AN ORDINANCE
ENTITLED AN ORDINANCE ORDERING AN ELECTION TO
BE. HELD _IN THE . CITY_ OF, BEAUMONT ON THE. 21ST. DAY
OF JUNE, .1949, T0. DETERMINE WHETHER. OR NOT . THE
CITY OF BEAUMONT SHALL TRANSFER.TO-THE PORT.OF
BEAUMONT.NAVIGATION DISTRICT_THE,PORT PROPERTIES,
ASSETS,.LANDS,_MONIES AND FUNDS ON HAND, AND.FAC-
ILITIES,_PROVIDING. THE PORT DISTRICT SHALL ASSUME
THE.UNPAID AND.OUTSTANDING.INDEBTEDNESS OF THE
CITY WHICH HAS BEEN.INCURRED BY.IT.FOR PORT
WHARF AND -DOCK PURPOSES; NAMING THE_PLACES.IT
WHICH SAID.ELECTION SHALL BE.HELD.; APPOINTING
JUDGES TO.PRESIDE OVER SAID ELECTION; PROVIDING
FOR THE.MANNER OF HOLDING SAID ELECTION, AND
GIVING NOTICE THEREOF.
WHEREAS, Senate Bill No. 335, passed by the current session
of the Legislature of the State of Texas,.signed by the Governor of
Texas on May 11, 1949, and becoming effective immediately, creates
the Port of Beaumont Navigation District of Jefferson County, Texas,
and Sections 7 and 25 of said Bill authorize and instruct The City
of Beaumont to call a special election in the said City for the pur-
poses stated in said Act; and,
WHEREAS, it appearing to the City Council that said elec-
tion should be held on Tuesday, the 21st day of June, 1949, within
the hours provided by law for the holding of a general election in
said City;
NOW, THEREFORE, BE -IT ORDAINED BY THE CITY OF BEAUMONT,
TEXAS:
Section 1.
That a special election be held in The City of Beaumont on the 21st
day; of June, A.D. 1949, for the purpose of submitting to the quali-
fied voters of The City of Beaumont the following matters:
Section 2.
Shall The City of Beaumont transfer to the Port of Beaumont
Navigation District the port properties, assets, lands, monies and
funds on hand, and facilities, providing the Port District shall
assume the unpaid and outstanding indebtedness of the City which has
been incurred by it for port, wharf and dock purposes.
Section 3.
The:said election shall be held in The,City of :Beaumont at ,
the following places, to wit:
French School; Junker.School, Gladys Street Fire
Station, Averill School; Beaumont High School,
Dick Dowling Junior HighSchool, Central Fire -
Station, the City.Hall, Fletcher,.School;.Jeffer
son. County Court House, David Crockett Junior High
School, Ogden.School,-Sabine Pass Avenue Fire Sta-
tion, Magnolia,School, South Park Elementary School -
Giles School, Hebert Colored School, Edwards.School,
Sonth.Park,High School, St. Annets School, Beaumont
Courts on College Street Extension.
That all voters'residing'in County Voting Precinct No. 1
shall vote at the French-School,Build3ng; that all voters residing.
in County Voting Precinct No..2 shall vote at. the Junker School -
Building;. that all voters' -residing in County Voting. Precinct No. 3
shall vote,at the Gladys.Street Fire Station; that all voters re-
siding,in County Voting Precinct No. 4. shall vote at -the Averill
School Building; that all voters residing in County Voting Precinct
No. 5 shall vote at the'Beaumont'High School Building;'that all
voters residing in County Voting Precinct No..6 shall vote at the
Dick Dowling Junior _High School Building; that all voters.residing
.in County Voting Precinct No. 7.shall vote at the Central Fire
Station; that all voters residing in County Voting Precinct No.
