14"JHERE�,AS, pursuant to the requirements of Subdivision (h.) of
erection 68 of the Charter of the City of Beaumont, the City Commission
of the City of Beaumont caused to be published for the time and in the
manner required therefor by the City Charter, a notice of -the Resolution
of said Commission passed on the 24th day of January, A.D. 1928, order-
ing a hearing to be given to the persons, firms, corporations, and
estates, their agents or attorneys owning property abutting on all
porticns between and two feet outside of the rails of the railroad
tracks on Railroad Avenue and all unpaved portions on Railroad Avenue
outside of such trackage area from the south side of Crockett Street'
to the north side of College Street, and calling upon all persons
interested_ in said matter to appear and show cause, in conformity with
the provisions of the Charter above referred to, why the assessment
in said notice should not be made against said property and against
the owners thereof, which hearing was to be held in the Council Chamber
of the City Hall of Beaumont, Texas, at four o'clock P.M. on the 14th
day of February, A.D. 1928; and,
';:r.EREA6; A full and fair hearing in conformity with the Charter
and law in such cases having been had in conformity with said notice
and the Commission having inquired into and determined all facts ne-
cessary to the adjudication of all special benefits accruing to such
owners by means of such improvements, and said hearing having been
duly closed; and,
It appearing that the assessment as proposed in the above
mentioned Resolution passed on the 24th day of January, A.D. 1928,
with the exce-ptions hereinafter noted, are in all respects fair and
equitable and that there will be a full and adequate and special bene
fit to the abutting property and the owners thereof from and by reason
of the proposed pavement and improvement in excess of the amount assess-
ed against the abutting property and the respective owners thereof:
NOW, THEREFOI-CE, BEUTT ORDAINED BY THE CITY COMMISSIGI OF
THE CITY OF BEAUI!!ONT:
Section 1
That there is hereby assessed against the several owners of
property and against their respective property abutting on all portions
between and two feet autside of the rails of the railroad tracks on
Railroad Avenue, and all unpaved portions on Railroad Avenue outside
of such trackage area from the south side of Crockett Stre:etto the
north side of College Street, as a tax two-thirds of the cost of paving,
gutter, and incidental drainage of said street&, excluaive of the whole
cost between curb lines of improving said streets at t4e4-i- intersections
with other streets and alleys, and all the cost of curbing said streefp.
The lots, parts of lots, blocks or tracts of land on which said
tax is levied and assessed -are hereinafter described, together with the
number,of front feet on such lot, lots, parts of lots, or blocks or
tracts of land, the name or names of the owner or owners thereof, and
and the proportionate amount of the cost of said paving and gutter,
and the cost of said curbing to be borne and paid for by such owner
or owners as sholrm by the statement prepared by the City Engineer
of the City of Beaumont, which said amount is hereby levied and
assessed as a tax upon such lot, lots, imrts of lots, blocks, or
tracts of land as shown, to wit:

Section 2.
That said amounts so _levied and assessed shall become due and
payable upon the completion of the paving upon the portion of said
street* upon which said lot, lots, Ix its of lots, blocks, or tracts
of land front and abut, and the amount of the tax hereby levied and
assessed, together with the cost of collecting and interest at seven
per cent (7%) per annuiA from the date same is collectable until paid
is hereby declared a lien against said lot, lots, parts of lots,
blocks, or tracts of land superior to all other liens, claims, or
titles except city, county, and state taxes, and constitute a personal
charge or claim against the owner or owners of said lot, lots, parts
of lots, blocks or tracts of land.
Section 3.
The fact that the portions of the above named streeto as
indicated are in bad condition and jeopardize the safety of the
people travelling thereon creates an imperative public emergency
necessitating the susper_sior of the rule requiring Ordinances to
be read on three several days be(Uore their passage. Wherefore,
such rule is hereby suspended, and this Ordinance shall be in full
force and effect from and after its passage and publication.
Passed by the affirmative vote of all members of the Commission

A RESOLUTION
WHEREAS, the City' Commission of the City of Beaumont deems
it advisable to immediately begin the construction of pavement.
on Railroad Avenue fron). the South side of Crockett Street to the
North side of College Street as provided for by contract between
the City of Beaumont and Scott Shambaugh; and,
WHEREAS, funds have not been allocated for that purpose; and
WHEREAS, the congested conditions of traffic on said portions
of said unpaved Street creates an emergency, necessitating the
paving of the said portions of said Streets and requiring this
Resolution to take -effect on the dat-e---of -its passage. - -
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COLDI-KISSION
OF THE CITY OF BEAUMONT
That the sum of Seven Hundred Dollars ($700.00) be segregat-
ed and set aside by the City Clerk of the City of Beaumont from
fund available out of the 1927 Street Bond Funds to be designated
as a 'Special Paving Fund, Railroad Avenue," and that the same
be drawn upon only for meeting•the City's obligation under its
contract with Scott Shambaugh for improving said street;
That any surplus of the above designated fund shall without
action automatically revert.to the general Street Paving Fund
on completion of pavement and settlement of said contract above
metnioned.
WHEREAS, the above mentioned portions of said Street is
badly in need of paving, and the congested condition of traffic
thereon necessitates the immediate paving thereof, thereby
-creating an -imperative_ public emergency requiring the rule
that Resolutions be read on three several days before -passage---
: be suspended, and said rule is hereby suspended, and this
Resolution shall be in full force and effect from and after
its passage.
Passed by an affirmative vote of all members of the Com-
mission and approved this, the -29 day of Mai, A.D. 1928.
