cost of which may be assessed against
persons and property benefitted under the terms of the City
Charter or under the terms of the amendments thereto. - Whenever
it is deemed advisable, to impound certificates issued for any
improvement provided by this Charter, the City of Beaumont shall
have the first right and claim to impound the same, and advance
out of the revolving street improvement fund the money to pay
for same, or the City of Beaumont may impound the same and
issue debenture bonds, certificates, warrants, or other evidence
of indebtedness against the said certificates so impounded,
or it'may issue debenture bonds or warrants protected by the
said certificates so impounded, and such debenture bonds or
warrants shall have a first lien upon all certificates so
impounded, and- the City may arrange to protect their payment out
of the
general credit of
the
city in case
sufficient funds

be collecteu, upon

certificates

governing authority is fully authorized to pass all ordinances
or resolutions or do whatever may be necessary to carry out the
authority hereby conferred, as well as to provide for the
revolving fund, and for that purpose may adopt by ordinance or
resolution such ot.aer methods as Lnay be deemed suitable to
carry- out the full pow9r and authlrity to properly finance aw
public improvement don_ under the special assessment plan,
including street improvements of every character under the terms
of this Charter and amendments thereto, and said powers shall
be cuarala.tive of and in addition to and alternative powers to
those now existing in the Charter of the City of Beaumont.
(2) The governing body of the City is hereby authorized
and directed to transfer the proceeds realized from the sale of
the bonds authorized by the election held on ITay 4th, 1929,
for the sum of Three Huudred Fifty Thousand Dollars ($350,000.-
00) for opening, improving, and- widening stree s, to the revol-
ving street improvement fund, r`ferred to infiection (1) hereof,
and make said funds available for the said revolving street
imp:. -o vement fund herein authdirized, and it shall not be neces-
sary to re -submit the matter to an election of the people.

THIRD PROPOSITION
Shall the existing Charter of the City of Beaumont be
amended by adding thereto a new se^t:�on with reference to
spreading assessments over a period of fifteen years, to be
known as Section 74, to read as follows:
Section 74: In all proceedings providing for assessments
against property owners for special benefits received, whether
the same arise out of the condemnation of land or otherwise,
the governing body of the City in its discretion is hereby
authorized to provide, whenever the same is practicable, or
whenever the same may be done under the law, for the spreading
of the payments of said assessments over a period not to exceed
fifteen years. Assignable certificates or other evidence of
indebtedness may be issued by the governing body in all cases
of assessment arising under the provisions of this Charter.
The governing; body shall have full power and authority to pre-
scribe the form of such certificates, and whenever such certifi-
cates shall recite substantially that the proceedings with
reference to making the improvements therein f;eferred to have
been regularly had, in compliance with the law, and that all
prerequisites to the fixing of the assessment lien against the
property described in saia certificate, and the personal liability
of the owner, or owners, tharaof have been performed, the said
certificates shall be prima facie evidence of all the matters
recited in such certificate, and no further proof thereof shall
be required. This provision shall apply to ary suit upon any
assessment or re -assessment for which a certificate may be issued
under the terms hereof, and further reference to any proceedings
-el -.ting, to such assessment or re -assessment shall not be neces-
s"r_y. Such assessment shall be collectable with interest,
ezpenee of collection, and reasonable attorneyTs fees, if
:incurred, and stall be a first and prior lien on the property
assessed, suPeriocl-to all other liens and claims except state
and county and city ad valorem taxes, and shall be a personal

assessed. The governing body is fully empowered to pass suit-
able ordinances to enforce the provisions of any assessments
that may be made under the terms of the Charter of the City of
Beaumont, and any amendment thereto, and to fix a lien against
the property benefitted. The cost of any improvement arising
out of any assessment made under the terms of the Charter of
the City of Beaumont, or any amendment thereto, may be wholly
paid by the City or partly paid by the City and partly paid
by the property owners owning property in the vicinity of the
territory specially benefitted thereby, and the governing body
of the City may within its discretion provide that the cost
of any improvement arising out of any assessment made under
the terms of this Charter, may be paid wholly by the property
owners owning property in the vicinity of the territory
specially benefitted thereby, and shall so provide upon
petition of the majority of the property owners affected,
but no assessment shall ever be made against any property
or owner thereof which shall exceed the amount of the special
benefit in enhanced value which such property shall receive
from such improvement. The rate of interest for deferred pay-
ments shall not exceed seven per cent, and said powers shall
be cumulative of and in addition to, and alternative powers
to those now existing in the Charter of the City of Beaumont.

