A Joint Public Hearing of the Planning Commission and City Council was held on March 18,
2019 and called to order at 3:15 p.m. with the following members present:

APPROVAL OF MINUTES
Alternate Commissioner Craig made a motion to approve the minutes of the Joint Public
Hearings held on January 28, 2019. Vice-Chairman Mason seconded the motion. Motion to
approve the minutes carried 9:0.
REGULAR MEETING
1) Preliminary Plat-Faith Estates, Section 1: Request for a Preliminary Plat approval for
Faith Estates, Section 1, Beaumont, Jefferson County, Texas.
Applicant: Faust Engineering & Surveying, Inc.
Location: West of Helbig Road, South of Plant Road
Mr. Boone presented the staff report. Faust Engineering and Surveying, Inc., has requested
Preliminary Plat approval of Faith Estates, Section 1. The development is located south of
Plant Road and west of Helbig Road. The 9.72 acre development is a forty lot residential lot
subdivision in an R-S (Residential Single-Family Dwelling) District. The proposed streets
will have 60 feet right-of-ways. Grace Lane and Peace Street will have 38 foot pavement
widths and Favor Street will have a 28 foot pavement width. Both Grace Lane and Favor
Streets will access Plant Road. Water and sewer will be provided by extension of City
utilities.
Slides were shown of the subject property. The item was sent to all interested parties.
Mr. Boone stated that the Water Utilities department had concerns about whether or
not the sewer services coming from Plant Road will be adequate enough to serve the entire
subdivision. He added there are also concerns regarding drainage and a detention pond.
Mr. Boone stated that the Planning staff recommended approval of the request with the
following conditions and added an amendment to condition number three (3) see *:
1. Sidewalks must be shown.
2. Temporary cul-de-sac must be installed at the end of Grace Lane. (Fire Department)
3. A temporary ditch will need to be constructed in a private drainage easement which
delivers runoff to the DD6 ditch to the south. A storm drain tie in permit will be required
with DD6 at the outfall, adhering to DD6 requirements. *All private drainage and
detention facilities are to be maintained by the developer and or his assessors or
assigns. All public and private drainage facilities must be approved by the City of
Beaumont Engineering and DD6.
4. Plans for water and sewer infrastructure adequate to serve the entire Faith Estates, must
be approved by Water Utilities prior to construction of any infrastructure and recording
of this or any unit of the subdivision.

No questions or comments for Mr. Boone. The applicant was present. Richard Faust, 2525
Calder Avenue addressed the Commission. Mr. Faust stated he had no objections to the
conditions and that he was in agreement with the amended condition. Chairman Nejad asked
who would be responsible for maintaining the detention pond once all of the lots are sold.
Mr. Faust replied the HOA (Homeowner’s Association) will be responsible for maintaining
the detention pond. No other questions or comments. Chairman Nejad stated that during the
pre-meeting, it was unclear whether or not the subdivision would have a Homeowner’s
Association. Alternate Commissioner Craig made a motion to approve the request for a
Preliminary Plat of Faith Estates, Section 1 with the following amended conditions:
1. Sidewalks must be shown.

2) Replat-Part of Lot 10, Block 4, Lucas Acres: Request for a Replat approval of part of Lot
10, Block 4, into Lots 10A and 10B, Block 4, Lucas Acres Addition, Beaumont, Jefferson
County, Texas.
Applicant: Mark W. Whiteley & Associates, Inc.
Location: 3265 & 3275 Charles Street
Mr. Boone presented the staff report. Thomas Rowe, representing Mark Whiteley and
Associates, Inc. has requested a replat of Lot 10, Block 4 into Lots 10A and 10B, Block 4 of
the Lucas Acres Addition. The purpose of the replat is to create two (2) residential lots, both
of which exceed the minimum lot area depth and width requirements. Water and sewer are
provided by the city. The property is located in flood zone “X” which is outside of the flood
hazard.
Eleven (11) notices were mailed to property owners with 200 feet of the subject property.
None were received in favor or in opposition.
Slides were shown of the subject property. The Planning Staff recommended approval of the
request. The applicant was present. No questions or comments for Mr. Boone. Tom Rowe