shall vote at the City Hall;_that all voters-rbsiding in County Vot-
ing Precinct No. 9 shall vote at the Fletcher School Building; that
all voters residing in County Voting Precinct No.. 10 shall vote at -
the Jefferson County Court Hous; that all ,voters residing in County
Voting Precinct'�No'..11' shall vote.at David,.Crockett Junior High
School Building; that allvoters.residing in -.County Voting Precinct
No. 12 -shall vote at the Ogden School Building; that all:voters-re-
siding in County Noting Precinct No..13 shall vote at the Sabine Pass'
Avenue Fire Station;.that all voters residing in County Voting Pre -
No. l�. shall vote at the Magnolia School Building; that.all
voters, residing in County Voting Precinct No. 15'shall vote at the
South Park Elementary School Building;,'that all voters residing in
County Voting Precinct No. 16. -shall vote.at the GilesxSchool Build-
ing; that all -voters residing in County Voting Precinct No. 17 shall
vote at the Hebert Colored School_ Building; that all voters residing
in County Voting Precinct No. 18 shall vote at Edwards School Build-
ing; that all voters residing in County Voting Precinct No. 4.2 -shall
vote at the South Park High School Building; that all voters residing
in County Voting Precinct No. 4.7'shall vote at St. Annets School
Building; that all voters residing in County Voting -Precinct No. 50
shall vote at Beaumont Courts on'the College Street Extension.
Section 4..
The following named persons.are appointed presiding judges
for their respective voting boxes in said wards with the authority
to select and appoint their own clerks:

There shall be printed on the ballot to be used in said
election the following:
FOR TRANSFERRING TO THE PORT OF BEAUMONT NAVIGATION
DISTRICT THE PORT.PROPERTIES, ASSETS, LANDS,.MONIES
AND FUNDS.ON HAND, -AND FAGILITIES,.PROVIDING THE -
FORT DISTRICT -SHALL ASSUME-THE.UNPAID AND OUTSTANDING
INDEBTEDNESS.OF.THE CITY.WHICH HAS.BEEN.INCURRED BY
IT_FOR PORT, WHARF AND.DOCK.PURPOSES.
AGAINST TRANSFERRING TO THE PORT OF BEAUMONT NAVIGA-
TION DISTRICT .THE PORT PROPERTIES, ASSETS, LANDS,
MONIES.AND FUNDS ON HAND AND.FACILITIES, PROVIDING
THE PORT DISTRICT SHALL �SSUME THE UNPAID AND OUT-
STANDING INDEBTEDNESS OF THE CITY WHICH_HAS BEEN.
INCURRED BY.-IT.FOR PORT, WHARF.AND DOCK PURPOSES.
All voters desiring to support the proposition and permit
the transfer of the Port properties, assets, lands, monies and
funds on hand, and facilities to the Port of Beaumont Navigation
District shall run a line through or across that section of said
proposition which begins with the word "AGAINST", and all voters
desiring to vote against the above stated proposition shall run a
line through or across that section of said proposition beginning
with the word "FOR".
Section 7.
That said election shall be held under the provisions of
the State laws governing elections, and the qualifications of those
voting thereat shall be controlled by the provisions of the State
law governing elections, and only those qualified,to vote residing
within the corporate limits of The City of Beaumont shall be allowed
to vote at said election.
Section 8.
A copy of this ordinance, signed by the Mayor of The City
of Beaumont and attested by the City Clerk of The City of Beaumont,
shall serve as proper and sufficient notice of said election, and
the Mayor is hereby directed to cause one each of said notices to be
posted in each of the election precincts and fractional parts of
election precincts within The City of Beaumont, and at the City Hall,
such posting to be not less than fifteen (15) full days prior to the
date for said election, and he shall further cause said notice to be
published on the same day in each of two successive weeks in a news-
paper of general circulation publiched within said City, the date of
the first publication to be not'°less than fourteen (14) full days
prior to the date set for said election. And the person posting said
notices shall make a return on the copy thereof, showing the times
and places of posting, and the return shall be filed in the office of
the City Clerk and shall be conclusive evidence of the posting of
said notice, and the affidavit of the publisher of the newspaper,

stating the days on which the same was published, shall be filed
in the office of the City Clerk and shall be conclusive evidence
of the publication of said notice.
