AN ORDINANCE
ENTITLED AN ORDINANCE OF THE CITY OF BEAUMONT,
TEXAS, RECEIVING AND ACCEPTING THE WORK OF IM-
PROVING TWENTY-THIRD STREET FROM THE SOUTH
PROPERTY LINE OF NORTH STREET SOUTHWARD TO THE
NORTH EDGE OF PAVEMENT ON CALDER AVENUE IN THE
CITY OF BEAUMONT) TEXAS, AUTHORIZING AND DIRECT-
ING THE EXECUTION AND ISSUANCE OF SPECIAL ASSESS-
NENT CERTIFICATES TO TROTTI & THOMSON, INC.,
THE CONTRACTOR PERFORMING SAID WORK; APPROVING
THE FORM OF SUCH SPECIAL ASSESSNENT CERTIFICATES.
BE IT ORDAINED BY THE CITY OF BEAUMONT :
SECTION 1:
That the work of improving the following described street
in the City of Beaumont, Texas, to -wit:
TWENTY-THIRD STREET, from the South
Property line of North Street Southward
to the North Edge of Pavement on
Calder Avenue,
by raising, grading, filling, widening, paving, repaving or re-
pairing same and by constructing such drainage lines and facili-
ties and other incidentals and appurtenances thereto as deemed
necessary and adequate by the City Engineer and as provided for
in the Plans and Specifications therefor, said paving consist-
ing of the construction or reconstruction of a Three -course Hot
Mix Asphaltic Concrete Pavement of five inches (5") total thick-
ness with Inverted Concrete Curb Type 1, all of the type and
width as provided for in said Plans and Specifications therefor
prepar'°ed by the City Engineer, and heretofore approved and adopted
by said City Council, all of said improvements being as provided
for and described in said Plans and Specifications, and all of
same having been performed and completed in full accordance with
all the terms and provisions of the contract dated October 28,
1948, between said City of Beaumont, Texas, and Trotti & Thomson,
Inc., and said Plans and Specifications therein contained; and
said City Engineer having measured, examined and caused to be tested
the finished improvements by the means and in the manner provided
by the terms of said Contract and the Plans and Specifications
therein contained, and said City Engineer having found that such
improvements have been constructed and completed in full com-
pliance with all provisions of said Contract and said Plans and
Specifications, and said City Engineer having approved and
accepted said work and improvements and having heretofore issued
his Certificate of�nal Acceptance, and so certified to said
City Council and r commending that said City Council accept and
receive said work and the improvements as constructed and com-
pleted by said Trotti & Thomson, Inc., and said work and improve-
ments having been examined and found by the Mayor and the City Council
of said City of Beaumont, Texas, to have been performed and com-
pleted in full compliance with said Contract and said Plans and
Specifications therefor, said work and improvements are hereby
found by said City Council to have been performed and completed
by said Trotti & Thomson, Inc., in full compliance with the
terms and provisions of said Contract and said Plans and Speci-
fications therefor, and same are hereby accepted and received
by said City Council of the City of Beaumont, Texa.sa said im-
provements referred hereinabove are referred to in that certain
Contract dated October 2$, 1948, as Unit 8.
SECTION 2:
That the Mayor and City Clerk of the City of Beaumont
Texas, are hereby authorized and directed to execute and issue
to Trotti &. Thomson, Inc., Special Assessment Certificates evi-
dencing the assessments levied against the properties improved
abutting upon the above described street and against the real
and true owners thereof, which, by the terms of said Contract,
the City of Beaumont, Texas, has agreed and obligated it self
to issue and deliver to said Trotti & Thomson, Inc., in accordance
with the provisions of the Final Assessment Ordinance and other
proceedings heretofore had and adopted by said City Council; said
Special Assessment Certificates shall be executed in the name of
said City by its Mayor and City Clerk, and impressed with the
seal of said City, and dated as of the date hereof, and such
officers are hereby authorized and directed to execute said Certi-
ficates in their official capacities on behalf of said City, and
deliver same to said Trotti &, Thomson, Inc., said,Special Assess-
ment Certificates having heretofore been prepared, a copy of
which is on file with the City Clerk, the form and contents.there-
of are hereby approved and adopted.
PASSED BY THE CITY COUNCIL, this the 1 t-, day of
June, 1949.

Gentlemen:
In accordance with proceedings heretofore
had by your honorable body pertaining to the improvement
of Twenty-third Street, from the South property line of
North Street Southward to the North edge of pavement on
Calder Avenue, I wish to inform you that the contractor,
Trotti & Thomson, Inc., has performed and completed all of
the work in improving said street in accordance with the
Plans, Specifications and the Contract therefor dated
October 28, 1948, said work being more particularly des-
cribed as the construction thereupon of a three -course hot
mix asphaltic concrete pavement of five inches (511) total
thickness with inverted concrete curb type one, drainage
lines and facilities and other appurtenances to such work.
I have examined the work done as per that
certain contract of October 28, 1948, and find that the
contractor, Trotti & Thomson, Inc., has completed the work
in a proper and highly satisfactory manner, and in full
accordance with the Plans, Specifications and the Contract
herein referred to.
Therefore, I recommend that the City Council
accept and receive this work.
