HomeMy WebLinkAboutORD 50-Uo IM 1j maw -ON NFAXIM ENTITLED AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, ON THE 1ST.DAY OF NOVEMBER, 1949, TO DETERMINE WHETHER OR NOT THE CITY COUNCIL OF THE CITY OF BEAUMONT_SHALL BE AUTHORIZED TO ISSUE SERIAL BONDS OF SAID CITY FOR THE PURPOSE AND IN THE AMOUNT AS FOLLOWS: FAIRGROLNDS IMPROVEMENT BONDS IN THE AMOUNT OF TWO MILLION DOLLARS ($2,000,000) FOR THE PURPOSE OF 11APROVING THE PUBLIC FAIRGROUNDS OF THE CITY OF BEAUMONT, THE CONSTRUCTION OF A PUBLIC COLISEUM THEREON AND THE PURCHASE OF NECESSARY EQUIPMENT THEREFOR, AND THE CONSTRUCTION, REPAIR, AND IMPROVEMENT OF PUBLIC BUILD- IlVGS THEREON AND THE PURCHASE OF NECESSARY EQUIR14M THEREFOR; AND THE LEVYING -OF A TAX IN PAYMENT THEREOF; MAILING CERTAIN FINDINGS AS TO THE NECESSITY AND ADVIS- ABILITY OF ISSUING SAID BONDS AND MAKING THE IMPROVEMENTS; NAMING THE TIME AND PLACE OF HOLDING SAID ELECTION AND APPOINTING OFFICERS THEREOF, AND PROVIDING THE MANNER OF HOLDING SAID ELECTION AND GIVING NOTICE THEREOF. WHEREAS, the City Council of the City,of-Beaumorit.has found and determined, and hereby finds and determines, that.in the public interest it is advisable, expedient and -necessary to issue serial bonds of said city to provide funds necessary for the improvement of the public fairgrounds of the City of Beaumont, the construction -of a.public coliseum thereon and the purchase of necessary equipment therefor, and the construction, repair and improvement of.public buildings thereon and the purchase.of necessary equipment therefor;' since the public fairgrounds,of the City'of°Beaumont are in need of improvement, and a need exists for a public coliseum for the City -of Beaumont, seating -as many, as 6500 persons; in which can be held public entertainments of the kind sponsored by.'the Music Commission of'the City of'Beaumont, as well as other musical and cultural entertainments, radio and television shows,'ice shows; band concerts, road shows, vaudeville and minstrel shows, flower. shows, manufacturersshows, oil and other in- dustrialt shows and; exhibitions, highschool and'•college basketball and other athletic'.exhibztions,,rodeos and,stock,.shows, conventions, -and other public entertainments for which no -adequate facilities are-now.available, and which are essential to the future growth,,development,and,welfare-of the City of Beaumont. And•there.is need-for:construction, improvement and repair of public buildings on said fairgrounds forthe,benefit:,'.:of the;citizen.s of the City, of Beaumont., . and - such improvements are 'needful. , to the public welfare of the City of. Beaumont and, its inhabitants; and;. WHEREAS, the City Council of the City of Beaumont further finds and determines that the probable period of usefulness of the improvements for '-which the bond funds are to be expended will be in excess of twenty- five years; now, therefore: BE IT ORDAINED BY THE CITY OF BEAUMONT: SECTION 1 That an election be held in the City of Beaumont, Texas, on Tuesday, the lst day of November, 1949, which is not less than fifteen nor more than thirty days from the date of the passage of this ordinance, at which election the following proposition shall be submitted to the resident, qualified electors of said city who own, taxable property in said city and who have duly rendered the same for taxation for their action thereon, and all electors shall vote in the election precinct of their residence. following: SECTION 2 The proposition to be submitted at said election shall be the SHALL the City Council of the City of Beaumont, Texas, be authorized to issue serial bonds of said city in the amount of two million dollars ($2,000,000) for the purpose of improving the public fairgrounds of the City of Beaumont, the construction of a public coliseum thereon and the purchase of necessary equipment therefor, and the construction, repair, and improve- ment of public buildings thereon and the purchase of necessary equipment therefor, said bonds maturing serially in such installments as may be fixed by the City Council over a period of years, not to exceed twenty-five years from their date, bearing interest at a rate not to exceed 5% per annum; and shall there be annually levied, assessed, and collected while said bonds or any of them are outstanding an annual ad valorem tax on all taxable property in the City of Beaumont sufficient to pay the interest on all of said bonds and create a sinking fund sufficient to retire the same at maturity. The probable period of usefulness of the improvements for which the bond funds are to be expended is more than twenty-five years. SECTION 3 The question as to whether or not the City Council of the City of Beaumont shall be authorized to issue said serial bonds shall be submitted on the ballot, and the ballots to be used in said elettinn shall be printed and furnished by the City of Beaumont, as provided by lair, and each ballot shall have printed thereon the followings OFFICIAL BALLOT PROPOSITION FOR THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE PURPOSE OF_IMPROVING TSE PUBLIC FAIRGROUNDS OF THE CITY. OF BEAUMONT,_THE CONSTRUCTION OF,A PUBLIC COLISEUM THEREON AND THE PURCHASE OF_P3ECESSARy EQUIPMENT THEREFOR, AND THE CON- STRUCTION, REPAIR, :AND IMPROVEMENT OF PUBLIC BUILDINGS. THEREON AND THE PURCHASE OF NECESSARY EQUIPMENT THEREFOR, AND THE LEVYING OF A. TAX IN PAYMENT THEREOF AGAINST THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT.FOR.THE PURPOSE.OF IMPROVING THE PUBLIC FAIRGROUNDS OF THE CITY OF BEAUMONT, THE, CONSTRUCTION OF. AND THE CONSTRUCTION, REPAIR, AND IMPROVEMENT OF PUBLIC BUILDINGS THEREON AND THE PURCHASE OF NECESSARY EQUIPMENT THEREFOR: AND THE LEVYING OF A TAX.IN PAYMENT THEREOF SECTION 4 Each voter shall mark out with black ink or black pencil one of the above expressions on the ballot, thus leaving the other as indicating his vote on such proposition® SECTION 5 frr' y Said election shall be held in each of the legal voting precincts within the City of Beaumont, and also in each fractional legal voting precinct in said city where only a portion of such precinct is within the city, and the following places therein, respectively, are hereby designated polling places in the following precincts of said city, and the follow ng -named persons are hereby appointed officers of said elections (1) in voting