The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with
the Texas Open Meetings Act, Texas Government Code, Chapter 551 on April 2, 2019, at the City
Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following:

Mayor Ames called the council meeting to order at 1:30 p.m.
Pastor Airon Reynolds with Borden Chapel Missionary Baptist Church gave the invocation. Mayor
Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Jordan, Getz,
Sam, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City

GENERAL BUSINESS
WORKSESSION
Review and discuss the proposed Small Cell Ordinance
Tyrone Cooper, City Attorney discussed the proposed Small Cell Ordinance with Council. Mr.
Cooper discussed changes to a new draft ordinance after meeting with AT&T, stated that for
background purposes the City of Beaumont and the State of Texas are subject to an FCC
Order that has, in some instances preempted the State Legislation that the Ordinance that
the City adopted in 2017 was based upon. The City is confronted with the FCC Order and
State Law, the City is subject to both orders. The FCC Order is presently in litigation by the
National League of Cities and the State Legislation is in litigation in a McAllen, TX lawsuit,
both are being reviewed and maybe even overturned. Mr. Cooper stated that on last week
an ordinance was presented Council 'arid today another one is presented with changes.
Spoke to Council regarding the changes, such as the application fee, the change has gone
from $100.00 to $250.00 (this was a suggestion from AT&T), this fee is for additional network
nodes that may be requested as part of the application process. For the first five nodes
there will be a $500.00 application fee, and for all nodes after the first five there will be
$250.00 fee per node. The next change is the definition of Network Nodes, AT&T has
suggested that the last sentence under Network Node in the Ordinance be deleted, Mr.
Cooper stated that he had no problem with the deletion and requested it be removed.

The State has given the City as a Home Rule Municipality a fiduciary duty to protect its
rights-of-way and manage the public streets to protect the health, safety and welfare of its
citizens. In that regard, determining who enters and how they enter the streets rights-of-way
and how they compensate the City for being in the rights-of-way is a main issue. Mr. Cooper
stated that is the primary issue in the State litigation. The basis of which is that the State is
now telling the City they have to charge a certain rate for the use of the right-of-way, in one
instance the State is saying the use of the City's right-of-way is a $28.00 per month charge.
Stated that in Texas there's an anti -gift constitutional provision, this means that cities can't
just give away city's funds and properties to private entities or anyone for basically nothing,
the standard would be market value. What the City would determine to be market value
would be the reasonable rate that the City would charge anyone for the use of the rights-of-
way, one of the big issues in this whole discussion is that it be nondiscriminatory. The
service providers are stating that the City should not discriminate against them as it might
relate toother users of the City's rights-of-way, other users could be Entergy, Centerpoint or
the Cable Companies. Mr. Cooper stated that the City has franchise agreements with those
companies he just spoke about and those companies pay the City a percentage of their
annual gross receipts for the use of the City's rights-of-way. It is not being provided in this
legislation that the providers provide or pay the City a percentage of their gross revenues,
stated that he's sure the City would be willing to accept a percentage of AT&T, T -Mobile,
Sprint and Verizon's gross revenues as a fee for the use of the rights-of-way, stated to
Council that this isn't being provided to the City and that's the issue in the lawsuit, that the
providers should be providing to the City what is market value for the use of the rights -of -
ways.
Mr. Cooper directed Council's attention to the section that discussed the annual and monthly
rates of right-of-way rentals, stated that this would be fees that would be put in the ordinance
as a kind of book mark, this would be the market value that the City would charge for the use
of it's rights-of-way, with the understanding that a vendorwould be charged the statutory rate
initially. Should the cities prevail in the litigation then the City would have the opportunity to
go back and invoice for the difference, should the Cities not prevail then the providers would
not owe the Cities any more money. Mr. Cooper stated that Section 14.03.205 subsections
(a) (b) and (c) are new provisions in the ordinance. Those provisions would be called
reoccurring or annual fees to be paid.
The other big issue is spacing, originally in the 2017 ordinance there was a minimum of 300
feet of spacing between each utility pole. The 300 feet spacing was reduced to 150 feet,
again the proposal is to keep the 150 feet. Mr. Cooper discussed the mixing and matching
that was mentioned earlier. The FCC Order specifically speaks to spacing, it doesn't set a
spacing distance per say, but it addresses the ability to space. There may also have been
some confusion about the effective date, there is an effective date of April 15, 2019. The
effective date addresses the Local Astatic Regulations that primarily deals with and includes
the spacing issue, the City is using the regulation because the FCC Order allows the City to
do so. The State statute is silent on spacing, it speaks to distance limitation and the phrase
is used one time, stated that he couldn't find anywhere else that spacing is addressed.
Mr. Cooper also discussed the application process, the time (which is considered the shot
clock) that the City needs to be aware of.