Section 75:
(1) For the purpose of promoting health, safety, morals;
and the general welfare of the community, the City of Beaumont
is hereby empowered to regulate and restrict the height, number_
of stories, and size of buildings and other structures, the
percentage of lot that may be occupied, the size of yards,
courts, and other open spaces, the density of population, and
the location and use of buildings, structures, and land for
trade, industry, residence, and other purposes, and -the goferning
authority of the City may divide the City into districts of such
number, shape, and area as may be deemed best suited to coxry
out the powers and purposes hareb,T granted. and within such
districts it may regulate and restrict the erection, construction,
re lonstruct ion, alteration,, repair, or use of buildings, struc•-
'eurgs, or land, providing all such regulations shall be uniform
for eaoh class or kind of buildings throughout each district;

Section 76•
(1) For the purpose of promoting public health, safety;
order, convenience, prosperity, and general welfare, the City
of Beaumont shall have the power, acting through its governing
body, under the police power, to provide by suitable ordinances
building lines on arXy street or any block of any street; and to
require their observance by suitable penalties, and my acquire
by condemnation or otherwise, the easements, properties, ani

ine on any street or block of any street, and may assess and
collect benefits against property owners and their property abut-
ting on or in the vicinity of said building line arising out of

Section 77: All of the powers conferred by the Act of
the First Called Session of the Fortieth Legislature of Texas,
authorizing cities to improve streets and alleys, and make
assessments for sane, known as Chapter 106, and found on page
489 of said Session Laws, are hereby adopted as cumulative of
and in addition to, and alternative powers to those now existing
in the Charter of the City of Beaumont, and the provisions of said

SEVENTH PROPOSITION
Shall the existing Charter of the City of Beaumont be
amended so as to add thereto a, neer section with reference to
airports to be known as Section 78, to read as follows:
Section 78:
(1) The City of Beaumont shall have power to acquire or
own by purchase, donation, bequest, or otherwise, all property
inside or outside of the City of Beaumont that it may need for
the purpose of establishing and operating an airport, and to
provide for the accomoC,ation of the United States tail planesand
other aerial transportation, and it may make suitable charges
therefor. The ownership and operation by the City of Beaumont
of such airport or airports shall be deemed a municipal purpose,
and the City shall pass suitable ordinances providing for the
fees to be collected and other charges to be made in the opera-
tion of either municipal or private airports, and shall have full
regulatory powers thereover, and the said powers shall be
cumulative of and in addition to and alternative powers to those:
now existing in the Charter of the City of Beaumont.
(2) All the powers and immunities conferred by the acts
of the Forty-first Legislature of the State of Texas with refer -
once to the acc;.uisition, maintenance, and operation of airports
by cities and Commissioners' Courts are hereby adopted, and these
powers and immunities shall be cumulative of and in addition to
and alternative powers to those now existing in the Charter of
the City of Beaumont.

to make local public street improvements by installing and main-
taining special lighting systems therefor; and to assess the
costs of said improvements and the maintenance of the same

purpose all of the provisions of Chapter 18, Title 28, of the
Revised Civil Statutes of Texas of 1925 are hereby adopted,
and shall be cumulative of and in addition to, and alternative
rcwers to those now existing in the Charter of the City of

NINTH PROPOSITION
Shall Section 55 of the existing Charter of the City
of Beaumont with reference to salaries be amended to read as
follows:
Sect ion 55:
(1) The Mayor shall receive a salary of $1800.00
per annum, payable monthly, and the Mayor pro tem shall
receive $10.00 for each meeting of the Commission over which
he presides in the absence of the Mayor. The salary of the
City Manager shall be fixed by the City Commission, and
approved by the Council. Each Commissioner shall receive
$1200.00 per annum, payable monthly. Members of the Council
shall receive $10.00 for each meeting of the Council attended
by him, not to exceed two meetings in any one month. The
directors. of the Departments and other employees of the City
shall receive such compensation as may be fixed by the City
Manager, and approved by the City Commission and Council.

