ILRB PASSAGE AND LA:NFUL PTBLICATION; AND DECLARING All EMERGENCY.
Whereas, on the 29th day of February, A. D. 1928, an
ordinance was dul'Apassed by the affirmative vote of all members
of the City Commission of the City of Beaumont whereby a mchool
bond election was ordered to be held within and for the Beaumont
Independent School District insaid city on the 7th day of April,
A.D. 1928; and,
Whereas, due notice of said election was given in the
manner and for the length of time repaired by law; and,
Whereas, in said election held within and for the Beaumont
Independent School District in the City of Beaumont on the 7th day
of April, 1928, the voters of the Beaumont Independent School District
of the City of Beaumont qualified to -vote at said election sathorized
the City Commission of the City of Beaumont to issi e bonds of said
city payable serially from one to forty years from their date, to
bear interest at the rate of 42 per cent per annum, interest payable
annually for the first year and semi-annually for each year thereafter,
said bonds to be in the following amounts and the money to be derived
therefrom,to be used for the following purposes, to wit;
For the construction of a senior high school build-
ing of brick, stone, or concrete material, and -the pur-
chase of the necessary site therefor -------------------- sp"900,000
For the construction of a negro high school of brick,
stone, or concrete material, and the necessary additions,
repairs, and improvements on buildings now in use, and the
purchase of additional sites therefor -------------------- `�600s000
11hereas, it is deemed expedient and advisable at -this time
to issue bonds in the amounts and for the purpose above set forth
under and by virtue of the authority conferred by said election of
.ate April 7, 1928; and,

Whereas, the public free schools of the Beaumont Inde-
pendent School District of the City of Beaumont do not have
sufficient space to properly house the pupils in said district,
and the existing public school buildings are in need of immediate
repairs, and the school children are improperly housed and have
not sufficient space available for class rooms, creating an im-
perative public necessity requiring this ordinance to take effect
immediately as an emergency measure.
NOW, `lh-EhEFORE, BE I`I' ORDAINED B:Y- '1hE CITY COMTJISSION
OF THE CITY- OF BE A UMONT :
Section 1
That the City Cormlission of the City of Beaumont shall
issue bonds as hereinafter described, for and on behalf of and
upon the credit of the Beaumont Independent School District of
the City of Beaumont to borrow to the extent of q�11500,000 to be
devoted to and expended: for the following purposes, to wit:
For the construction of a senior high school
building of brick, stone, or concrete material, and
for the purchasing of necessary site therefor------.c90O,000
For the construction of a negro high school
of brick, stone, or concrete material, and the
necessary additions, repairs, and improvements
on buildings now in use, and the purchase of
additional sites therefor-------------------------600,000
That said bonds provided for herein shall be and are
issued under and by virtue of the Constitution and Laws of the
State of Texas and the Charter of Ihhe City of Beaumont adopted
the 30th day of December, A. D. 1919, and the power and authority
granted by Sections 18 and 71 of the City Charter and all other
provisions of said Charter pertaining to the issuance of said
bonds, and by Chapter 147, General Laws of the State of Texas,
passed by the 33rd Legislature at its regular session granting
certain powers to cities of more than 53000 inhabitants_, and by
Chapter 9 of the Acts of the regular session of the 37th Legis-
lature, and all amendments to said laws, and all other laws of the
State of Texas, pertaining to and authorizing the issuance of
municipal bonds.
Section 2
That said bonds in the sum of ol,.500,000 shall be divided
into two series, and each series divided into forty installments, and
said series of said bonds shall be known and called each respectively
School Bonds of 1928, Series A", and "School.Bonds of 1928, Series .,
and the Mayor of the City of Beaumont is hereby authorized and directed
to have prepared and executed a set of bonds for each of said purposes
as follows:

Said bonds to be payable in lawful money of the United States
of America and each dated the lst day of May, A. D. 1928, each bond
of Series A numbered from 1 to 513 inclusive shall bear interest.at
_ the rate of 4y% per annum, and bonds numbered from 514 to 900 in-
clusive, shall bear interest at the rate of 4�% per annimv,; and bonds
in Series B numbered from 1 to 324 inclusive shall bear interest at

shall bear interest at the rate of 4e per .annurii, interest payable
annually for the "first year on the lst day of May, 1929, and for all
years thereafter payable semi-annually on the lst day of May and the
lst day of November of each year, according to the tenor of the in-
terest coupons to be attached to said bonds:
The Mayor shall sign said.bonds and they shall be countersigned
and attested by the City Clerk and registered by the Director of the
Department of Finance and the seal of the City of Beaumont shall be
impressed upon each of them. The coupons shall be executed with the
lithographed signatures of the 1\'ayor and City Clerk.- Said bonds and
interest coupons shall be payable upon presentation and surrender at
the office of the Director of the Department of Finance of the City
of Beaumont, or at the office of the National City Bank of New York
City, New York, at the option of the holder.
Section 3
The bonds and interest coupons above provided for, upon their
face, shall be subatantially in words and figures as follows; to wit;

York City, New York, at the option of the holder, the sum of Forty--
five Dollars lawful money of the United States of America, being
one year's interest then due on its serial bonds of 1928, Series A,
dated the lst day of May, 1928.

The remaining coupons of said bonds shall bein substantially
the above form, but the coupons attached to bonds numbered from I
to 324 inclusive shall be for the sum of '322.50, being six months`

dvery six months on the lst day of May and the lst day of November

Section 4
It is further ordered that the Mayor be authorized, and he is
hereby directed to take charge of the above described bonds, pending
their investigation by the Attorney General of the State of Texas, and
upon their approval and registration he shall proceed to sell the
same at no less than their face value and accrued interest, at public
or private sale, and the proceeds of such sale shall be deposited with
the Director of the Department of Finance of the City of Beaumont.
The proceeds of said bonds shall be used for the purpose of making
permanent city improvements, to wit:
For the construction of a senior high school
building of brisk, stone, or concrete material
and the purchasing of the necessary site therefor 4900,000

necessary additions, repairs and improvements on
the buildings now in use, and the purchase of ad-

Section 5
It is further ordained that for the purpose of paying the
interest on said School Bonds of 1928, Series A, as well as the
various installments of principal as the same shall respectively
mature, there is hereby levied for the year 1928 and for each suc-
cessive year thereafter as long as the same may be necessary to
provide the interest and annual installments of principal on said
bonds, on all property within the Beaumont Independent School Dis-
trict of the City of Beaumont subject to.taxation an ad valorem tax
of 10.8 cents on each Eil100 valuation on all taxable property in
the Beaumont Independent School District of the City of Beaumont, or
so much thereof, or such other rate of tax as shall be necessary,
and the same shall be so annually assessed and collected and applied, and
said tax_, or so much thereof, or such other tax as may be necessary,
is hereby levied for each year hereafter while said bonds or any of
them are outstanding, and them same shall be annually assessed and
collected and applied to the purpose named.
It is further ordered that for the purpose of paying the interest
on said School Bonds of 1928., Series B.,as well as the various in-
stallments of principal, as the same shall respectively mature, there
is hereby levied for the year 1928, and for each succeeding year there-
after, as long as the same may be necessary to provide the interest and
annual installments of principal of said bonds on all property within
the Beaumont Independent School District of the City of Beaumont subject
to taxation an ad .valorem tax of 7.2 cents on each �'p100 -valuation of
all taxable property in the Beaumont Independent School District of
the City of Beaumont, or so much thereof or such other t,ite of tax_ as
shall be necessary, and the same shall be so annually assessed and col-
lected and applied and said taxes, or so much thereof as may be necessary,
or such other tax as may be necessary, is hereby levied for each year
hereafter while said bonds or any of them are outstanding, and the
same shall be annually assessed, collected, and applied to the purpose
named.
All ordinances and parts of ordinances and all. resolutions and parts
of resolutions inconsistent or in conflict with the provisions of this
ordinance are hereby rescinded and repealed And the ordinance passed
by the City Coirnnission of the City of Beaumont on the 10tr. day of April,
1928, entitled, "An ordinance authorizing and directing the issuance of
serial bonds of the City of Beaumont, bearing interest at the rate of 4'0
per annum, interest payable annually for the first year and semi-annually
on each #enr thereafter, in the sum of "Jp00,000 to be issued for the
purpose of constructing a senior high school building of brick, stone,
or concrete material, and purchasing the necessary site therefor; and
authorizng and directing the issuance of serial bonds of the City of
Beaumont, bearing interest at the rate of 4 -- per an.ntum, interest pay-
able annually for the first year and semi-annually for each year there-
after, in the sum of 1j�600,000 to be issued for the purpose of constructing
a negro high school of brick, stone, or concrete material, a nd the ne-