GENERAL BUSINESS
Consider an ordinance repealing in its entirety Article 14.03, Division 4, Right of Way
Management Regulations of Chapter 14, Streets and Sidewalks, of the Code of Ordinances
of the City`of Beaumont and replacing it with the New Article 14.03, Division 4, Right of Way
Management Regulations, to conform to new rules adopted by the FCC -Federal
Communications Commission regarding Small Cell Technology.
On August 28, 2017, Ordinance No. 17-054 and No. 17-055 were adopted in Chapter 14
to conform to new State Legislation for Small Cell Technology.
On September 26, 2018 the FCC issued a declaratory ruling, report and order, FCC WT
Docket No. 17-79 adopting new rules addressing the deployment of small .wireless facilities
in public right of ways. These rules took effect January 14, 2019 and Staff have made the
changes regarding Small Cell Technology to conform to the new ruling from FCC.
Staff recommends repealing the existing Article 14.03, Division 4 of Chapter 14 and adopting
as new.

BEAUMONT, TEXAS, REPEALING IN ITS ENTIRETY ARTICLE 14.03, DIVISION 4, RIGHT-OF-WAY
MANAGEMENT REGULATIONS, OF CHAPTER 14, STREETS AND SIDEWALKS, OF THE CODE OF
ORDINANCES OF THE CITY OF BEAUMONT, AND REPLACING IT WITH THIS NEW ARTICLE 14.03, DIVISION
4, RIGHT=OF-WAY MANAGEMENT REGULATIONS, TO CONFORM TO NEW RULES ADOPTED BY THE
FEDERAL COMMUNICATIONS COMMISSION PURSUANT TO ITS DECLARATORY RULING, REPORT, AND
ORDER RELATED TO SMALL CELL TECHNOLOGY AND ADOPT OTHER MINOR CHANGES, AND PROVIDING
A PENALTY CLAUSE, A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVING CLAUSE, A
PUBLICATION CLAUSE AND AN EFFECTIVE DATE. Mayor Pro Tem Mouton seconded the motion.

Stated that he's `speaking again regarding the issue of the L.L. Melton, feels that his
concerns aren't making much progress.as it relates to the facility, stated that he had several
things that he would like to ask of the Council, number one, feels that there needs to be a
declaratory judgement done, there's a contract quandary, this is not to slight the City

Attorney or any other lawyer present, the community reads the contract on the Melton one
way, the City Attorney and other lawyers that are a part of the City Council reads it one way
and the lessee reads it one way, we need someone that is transcendent above us all to take
a look at the contract, realizes that it would cost the City money, with that being said and so
that there will not be some horrid use of City funds, asked that the City send the bill to him,
wanted to go on record saying that if the Council decides to do the declaratory judgement it
won't cost them a penny, stated if the sum of $26,000.00 can be raised to buy back guns
surely they can raise money to keep a facility open and operative, number two, there was a
proposal that was done, time was taken to create and put this lease together, there seems to
be no outcry from City leaders regarding things that the current lessee said she would do but
is currently not doing, there's no football, baseball, or real community meetings and never
has been, stated that he would like to know why, why isn't Council bothered by the fact that
Dr. Farrell has made these promises and not fulfilled any of them to the community, number
three, the best proposal that was put on the table was by Mayor Ames, Mayor Pro Tem
Mouton and Councilmembers Jordan and Samuel, that was to forge an afterhours relational
structure so that after she's not in the building it can be utilized, number four, there is a
rumor that the building is going to be appraised and that makes him think sale, stated that he
wants to go on the record saying that if it became for sale he would be the first one in line to
try and purchase the facility, however a sale with a lease in it as long as the current lease
exist is a heavy benefit to the lessee, it really puts it in Dr. Farrell's hands, lastly as the
citizens elected officials, they expect the Council to fight for them, a vote for the community
is a vote for themselves, stated that they have a deep seeded concern regarding the Melton
and they aren't going away, asked everyone that was in attendance regarding the Melton to
please stand so that Council can see that he doesn't stand alone and he will not stand alone,
stated that they don't want Dr. Farrell to be moved, they are better together than they are
apart