Shall the existing Charter of the City of Beaumont be amend-
ed by addiYg thereto a new section with reference to spreading
assessments over a period of fifteen years, to be knovn as Section
74, to read as follows:
Section 74:
In all proceedings providing for assessments
against property owners for special bene fits received,
whether the same arise out of the coniemnation of lexi
or otherwise, the governing body of the City in its
discreation is hereby authorized to provide, whenever
the same is practicable, or whenever the same may be
done under the law, for the spreading of the payments of
said assessments over a period not to exceed fifteen
years. Assignable certificates or other evidence of
indebtedness may be issued by the governing bony in all
cases of assessment arising under the provisions d this
Charter. The governing body shall have fall power and
authority to prescribe the form of such certificates,
and whenever such certificates shall recite substantially
that the proceedings with reference to making the im-
provements therein referred to have been regularly had,
in compliance with the law, and that all prerequisites
to the fixing of the assessment lien against the prole rty
described in said certificate, and the personal liability
of the owner, or owners, thereof have been performed,
the said certificates shall be prima facie evidence of all
the matters recited in such certificate, and no further
proof thereof shall be required. This provision shall
apply to arty suit upon any assessment or re -assessment for
which a certificate may be issued under the terms hereof,
and further reference to any proceedings relating to
such assessment or re -assessment shall not be necessary.
Such assessment shall be collectable with interest,
expense of collection, and reasonable attorney's fees, if
incurred, and shall be a first and prior lien on the
property assessed, superior to all other. Liens and claims
except state and county and city ad valorem taxes, and
shall be a personal liability and charge against the
owner or owners of the property assessed. The governing
body is fully empowered to pass suitable ordinances to
enforce the provisions of air assessments that may be made
under the terms of the Charter of the City of Beaumont,
and any amendment they eto, and to fix a lien against the
property benefitted. The cost of any improvement arising
out of arty assessment made under the terms of the Charter
of the City of Beaumont, or say amendment thereto,, may be
wholly paid by the City or partly paid by the City and
partly paid by the property owners owning property in the
vicinity of the territory specially benefitted thereby,
and the governing body of the City may within its discretion
provide thwt the cost of any improvement arising out of
any assessment made under the terms of this Charter, may
be paid wholly by the property owners owning property in
the vicinity of the territory specially benefitted thereby,
and shall so provide upon petition of the majority of the
property owns rs affected, but no assessment shall ever be
made against any property or owner thereof which shall exceed
the amount of the special benefit in enhanced value vi iota:

FOURTH PROPOSIT mN
Shall the existing Charter of the City of Beaumont be amended
so as to add thereto a new section with reference to zoning, to ba
known as Section 75, to read as follows:
Section 75:
(1) For the purpose of promoting health, safety,
morals, and the general welfare of the community, the
City of Beaumont is hereby empowered to regulate and
restrict the height, number of stories, and size of
buildings and other structures, the percentage of lot
that may be Occupied, the size of yards, courts, and
other open spaces, the density of population, and the
location and use of buildings, structures, and land for
trade, industry, residence, and other purposes, and the
governing authority of the City may divide the City into
districts of such number, shape, and area as may be deemed
best suited to carry out the powers and purposes hereby
granted, and within such districts it may regulate ani
restrict the erection, construction, reconstruction,
alteration, repair, or use of buildings, structures,
or land, providing all such regulations shall be uniform
for each class or kind of buildings throughout each
district, but the regulations in one district may differ
from those in other districts, and the powers herein
granted shall be deemed cumulative of and in addition to,
and alternative powers, to those now existing in the
Charter of the City of Beaumont.
(2) All the powers contained in Chapter 283, page
424, of the General and Special Laws of the Fortieth
Legislature of Texas, and known as House Bill No. 87,
authorizing cities to pass zoning, regulations , are hereby
adopted .as cumulative of and in addition to and alter-
native powers to those now existing in the charter of
the City of Beaumont.
FIFTH PROPOS ITION
Shall the existing Charter of t13 City of Beaumont be amended
so as to add thereto a new section with reference to the establish-
ing of building lines, to be known as Section 76, to read as follows:
Section 76
(1) For the purpose of promoting public health,
safety, order, convenience, propperity, and general
welfare, the City of Beaumont shall have the power,
acting through its governing body, under the police
power, to provide by suitable ordinances, building lines
on any street or any block of arW street, and to require
their observance by suitable penalties, and may acquire
by condemnation or otherwise, the easements, properties,
and titles necessary to be taken arA acquired to establish
a building line on any street or block of any street, arra
may assess and collect benefits against property owners
and their property abutting on or in the vicinity of
said building line arising out of the establishment of
said building line, and these powers shall be cumulative
of and in addition to and alternative powers to those
now existing in the Charter of the City of Beaumont..
(2) All of the powers granted by Chapter 276 of
the General aid Special Laws of the Fortieth Legislate re
of Texas, relating to the establishment cf building
lines in cities, and providing for an assessment therefor,

