-L AN O RD MANCE GRANTING TO THE EASTERN TEXAS ELECTRIC COMPANY, A CORPORA- TION, ITS SUCCESSORS AND ASSIGNS, THE RIGHT AND PRIVILEGE TO CONSTRUCT, MAINTAIN AND OPERATE A LINE OF STREET RAILWAY, TO(ZTHER WITH THE NECESSARY TURNOUTS AND PASSING TRACKS, SAID LINE OF STREET RAILWAY TO BRANCH OFF OF ITS PARK STREET CAR LINE ON ECTOR STREET AT ITS INTERSECTION WITH.ALMA STREET, WEST UPON AND ALONG ALMA STREET TWO BLOCKS, AND CONTINUING WEST UPON AND ALONG AN ALLEY OR PASSAGE WAY A FURTHER DISTANCE OF 382.25 FEET TO AVENUE A. WITH THE RIGHT TO TRANSPORT PASSENGERS THEREOVER FOR HIRE IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AND PRESCRIBING THE CONDITIONS THEREOF. BE IT 0 RDA INED BY THE CITY C CMMISSION OF THE CITY OF BEAUMONT: Section le The Eastern Texas Electric Company, its successors and assigns, is hereby granted the right ail privilege to construct, maintain and operate at its own expense a line of street railway for the transportation of passengers in the city of Beaumont, Jefferson County, Texas, said line to branch West from what is known as the Park Car Line on Eetor Street at its intersection with Alma Street, along and over Alma Street a distance of two blocks and continuing in the same general direction on and along an alley or passage way a further distance of 382.25 feet to Avenue A, as per blue print hereto attached and marked "Exhibit A", and made a part hereof, with the further right and privilege to lay, construct anti maintain the necessary turnouts or passing tracks on said street, alley or passageway as it may desire, with the privilege and right to operate street railway cars thereon for the purpose of trans- porting passengers for hire thereon. Section 2. The said Eastern Texas Electric Company, its successors and assigns, shall at its own expense construct and maintain said street railway tracks at the same grade or level as the established grade or level of Alma Street and shall ballast said street between the rails and to a distance of two feet on either side with rock, shell, gravel, cinders, sand or other suitable material to big deter- mined by the City Commission, and to keep same in a good and safe condition kor public travel thereon. t H Section 3. The said Eastern Texas Electric Company, its successors and assigns, shall at its ov+m expense, and under the direction of the City Engineer, construct and maintain good and sufficient cross- ings at the intersection of all cross streets crossed by its said street railway tracks with easy approaches thereto. Section 4. Whereas, this spur track will be used only during the baseball season and for transporting passengers to and from the baseball park, and the grantee may desire to discontinue the same, said company is hereby given the right to discontinue said service on said line, and in the event it does so, it shall within thirty days remove all trackage laid hereunder and place the streets in good condition for travel after removing said tracks, and in the event this line is extended or added to in anyway, this provision of this ordinance shall thereby become null and void. Section 5. If any streets over which this franchise extends are paved while the trackage described herein is maintained, the grantee on crossings on paved streets will construct permanent crossings in accordance with blue print hereto attached marked "Exhibit B" and made a part hereof. Section 6. The foregoing rights and privileges are granted upon the expressed condition that said grantee shall within thirty (30) days after the final passage of this Ordinance, file with the City Secretary of the City of Beaumont its acceptance of this Ordinance. Section 7. This Ordinance is passed subject to all of the terms and provisions of the Charter of the City of Beaumont . Section S. This Ordinance shall go into effect thirty (30) days after -2- its adoption on its third and final reading and riling of accept - ante and shall continue in full force and effect for and, durirg the life of the franchise of the Eastern Texas Electric Company.