do not have sufficient space to house the,pupils of the Beaumont
Independent School District and additional building facilities are

state of repair and the school children are improperly housed -and have
not ,sufficient space available for class rooms, Which creates an im-
perative public.necessity requiring the rule that ordinances be read
on three separate days before their passage to be suspended and said
rule is hereby suspended and this ordinance shall be in force and
effect from and after its passage and lawful publication.

NOW, THEREFORE, BE IT ORDAINED BY
THE CITY COMMISSION OF THE CITY
OF BEAUMONT:
SECTION 1.
That the City Commission of the City
of Beauiliont shall issue bonds as herein-
after described, for and on behalf of and
upon the credit of the Beaumont Inde-
pendent School District' of the City of
Beaumont. to borrow to the extent of $1,-
500,000 to be devoted to ,and expended for
the following purposes, to wit:
For the construction of a senior High
school building of brick, stone, or con-
f crete material, and for the purchasing
of necessary site therefor ..$900,000.
For the construction of a negro high
school of brick, stone, or concrete
material, and the necessary additions,
repairs, and improvements on build-
ings, now in use, and the purchase of
additional sites therefor $600,000
That said. bonds provided for herein
shall be and are issued under and by vir-
tue of the Constitution and Laws of the
State of Texas and the Charter of the
City of Beaumont adopted the 30th day
of Decemebr, A. D. 1919, and the power
and authority granted by. Sections 18 and
71: of the City Charter and all other pro-
vision; of said Charter pertaining to the,
issuance of said bonds, and by Chapter
147, General Laws of the. State of Texas,
Passed by the 33rd Legislature at'its regu-
lar session granting certain powers to
cities of more than 5,000 inhabitants, and
by Chapter 9 of the Acts of the regular
session of the 37th Legislature, and all
amendments to said. laws, and all other
laws of the State of Texas, pertaining
to and authorizing the issuance of munic-
ipal bonds.
SECTION 2.
That said bonds fh the sum of $1,500,000
shall be divided nto two series, and each
series divided .into forty installments, and
said series of said bonds shall be known
and called each respectively "School
Bonds of 1928, Series A," and "School
'Bonds of 1928, Series B,"sand the Mayor

Clerk. Said bonds and interest coupons
shall be payable upon presentation and
surrender at the office of the Director of

eral Laws of the State of Texas, passed
by the 33rd Legislature at its regular ses-
sion, granting certain powers to cities of

amendments thereto, and all other laws
of the State of Texas pertaining to and
authorizing the issuance of municipal

cited, and declared that 'all acts, condi-
tions and things required to be, done and
precedent to and in the issuing of these
bonds have been properly done, have hap-
pened and been performed in regular and
due form as required by law, and that
the total indebtedness of the City of
Beaumont and the Beaumont Independent
'School District, including the total in-
debtedness contracted by the issuance of
these bonds, does not exceed the Constitu-
tional or Statutory limitations.
And it is hereby recited, certified, and
declared that the additional tax levied
and made necessary to be levied in order
to provide for the interest and principal
of this issue of bonds, together with the
rate oftax existing at the time of the
issuance ofthese bonds is within the
limitations of the Constitution and Laws
of the State of Texas and of the Charter
of the City of Beaumont.
In testimony whereof the City of Beau-
mont has caused this bond to be issued
and signed by its Mayor, countersigned
and attested by its City Clerk, registered
