Pate Councilmembers absent: Councilmember Virginia Jordan Also present: Chris Boone, Director of Planning and Community Development Adina Josey, Senior Planner Tyrone Cooper, City Attorney Fran Malvo, Recording Secretary 1 Planning and Zoning January 28, 2019 APPROVAL OF MINUTES Commissioner Senigaur made a motion to approve the minutes of the Regular meeting and Joint Public Hearings held on December 17, 2018. Commissioner Makin seconded the motion. Motion to approve the minutes carried 7:0. JOINT PUBLIC HEARING Mayor Ames called the Joint Public Hearings of January 28, 2019 to order and explained the purpose of the Joint Public Hearing process and then turned the meeting over to Chairman Nejad. Chairman Nejad explained the policies and procedures for the hearing process. 1) File 2370-P: Request for a Specific Use Permit to allow an alcohol and drug rehabilitation facility in an RM-H (Residential Multiple Family Dwelling-Highest Density) District. Applicant: Shalom Health Care Center Location: 950 Washington Boulevard Mrs. Josey presented the staff report. Shalom Health Care Center has requested a Specific Use Permit to allow an alcohol and drug rehabilitation facility at 950 Washington Boulevard. More than half of the property is zoned GC-MD (General Commercial - Multiple Family Dwelling). However, the portion of the property where the alcohol and drug rehabilitation facility will be located is zoned RM-H (Residential Multiple Family Dwelling - Highest Density). The applicants state that the facility will begin by only treating adult female patients, but adult males would not be denied. Patients will remain at the facility for 15- 20 days. The facility will have 8 beds available for detoxification and 16 beds available for residential post-detoxification treatment. In addition, the facility will offer outpatient programs for alcohol and drug abuse. Security will be provided by an eight foot fence around the entire facility along with 24 hour on campus security guards. Security cameras will also be used. Patients will not be allowed outside of the buildings during treatment. Slides of the subject property were shown. Thirty-six (36) notices were mailed to property owners within 200 feet of the property. None were received in favor or in opposition. Staff recommended approval of the request with the following condition: 1. Construction plans must meet all requirements by Water Utilities for water and sanitary sewer services, including the requirement of the City's pre-treatment program. The applicant was present. Dr. Khowaja, 2245 Texas Drive, Suite 300, Sugarland, Texas addressed the Commission. Dr. Khowaja stated that there is not a facility in the Jefferson County area that provides this type of treatment. He also stated that they are providing first priority treatment to women because there is a significantly high rate of drug abuse among women and as a result, children are being placed into foster care. Chairman Nejad questioned fencing around the property. Dr. Khowaja responded fencing will be provided around the entire facility and the patients will not and cannot be visible. Commissioner Senigaur asked 2 Planning and Zoning January 28, 2019 what would be the job qualifications for employee prospects? Dr. Khowaja replied that he plans to partner with Lamar University to seek licensed and qualified students. Mayor Ames asked will the facility be licensed? Dr. Khowaja replied yes. Chairman Nejad asked about what determines patients to be qualified for the program? Dr. Khowaja replied the outpatient department has to have patients with substance abuse and/or chemical dependency. Referrals will be done from the emergency room and/or hospitals and patients will also be allowed to admit themselves in the facility for treatment. Commissioner Javed asked how is the program funded for patients admitting themselves into the facility for treatment. Dr. Khowaja Dr. Khowaja responded private insurance will be accepted along with approved funding from the state. Ken Dollinger, 8235 Shenandoah Drive addressed the Commission. Judge Dollinger stated that he did not attend the meeting to speak in favor of the request but stated that he is the presiding judge for Jefferson County Drug and Alcohol Treatment Court. He stated there is a tremendous need for the facility. No other questions or comments. The public hearing closed. Commissioner Javed made a motion to approve the request for a Specific Use Permit to allow an alcohol and drug rehabilitation facility in an RM-H (Residential Multiple Family Dwelling-Highest Density) District as requested for File 2370-P with the following condition: 1. Construction plans must meet all requirements by Water Utilities for water and sanitary sewer services, including the requirement of the City's pre-treatment program. Alternate Commissioner Pate seconded the motion. Motion to approve carried 7:0. 