Stated that it's very clear to him that the Council has no intention of doing anything regarding
the Melton facility, regarding the rumors that are circulating about the City selling the facility,
if it's a rumor then that's good for Council, if it's not a rumor then it's bad for the City, again,
the City Council continues to present its self as being a voice of the people but the evidence
shows that the City Council isn't a voice for the people but a voice for themselves, whatever
Council has on it's agenda it's only conducive for them as long as it benefits them and their
areas, the other parts of the City Council allows them to go without, youth have nowhere to
go, Council sits and makes it appear that they are working hard and tirelessly to make sure
things are done and it's not, certain Councilmembers make sure that their constituents are
taken care of, other Wards don't get that because they don't have a voice, stated to Mayor
Pro Tem Mouton that she needs speak up, the constituents of her Ward need to hear her,
everyone else is speaking up but not her, made comments regarding the City Manager

Thanked Mayor Pro Tem Mouton for the work that she's done, thanked Councilmember
Samuel for the work that he's done, stated he needs to do a lot better, stated to
Councilmember Pate that he needs to go, all he talks about is Lamar and the State Fair,
informed the Mayor that she's got a lot of people backing behind her and it seems she will be
around for a while, stated to Councilmember Sam that he needs to go home that he has
nothing to bring to the City of Beaumont, also stated to Councilmember Getz that he was a

racist and he needs to go home and that if he ever tries to run for Mayor he will never get to
sit in that seat, stated to Councilmember Jordan that she's a little to old and she needs to go
home, told all of Council that they have been in their positions too long, they need to let
some of the younger people come in and do something different for the City, they aren't
doing anything and should open this City up and let people enjoy it
Enoch Dixon 4575 Cartwright St. Beaumont TX
Spoke to Council regarding water standing on his street and in front of his driveway, stated
that this has been going on since December, went through a time frame and explained what
happened from one month to the next regarding the standing water, stated that everyone
one on his street has to drive on one side due to the standing water, as of today the issue is
still a problem, the City came out and did some work but hasn't solved the problem

Thanked Mr. Kemp who was in the audience and a citizen regarding the issue that he
brought forward to Council at the intersection of Dowlen and Concord where he requested
either a blinking light or bringing the stop signs in closer due to citizens running the four way
stop signs that were previous placed, she was in opposition of the suggestion. in the
beginning because she thought it would back up traffic coming off of Dowlen onto Concord,
since the change the traffic is flowing better and just wanted to thank Mr. Kemp for bringing
the suggestion to Council, also stated that rehab work has started on Roland Rd. and Barrett
St., the work is being done quickly and it looks great, wanted to thank Council and City staff
for addressing this issue as quickly as they did

Commented on the locked restrooms afthe Park by the Event Centre between the hours of
8:00 a.m. and 5:00 p.m., when citizens bring their kids during that time and have to use the
restroom they can't because it's locked, if something can be done about that it would be
great, also stated if people think that there's nothing to do in Beaumont she suggested that
they look at all the parks that the City has, there's lots of good places to play football and
basketball they are all public places, stated that good things are being done in Beaumont
and yes better things can be done, the Council is trying to get things done, stated that there
is also a sheet on the table as you come into the Council Chambers that gives information
regarding the streets that will be worked on

Stated that he stands as a very expensive tax payer, the issue that he has is when the City
spends his tax dollars and doesn't consider him, there's a lot of people that sit in the
audience that has been in attendance at these meetings over and over again regarding the
same issue, the L.L. Melton, stated that Council works for the people but are a
representation for the wrong people, the people that don't even live in this community like
Dr. Farrell that operates the Melton facility, stated that she is receiving the same benefits as
Exxon Mobil is receiving from the State of Texas, Exxon Mobil brags about saving $50 billion
dollars a quarter and they don't put any of those dollars backintothe community, this is what
is happening to our community and this is why a lot of people are frustrated during election
season, what Council needs to do is the right thing by the people, stated that there a lot of

things that aren't happening correctly, asked that Council get things that need to be done
and to get them done right

Spoke to Council regarding the issue that he's been dealing with in the fraud case that he
was involved with, stated that his constitutional rights are being denied and doesn't think it's
right, he's not receiving the information in writing that he wants, asked that the City Council
give him what he wants in writing, justice will be done and he will take this to the news and
point out the injustice of what he's been going through as a tax payer and senior citizen