representing Mark Whiteley and Associates, Inc., 3250 Eastex Freeway, addressed the
Commission. Mr. Rowe stated that Jeff Akhtar is the owner of the property. No questions or
comments for Mr. Rowe. Alternate Commissioner Craig made a motion to approve the
request for a Replat of part of Lot 10, Block 4 into Lots 10A and 10B, Block 4, Lucas Acres
Addition. Alternate Commissioner Pate seconded the motion. Motion to approve carried 7:0.
3) 892-OB: Request for a sidewalk waiver.
Applicant: Faust Engineering & Surveying, Inc.
Location: West of Helbig Road, South of Plant Road
Mr. Boone presented the staff report. Soutex Surveyors & Engineers is requesting a waiver to
the sidewalk requirement for property located across from 8015 Old Voth Road. The
applicant states that sidewalks would create an economic hardship, impacting the developer’s
ability to move forward with the project, as the ditch would need to be filled with reinforced
concrete pipe and inlets. This item has been reviewed by Engineering and they have no
objection to the request.
The request is unique in that the property is quite narrow and has a long right-of-way
frontage. The sidewalk could potentially be used by school children, as development
increases along RFD Road for access to Roy Guess Elementary. However, pedestrians would
first need to walk down RFD Road’s narrow right-of-way (bordered by deep ditches). Next,
they would need to cross Old Voth Road to access the sidewalk and cross Old Voth Road a
second time to reach the school. Conversely, the property to the north installed all required
sidewalks. Mr. Boone stated that there is a development just to the north that installed
sidewalks.

JOINT PUBLIC HEARINGS
1) File 2373-P: Request for a Specific Use Permit to allow a bible study on property zoned
NC (Neighborhood Commercial) District.
Applicant: Emmanuel Guillory
Location: 3890 Highland Avenue
Mr. Boone presented the staff report. Emmanuel Guillory has requested a Specific Use
Permit to allow a bible study (religious Organization) at 3890 Highland Avenue. The
applicant states that the property would be used for bible study, discussions related to
theology and ocassional bible study classes for college age students from the local university.
Meeting times would initially be Sunday morning from 9 a.m. until 10 a.m. and Wednesday
evening from 6:30 p.m. until 7:30 p.m. Plans are to eventually have other meetings, primarily
in the evening.
Property owner notices were mailed to twenty-two (22) property owners within 200 feet of
the subject property. None were received in favor and one was received in opposition.

Staff recommended approval with the following conditions:
1. Stripe the parking area with the alternative parking layout supplied by City Engineering
and install proper ADA signage.
2. Remove the fence on Brockman Street completely and make it a single fence instead of a
double fence or keep the existing fence and pave the driveway approach with asphalt or
concrete.
2) File 2374-P: Request for a Specific Use Permit to allow a wholesale food preparation
facility in a GC-MD (General Commercial-Multiple Family Dwelling) District.
Applicant: Prentiss Semien
Location: The northeast corner of Grand Street at Miller Street
Mr. Boone presented the staff report. Prentiss Semien is requesting a Specific Use Permit to
allow the construction of a wholesale food preparation facility at the northeast corner of
Grand and Miller Streets. Mr. Semien plans to construct a new facility to prepare, cook and
package pork skins, also known as cracklins.
In August of last year, Mr. Semien received a Specific Use Permit, with the same purpose,
for the property located at 1195 Grand Street. Unfortunately, the building was not repairable,
so Mr. Semien’s plans have changed. Hours of operation will be 8 a.m. until 9 p.m. with a
store front open from 10 a.m. until 9 p.m. The largest shift will have five employees.