2) File 2371-P: Request for a Specific Use Permit to allow a Brewpub in a GC-MD (General Commercial-Multiple Family Dwelling) District. Applicant: Christopher Scott Reeves Location: 2140 Calder Avenue Mrs. Josey presented the staff report. Christopher Scott Reeves is requesting a Specific Use Permit to allow a Brewpub at 2140 Calder Avenue. The proposed brewery will be open from 1 p.m. until 10 p.m., Monday through Saturday and 12 p.m. until 6 p.m. on Sundays. Plans are to provide seating inside for approximately 40-50 customers with additional seating available in an outdoor patio area. Craft beer will be produced on site at a rate of approximately 250 barrels per calendar year. All necessary utilities are available. Slides of the subject property were shown. Mrs. Josey pointed out that parking will be accessed through an alley way at the rear of the property. Craft beer will be produced on site. Fourteen (14) notices were mailed to property owners within 200 feet of the subject property. One response was received in favor and none in opposition. Staff recommended approval with the following condition: 1. Construction plans must meet all requirements by Water Utilities for water and sanitary sewer services, including the requirement of the City’s pre-treatment program. 3 Planning and Zoning January 28, 2019 The applicant was present. Scott Reeves, 125 Pine Shadows, Vidor, Texas addressed the Commission. Mr. Reeves stated he plans to employ between two to four employees. He added that the establishment is not a bar or club. Chairman Nejad asked what is the significance of producing 250 barrels on site. Mr. Reeves replied he wants the establishment to remain very small with plans to close early. He also stated he plans to serve wine, have a popcorn machine and will eventually have food trucks on weekends. He will contact TABC for the license. Keith Broussard, 530 Sheldon Road, Channelview, Texas addressed the Commission. Mr. Broussard stated that he was not going to speak, but spoke in favor of the request. Tyler Wharton, 615 Yacht addressed the Commission. Mr. Wharton spoke in favor of the request. The public hearing closed. Commissioner Makin made a request to approve the request for a Specific Use Permit to allow a Brewpub in a GC-MD (General Commercial- Multiple Family Dwelling) District as requested for File 2371-P with the following condition: 1. Construction plans must meet all requirements by Water Utilities for water and sanitary sewer services, including the requirement of the City's pre-treatment program. Alternate Commissioner Pate seconded the motion. Motion to approve carried 7:0. 3) File 2372-P: Request for a Specific Use Permit to allow a Recreational Vehicle (RV) resort in an LI (Light Industrial) District. Applicant: B.K. Broussard Location: 6185 Fannett Road Mrs. Josey presented the staff report. B.K. Broussard has requested a Specific Use Permit to construct a Recreational Vehicle Resort at 6185 Fannett Road. The proposed RV (Recreational Vehicle) resort will provide 73 pads, along with 8 ADA compliant unisex showers, a playground and dog yard. An office/club house will provide laundry facilities and a game room. In September 2017, a request for a Rezoning and Specific Use Permit to allow a 150 unit RV Park was denied for property adjacent to the subject property. That request was also adjacent to single family residences to the northeast. Slides of the subject property were shown. Three (3) notices were mailed to property owners within 200 feet of the subject property. No responses were received in favor or opposition. Staff recommended approval with the following conditions: 1. Construction plans must meet all requirements by Water Utilities for water and sanitary sewer services, including the requirement of the City’s pre-treatment program. 2. Driveway must be approved by TXDOT. The applicant was present. Keith Broussard, 530 Sheldon Road, Channelview, Texas addressed the Commission. The applicant stated he thought the resort would be a good 4 Planning and Zoning January 28, 2019 investment in that vicinity due to more jobs coming into the area. Chairman Nejad asked Mr. Broussard about the game room. Mr. Broussard stated the game room will not have gaming machines. Samuel Fountain, 87 N. IH10, Suite 215 addressed the Commission. Mr. Fountain stated that TXDOT will only allow so many feet from the frontage road for a driveway. A brief discussion followed. Judge Ken Dollinger, 8235 Shenandoah addressed the Commission. Judge Dollinger stated that he not want to speak in opposition of the request due to his friendship with the applicant. He stated he would like to request that a high privacy fence is installed upon approval of the request. The public hearing closed. Commissioner Senigaur made a motion to approve the request for a Specific Use Permit to allow a Recreational Vehicle (RV) resort in an LI (Light Industrial) District as requested for File 2372-P with the following conditions. 1. Construction plans must meet all requirements by Water Utilities for water and sanitary sewer services, including the requirement of the City’s pre-treatment program. 2. Driveway must be approved by TXDOT. Commissioner Javed seconded the motion. Motion to approve carried 7:0. OTHER BUSINESS THERE BEING NO OTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:59 P.M. 5
