Home My WebLink AboutORD 36-UP C&K 5-=4 7/2/49 0�- AN ORDINANCE ENTITLED AN ORDINANCE OF THE CITY OF BEAUMONT TEXAS, RECEIVING AND ACCEPTING THE WORK OF IMPROVING FIRST STREET, FROM THE NORTH PROPERTY LINE OF SOUTH STREET NORTHVJARD TO THE SOUTH EDGE OF P u VEMENT ON LAUREL AVENUE IN THE CITY OF BEAUMONT, TE)P_S; AUTHORIZING AND DIRECTING THE E.XECUTION AND ISSUANCE OF SPECIAL ASSESS- MENT CERTIFICATES TO TROTTI & THOMSON, INCORPORATED, THE CONTRACTOR PERFORMING SAID WORK; APPROVING THE FORM OF SUCH SPECIAL ASSESSMENT CERTIFICATES® BE IT ORDAINED BY THE CITY OF BEAUMONT SECTION 1: That the work of improving the following described street in the City of Beaumont, Texas, to -wit FIRST STREET, from the worth property line of South Street Northward to the South edge of pavement on Laurel Avenue, by raising, grading, filling, widening, paving, repaving or re- pairing same and by constructing such drainage lines and facilities and other incidentals and appurtenances thereto as deemed necessary and adequate by the City Engineer and as provid- ed for in the Plans and Specifications therefor, said paving consisting of the construction of a six-inch (6") Reinforced Portland Cement Concrete Slab with integral curb and of the type and width as provided for in said Plans and Specifications therefore prepared by the City Engineer, and heretofore approved and adopted by said City Council, all of said improvements being as provided for and described in said Plans and Specifications, and all of same having been performed and completed in full accordance with all the terms and provisions of the Contract dated October 28, 1948, between said City of Beaumont, Texas, and Trotti & Thomson, Incorporated; and said Plans and Specifica- tions therein contained; and said City Engineer having measured, examined and caused to be tested the finished improvements by the means and in the manner provided by the terms of said Con- tract and the Plans and Specifications therein contained, and said City Engineer having found that such improvements have been constructed and completed in full compliance with all provisicn s of said Contract and said Plans and Specifications, and said City Engineer having approved and accepted said work and improvements and having heretofore issued his Certificate of Final Acceptance, and so certified to said City Council and recommending that said City Council accept and receive said work and the improvements as constructed and completed by said Trotti & Thomson, Incorporat- ed, and said work and improvements having been examined and found by the Mayor and the City Council of said City of Beaumont, Texas, to have been performed and completed in full compliance with said Contract and said Plans and Specifications therefor, said work and improvements are hereby found by said City Council to -1- r cl, 3�-fit have been performed and completed by said Trotti & Thomson, Incorporated, in full compliance with the terms and provisions of said Contract and said Plans and Specifications therefor, and same are hereby accepted and received by said City Council of the City of Beaumont, Texas, said improvements referred to hereinabove are referred to in that certain contract dated October 28, 1948 as Unit 3,0- .. SECTION 2• That the Mayor and City Clerk of the City of Beaumont, Texas, are hereby authorized and directed to execute and issue to Trotti & Thomson, Incorporated, Special Assessment Certificates, evidencing the assessments levied against the properties improved abutting upon the above described street and against the real and true olrmers thereof, which, by the terms of said Contract, the City of Beaumont, Texas, has agreed and obligated itself to issue and deliver to said Trotti & Thomson, Incorporated, in accordance with the provisions of the Final Assessment Ordinance and other proceedings heretofore had and adopted by said City Council; said Special Assessment Certificates shall be executed in the name of said City or its Mayor and City Clerk, and impress- ed with the seal of said City, and dated as of the date hereof, and such officers are hereby authorized and directed to execute said Certificates in their official capacities on behalf of said City, and deliver same to said Trotti & Thomson, Incorporated, said Special Assessment Certificates having.heretofore been prepared, a copy of which is on file with the City Clerk, the form and contents thereof are hereby approved and adopted. MAYOR C ITY OF EmAUmOmT BE.A.vMorir, TExxs .r N _ a UJI 11 ;Uul;� Zl), 1949 Mayor and City Council City of Beaumont, Texas Gentlemen In accordance with the proceedings heretofore had by your Honorable Body pertaining to the improvement of First Street, from the North property line of South Street Northward to the South edge of pavement on Laurel Avenue, I wish to inform you that the Contractor, Trotti & Thomson, Incorporated, has performed and completed all of the work in improving said street in full accordance with the Plans, Specifications and the Contract therefor dated October 28, 1948, said work being more particularly described in the construction thereupon of a Six Inch (6") Reinforced Portland Cement Concrete Slab together with integral curb, drainage lines and facilities and other appurtenances to such work, I have this date examined the work done as per that certain Contract of October 28, 1948, and find that the Contractor, Trotti & Thomson, Incorporated, has completed the work in a proper and highly satisfactory manner and in full accordance with the. Plans, Specifications and the Con- tract referred to herein. Therefore, I recommend that the City Council accept and receive this work,.