Spoke to Council regarding the L.L. Melton facility lease agreement, stated that he had a
copy of the lease agreement which is a contract, stated that a contract is.a bargain for an
exchange of promises to be made, stated that his law license is as good as anyone else, he
stated that he would like to discuss the language in the agreement to see what kind of
promises were made by the City and what promises were made by Dr. Farrell, in the
agreement it states that "the lessee (Dr. Farrell) further agreed that the facility will be open to
the general public for recreational purposes during regular hours as long as it doesn't
unreasonably interfere with the lessees services" stated that he's not saying that the contract
should be broken or renegotiated but that the contract should be enforced, there is no desire
by anyone to interfere with the services of Dr. Farrell, that's why the community wants to
utilize the facility after her hours and on the weekends so that there is no interference, a
contract'unlike a human it's blind to emotions, that's why you can't enforce one side of a
contract without enforcing the other provision of a contract, stated to Councilmember Getz
that he wanted over $800,000 dollars for eight more Police Officers but hasn't seen one
penny being asked to help our at risk youth get off the street, to him that is unreasonable,
asked Council where do they think crime comes from, criminals don't popup as grown adults,
they start as children, asked how many Councilmembers are interested in reducing the crime
and drug addiction, they can protect the kids from this cruel world by the decisions they
make
J.D. Roberts 5475 Landry Ln. Beaumont TX
Stated that the last time he attended the Council meeting he thinks that Councilmember
Jordan asked the City Attorney about a contract that he presented to Council stating that Dr.
Farrell had a contract with Jefferson County, stated that the information wasn't true, it was a
lie, the County stated to him that they had no idea who would be at the L.L. Melton facility,
after surveying and looking at the letter that was sent to the County Judge by Mr. Boone
there was no indication that Dr. Farrell was going to be on the lease or was going to have
another lease, the City needs to be transparent about this, if Dr. Farrell has a lease with the
County then say that she does, the problem is that. the County still hasn't received a copy of
the lease, this lease has been in place since 2013, the County has no knowledge as to
whose signatures are on the lease or anything, at the last meeting that he attended the City
Manager instructed him to get a copy of the agreement from the City Attorney, after the
meeting the City Attorney walked out of the Chambers without giving him a copy, stated that
he still would like to get a copy of the lease between Dr. Farrell and the County, believes that
there isn't an agreement, also stated to the City Attorney that Dr. Farrell may have one with
him and that he should have removed himself from the situation and that Mr. Cooper knows
really what is going on, there is a perception that the City Attorney gives to everyone, stated

to Council that they can all work this out together, asked that the land be given to them, he's
already asked to buy the land but it can't be. bought because the county is in a lease with the
City, no one knew the City was leasing the land for $20.00 a month, made additional
comments about the first time he checked the tax office web site he saw where the land
belonged to Jehovah-Jireh, he checked a second time and it changed from Jehovah-Jireh to
the City of Beaumont, asked that Council get it together and give them the land
Councilmembers/City Manager/City Attorney comments on various matters

COUNCILMEMBER JORDAN - STATED THAT COMMENTS WERE MADE REGARDING THE
POSSIBILITY OF COUNCILMEMBERS TAKING CARE OF THEIR
OWN AREAS OF THE CITY AT THE EXPENSE OF OTHERS,
WANTED TOGO ON THE RECORD TO SAY IF ANYBODY WANTS TO
GO OUT WITH PENCIL AND PAPER AND MAKE NOTE ON WHO HAS
LIBRARY'S AND COMMUNITY CENTERS ETC., WARD I DOES NOT,
HER INTEREST IS FOR THE ENTIRE CITY AND CERTAINLY WARD

EVERYONE TO KNOW THAT THE ISSUE REGARDING THE
MELTON HAS NOT GONE UNNOTICED, KNOWS THAT THE
SUPPORTERS AREN'T HAPPY WITH THE WAY THAT IT'S GOING,
THERE ARE SOME ON COUNCIL THAT DO CARE ABOUT WHAT
HAPPENS, ASKED THAT EVERYONE TRY TO WORK WITH THEM,
DOESN'T KNOW WHAT CAN COME FROM THIS BUT SHE'S
ALWAYS BEEN ONE TO TRY, WE HEAR THEM AND CAN ONLY DO
THE BEST THAT THEY CAN WITH THE CONSTRAINTS THAT THEY
HAVE, COMMENTED ON THE NECHES RIVER FESTIVAL, IT'S FOR
THE ENTIRE CITY, ENCOURAGED EVERYONE TO SUPPORT IT
AND TAKE THE KIDS TO THE PARADE THEY WILL SURELY ENJOY
IT, COMMENTED ON FIRE STATION #1 AND HOW HAPPY THE
FIRE FIGHTERS ARE IN THEIR NEW FACILITY, ALSO MENTIONED
THE FILL THE BOOT CAMPAIGN FOR MUSCULAR DYSTROPHY
THAT KICKED OFF EARLIER TODAY