precinct No. 1 said election shall be held at the French High School Building, and T. B. Hensley is'hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (2) In voting precinct No. 2 said election shall be held at the Junker School Building, and Mrs. J. E. Ray is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (3) In voting precinct No. 3 said election shall be held at the Gladys Street Fire Station, and Mrs. L. E. Downs is hereby appointed presid- ing judge to hold said election, with authority to appoint her assistants and clerks. (4) In voting precinct No. 4 said election shall be held at the Averill School Building, and W. F. Wilson is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (5) In voting precinct No. 5 said election shall be held at the Beaumont High School Building, and Mrs. B. D. Carney is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (6) In voting precinct No. 6 said election shall be held at the Dick Dowling Junior High School Building; and Mrs. E. W. Doty is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (7) In voting precinct No. 7 said election shall be held at the Central Fire Station, and Mrs. G. K.,Rafferty is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (8) In voting precinct No. 8 said election shall be held at the City Hall, and Mrs. Lola B. Martin is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (9) In voting precinct No. 9 said election shall be held at the Fletcher School Building, and Chas. McDonough is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (10) In voting precinct No. 10 said election shall be held at the Court House, and F. E. Carroll is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (11) In voting precinct No. 11 said election shall be held at the David Crockett Junior High School Building, and F. L. Fisher is hereby ap- pointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (12) In voting precinct No. 12 said election shall be held at the Ogden School Building, and Mrs. C. E. Drake is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. D (13) In voting precinct No. 13 said election shall be held at the Sabine Pass Avenue Fire Station, and Mrs. P. B. Derr is hereby appointed presiding judge to hold said election, with authority to appoint her assist- ants and clerks. (14) In voting precinct No. 14 said election shall be held at the Magnolia School Building, and E. A. Godwin is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (15) In voting precinct No. 15 said election shall be held at the South Park Elementary School Building, and Mrs. J. C. Burkhart is here- by appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (16) In voting precinct No. 16 said election shall be held at the Giles School Building, and Mrs. Vernon E. Bazine is hereby appointed presid- ing judge to hold said election, with authority to appoint her assistants and clerks. (17) In voting precinct No. 17 said election shall be held at the Hebert Colored School Building, and A. L. Price is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (18) In fractional part of voting precinct No. 18, lying within. the City of Beaumont, Texas, said election shall be held at the Edwards School Building, and B. F. Quicksall is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (19) In fractional part of voting precinct No. 19, lying within the City of Beaumont, Texas, said election shall be held at 4905 Voth Road, and Frank Allen is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (42) In fractional part of voting precinct No. 42, lying within the City of Beaumont, Texas, said election shall be held at the Lamar College Administration Building, and Mrs. Tom Stephens is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (47) In fractional part of voting precinct No. 4.7, lying within the City of Beaumont, Texas, said election shall be held at St. Anne's School Building, and Mrs. W. T. McNeill is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (50) In fractional part of voting precinct No. 50, lying within the City of Beaumont, Texas, said election shall'.;be held at the J. C. Chance Well Service, Inc., store, at 5360 College Street Extension, and Mrs. J. P. McCarter is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. SECTION 6 Said election shall be held under the provisions of and in accord- ance with the laws governing the issuance of municipal bonds in cities, as provided in the Constitution and General haws of the State of Texas, and the manner of holding said election and making returns thereof shall be governed by the laws of the State of Texas governing general elections; and only qualified electors of said city, who o-vm taxable property in said city and who have duly rendered the same for taxation, shall be qualified to vote at said election, and all electors shall vote in the election precinct of their residence. SECTION 7 A copy of this ordinance, signed by the Mayor of the City of Beaumont and attested by the City Clerk of the City of Beaumont, shall serve as proper and sufficient notice of said election, and the Mayor is hereby directed to cause one each of said notices to be pasted in each of the election precincts and fractional parts of election precincts within the City of Beaumont and at the City Hall, such posting to be not less than 15 full days prior to the date set for said election, and he shall further cause said notice to be published on the same day in each of two successive weeks in a newspaper of general circulation published within said city, the date of the first publication to be not less than 14 full days prior to the date set for said election. And the person posting said notices shall make a return on the copy thereof, showing the times and places of posting, and the return shall be filed in the office of the City Clerk and shall be conclusive evidence of the posting of said notice, and the affidavit of the publisher of the newspaper, stating the days on which the same was published, shall be filed in the office of the City Clerk and shall be conclusive evidence of the pub- lication of said notice. SECTION 8 This ordinance shall take effect from and after the date of its passage. PASSED this, the 11th day of October, 19.9, by the affirmative vote of all members of the City Council of the City of Beaumont, Texas. APPROVED this, the 11th day of October, 1949.
