STAFF REPORT
Soutex Surveyors & Engineers is requesting a waiver to the sidewalk requirement for
property located across from 8015 Old Voth Road. The applicant states that sidewalks
would create an economic hardship, impacting the developer's ability to move forward
with the project, as the ditch would need to be filled with reinforced concrete pipe and
inlets. This item has been reviewed by Engineering, and they have no objection to the
request.
The request is unique in that the property is quite narrow and has a long right-of-way
frontage. The sidewalk could potentially be used by school children, as development
increases along RFD Road, for access Roy Guess Elementary. However, pedestrians
would first need to walk down RFD Road's narrow right-of-way (bordered by deep
ditches). Next they would need to cross Old Voth Road to access the sidewalk, and
cross Old Voth Road a second time to reach the school. Conversely, the property to the
north installed all required sidewalks.

My client is requesting sidewalk wavier along Old Voth Road.
The subject property ioaslender triangle shaped property between the feeder road and Old
Voth Road (Across from Stones Crying Out Ministry — 8001 Old Voth Road).

ditches. Our opinion of probable, cost to fill in the ditch with reinforced concrete pipe and
property spaced inlets is $40,000,00. This would create an economic hardship, impacting the
Developer's ability tomove forward with the project,
