HomeMy WebLinkAboutORD 41-UAN ORDINANCE ENTITLED AN ORDINANCE AMENDING DIVISION XIV OF CHAPTER 71 OF THE CODE OF THE CITY OF BEAUMONT, AND BEING A PART OF THE ELECTRICAL CODE OF THE CITY OF BEAUMONT ENTITLED "EXAMINATION AND CER- TIFICATION," BY AMENDING ARTICLES 71-40 TO 71-49, AND PROVIDING FOR. THE "EXAMINING BOARD OF MASTER ELECTRICIANS"; FIXING THE DUTIES OF SAID BOARD, THE KIND AND CHARACTER OF EXAMINATIONS, THE RECORDS TO BE KEPT, APPEALS FROM THE _ACTION OF THE BOARD, AND ALSO REPEALING ARTICLES 71-40 TO 71-49., INCLUSIVE, OF CHAPTER 71 OF THE CODE OF THE CITY OF BEAUMONT AS SAID ARTICLES EXISTED PRIOR.TO THE EFFECTIVE DATE OF THIS ORDINANCE, AND ALL OTHER ORDINANCES IN CONFLICT HERMVITH; PROVIDING A PENALTY; PROVIDING SEPARABILITY AND SAVINGS CLAUSE. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Division XIV of Chapter 71, Articles 71-40 to 71-G.9, shall hereafter read as follows: i1Article 71-40. EXAMINATION BOARD CREATED. - There is hereby created the 'Examining Board of Master Electricians,' consisting of five (5) persons. This Board shall determine the qualifications of anyone desiring to enter the business of a master electrician. The members of the Board shall be appointed by the City Manager. "Article 71-41. QUALIFICATIONS OF MEMBERS. - The membership of the Examining Board of Master Elec- tricians shall consist of the following: The City Electrical Inspector; One Electrical Engineer; One Master Electrician; One General Contractor; One .Architect. "Article 71-42. TENURE OF OFFICE. - As soon as this Ordinance becomes effective, a Board shall be appointed whose membership shall hold office from the,date of their appointment for a term ending June 30, 1950, or until their successors have been appointed and qualified; thereafter, a Board shall be appointed on July 1 of each year, the members of which shall serve for a term of one (1) year, unless reappointed ,for a succeeding term. Any member of the Board may be removed by the governing body of the City for cause. Vacan- cies within the Board shall be filled by appoint- ment for the unexpired term. The members of the Board shall serve without compensation. "Article 71-43. POWERS AND DUTIES. - The.Board shall select a Chairman and shall prescribe a pro- cedure and order of business for hearing applica- tions for examination. The City Electrical Inspector shall act as Secretary to said Board. "It shall be the duty of said Board to pass upon the qualifications of all applicants for a license as master electrician to do business in -The City of Beaumont. The Board shall fix the date of examination for such applicants, which examinations shall be held monthly or oftener as may be decided by the:Board. The Board shall make reasonable rules relating to the type of examination required, so as to determine the qualifications of applicants. "Three members of the Board present at any meeting shall constitute a quorum for the.transaction of business, and a majority of the members present and voting shall be necessary to constitute an official action of the Board. "A record of all official transactions of the Board , shall be kept in such a manner as to properly re- flect the business transcribed by said Board, and shall be available to the City Manager and the City Council -at all times. "Article 71-44. APPLICATION FOR EXAMINATION. - All applications for examination shall be made in writ- ing and addressed to the Board and shall be accom- panied by an examination fee of Ten ($10.00) Dollars, The application shall show the number of years of applicant?s experience in the alteration, installation, and repair of electrical wiring and equipment. "The examination fee shall be made payable to The City of Beaumont, and shall include one.examination. "Applications for examination shall be made at the office of the Building Inspector and referred to the Examining Board of Master Electricians. - "The Examining Board of Master Electricians shall prescribe a written examination of a uniform, fair, impartial nature, testing the applicantts knowledge of the electrical ordinances and regulations of The City of Beaumont, and his ability to read simple electrical plans. The Board may prescribe certain other fair, impartial tests of the applicantfs skill and ability to do work involving the alteration, installation, and repair of electrical wiring and equipment. "The examinations shall be graded promptly by the Board and the results of findings of the Board shall be filed with the Building Inspector within ten (10) days of the date of the examination. "Any unsuccessful applicant may make application for re-examination at such reasonable time as may be pre- scribed by the rules adopted by the Board,,and by paying the fee of Ten ($10.00) Dollars. - 2 - J fq "Article 71-45. APPEAL. - Any applicant that is refused a license, or whose license may have been revoked, may appeal "to the Board of Appeals for a review of his case. If an applicant is dissatis- fied with the decision of the Board of Appeals, he shall have the right of final appeal to the City Council, whose judgment as to all matters involved shall be final. "Article 71-46, - LICENSE REQUIRED.' - It shall be unlawful for any master electrician to perform any electrical work within the City of Beaumont without first obtaining a license to do the same. Before receiving a license each applicant for a master elec- trician4s license shall ive a bond to the City in the sum.of One Thousand 51,000.00) Dollars, with such sureties as the City Clerk shall approve, con- ditioned that such person will comply with the ordi- nances and laws relating to electrical wiring, that he will pay all damages, costs, and expenses that may be caused to the City, the owner of the premises or any other person injured by the negligence of him and such persons in his employ, or occasioned by his or their failure. to comply with said laws and ordi- nances. Each applicant, before receiving a license, must pay to the City Fifty 050.00) Dollars for the first year and Ten ($10.00) Dollars for each succeed- ing year. 41Article 71-47. SUSPENSION OR REVOCATION OF LICENSE. - Upon presentation to the Building Inspector of sub- stantial evidence that the folder of any license issued after examination by the Examining Board of Master Electricians has wilfully or persistently vio- lated any provision of the electrical ordinances of the City, or has apparently become incompetent to comply with such provisions, the said Building In- spector may revoke or suspend said license. "Article 71-48. VIOLATIONS AND PENALTY. - Any person, firm, or corporation violating any of the provisions of this ordinance shall be subject to a'fine upon conviction in Cororation Court in any sum not to ex- ceed Two Hundred p$200.00) Dollars, and each and every day of continuance thereof shall constitute a distinct and separate offense. "Article 71-49. SEPARABILITY AND SAVINGS CLAUSE. - If any section, subsection., sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such section, subsection, sentence, clause, phrase, or portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity or constitutionality of the remaining portion thereof." Articles 71-40 to 71-49, inclusive, of Chapter 71 of the Code of The City of Beaumont, as they existed prior to the passage of this ordinance, are hereby expressly repealed. - 3 - PASSED by the City Council this day of July, A.