of the City of Beaumont, and said powers shall be
cumulative of and in addition to, aid alternative
powers to those now existing in the Charter of the
City of Beaumont.
SIXTH PROPOSITION
Shall the existing Charter of the City of Beaumont be amended
by adding thereto a new section with reference to street improve-
ments and assessments, to be know as Section 77, to read as
follows:
Section 77•
All of the powers conferred by the Act of the
First Called Session of the Fortieth Legislature of
Texas, authorizing cities to improve streets and alleys,
and make assessments for same, known as Chapter 106,
and found on page 489 of said Session Laws, are hereby
adopted as cumulative of and in addition to, and Alter-
native powers to those now existing in the Charter of
the City of Beaumont, and the provisions of said law, or
any one of them, may be exercised by the governing body
of the City whenever it is deemed advisable so to do.
SEVENTH PROPOS IT ION
Shall the existing Charter of the City of Beaumont be amended
so as to add thereto a new section with reference to airports to
be known as Section 78, to read as follows:
Section 78:
(1) The City of Beaumont shall have power to
acquire or own by purchase, donation, bequest, or
otherwise, all property inside or outside of the City
of Beaumont that it may need for the purpose of es-
tablishing and operating an airport, and to provide for
the accomodation of the United States Mail planes and
other aerial transportation, and it may make suitable
charges therefor. The ownership and operation by the
City of Beaumont of such airport or airports shall be
deemed a municipal purpose, and the City shall pass
sgitable ordinances providing for the fees to be collected
and other charges to be made in the operation of either
municipal or private airports, and shall have full regula-
tory powers thereover, and the said powers shall be
cumulative of and in add it ion to and alternative powers
to those now existing in the Charter of the City of
Beaumont .
(2) All the powers and immunities conferred by
the Acts of the Forty-first Legislature of the State of
Texas with reference to the acquisition, maintenance,
and operation of airports by cities ani Commissioners'
Courts are hereby adopted, and these pavers and immunities
shall be simulative of and in addition to and alternative
powers to those now existing in the Charter of the City
of Beaumont.
EIGHTH PROPOSITION
Shall the existing Charter of the City of Beaumont be amended
by adding thereto a new section with reference to street lighting,
to be known as Section 79, to read as follows:

Section 79:
The City of Beaumont shall have full power to
make local public street improvements by irs talling
and maintaining special lighting systems therefor,
and to assess the cost of said improvements and the
maintenance of the same against property specially
benefitted thereby, and for such purpose all of the
provisions of Chapter 18, Title 28, of the Revised
Civil Statutes of Texas of 1925 are hereby adopted,
and shall be cumulative of and in addition to, and
alternative powers to those now existing in, the Charter
of the City of Beaumont.
NINTH PRCPOSITION
Shall Section 55 of the existing Charter of the City of
Beaumont with reference to salaries be amended to read as follows:
Section 55:
(1) The Mayor shall re ce ive a salary of $1800.00 per
annum, payable monthly, and the Mayor pro tem shall receive
$10.00 for each meeting of the Commission over which he
presides in the absence of the Mayor. The salary of the
City Manager shall be fixed by the City Commission, and
approved by the Council. Each Commissioner shall receive
1200.00 per annum, payable monthly. Members of the
ouncil shall receive $10.00 for each meeting of the
Council attended by him, not to exceed two meetings in
any one month. The directors of the Departments and
other employees of the City shall receive such compensation
as may be fixed by the City Manager, and approved by the
City Commission and Council.
