HomeMy WebLinkAboutORD 34-TC&K 5-2 0-3 10-25-48 AN ORDINANCE ENTITLED AN ORDINANCE DETERMINING THAT CERTAIN STEPS HAVE HERETOFORE BEEN TAKEN IN CONNECTION WITH THE CONSTRUCTION OF IMPROVEMENTS ON CERTAIN STREETS NAMED HEREIN BELOW WITHIN THE LIMITS THERE DESCRIBED; ACCEPTING THE BID OF TROTTI & THOMSON, INC. FOR THE CONSTRUCTION OF SAID IMPROVEMENTS AS THE LOWEST AND BEST RES- PONSIBLE BID THEREFOR; AWARDING A CONTRACT TO SAID TROTTI & THOMSON, INC. UPON SAID BID FOR SAID IMPROVEMENTS; APPROVING THE CONTRACT, PERFORMANCE AND MAINTENANCE BONDS EXECUTED BY TROTTI & THOMSON, INC., AND ITS SURETY FOR SAID IMPROVEMENTS; AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE AND ATTEST SAID CONTRACT FOR, AND ON BEHALF OF THE CITY OF BEAUMONT; MAKING APPROPRIATION OF FUNDS FOR THE PAYMENT OF THE CITY OF BEAU11VIONT1S SHARE OF THE COST OF SAID IMIPROVE- MENTS, AND DIRECTING THE CITY ENGINEER TO PREPARE AND FILE WITH THE CITY COUNCIL ESTIMiATES OF THE COST OF SAID IMPROVEIMENTS AS REQUIRED BY LAW. BE IT ORDAINED BY THE CITY OF BEAUMONT: SECTION 1: The City Council of the City of Beaumont, Texas, hereby finds and determines: (a) That bids for the improvement of the herein below named streets within the limits designated were received and opened in public meeting on September 28, 1948, pursuant to advertisements for such bids published for the length of time and in the manner required by law and the Charter of said City, vehich bids were at that time referred to the City Manager for study and recommendation; and (b) That thereafter the City Manager did make recommendation to the City Council at its meeting held on October 5, 1948, reco- mmending that the bid of Trotti & Thomson, Inc., in the sum of $p142,954.39 be accepted, and pursuant to which recommendation the City Council did accept said bid as being the lowest and best bid by responsible bidder for the construction of said im- provements; and lu� (c) That thereafter at the same meeting the City Council passed a resolution approving the contract per- taining to said improvements and author- izing the City Manager to execute said contract with Trotti & Thomson, Inc., on behalf of the City of Beaumont and the Clerk to attest to same and affix the seal of the City thereto; and (d) That thereafter Trotti & Thomson, Inc. executed said Contract, Performance Bond and Maintenance Bond, said bonds being executed by an acceptable Surety Company, all pursuant to its bid proposal and in accordance with the Notice to Bidders and General Specifications, all of which are in the form and manner as req- . uired by law and the Charter of said City; and that said Contract so executed, and the Performance Bond and the Maintenance Bond have been presented to and filed with the City Council and same are found to be in due and proper form and acceptable to the City Council; and (e) That thereafter the City Engineer prepared and filed with the City Council an estimate of the portion of the costs of said improvements to be paid by the City of Beaumont, said estimate being the sum of $66,740.82; and it is hereby found and determined that there are available funds on hand in the treasury of said City of Beaumont sufficient to cover costs to the City of Beaumont and available for appropriation for such use. SECTION 2: That the bid of Trotti & Thomson, Inc., for the construction of improvements on the following named streets, within the limits designated and according to Unit numbers as designated herein below and in the Contract Documents pertaining hereto, in the sum of $142,954.39 be, and the same is hereby accepted as the lowest and best bid by a responsible bidder, and the Contract for the construct- ion of said improvements is hereby awarded to 'the said Trotti & Thomson, Inc., upon said bid: Unit 1: South Street, from the West property line of Mariposa Street Westward to 4.5 feet East of center line of Southern Pacific main line track near First Street. -2- Unit 2: South Street, from 4.5 feet West of center line of Southern Pacific main line track near First Street Westward to the East property line of Fourth Street. Unit 3: First Street, from the North property line of South Street Northward to the South edge of pavement on Laurel Avenue. Unit 4: Angelina Street, from the East prop- erty line of Fourth Street Eastward to the East property line of Third Street. Unit 5: Guffey Street, from the North property line of Angelina Street Northward to the South property line of Pecos Street. Unit 6: Minor Street, from the South property line of South Street Southward to the North property line of Pecos Street. Unit 7: Eighth Street, from the North property line of South Street Northward to the South property line of Laurel Avenue. Unit 8: Twenty-third Street, from the South property line of North Street South- ward to the North edge of pavement on Calder Avenue. Unit 9: North Street, from the West property line of Twenty-third Street Westward to include the intersection of Central Drive and North Street. Unit 10: Harrison Street, from the West prop- erty line of Pine Street Westward to the East property line of Grand Avenue. Unit 11: Fourth Street, from the North line of College Street Northward to the North right-of-way line of the Southern Pacific main line track South of Angelina Street; said accepted bid calls for the construction or reconstruction of six_ inches (61r) Reinforced Portland Cement Concrete pave- ment together with Integral Curb and Gutter on Units 1, 2, 3, 4, 9, 10, and 11, and the construction or reconstruction of a Three -Course Hot Mix Asphaltic Concrete Pavement five inches (5") total thickness with Inverted Concrete Curb Type 1 -on Units 5, 6, 7, and 8. SECTION 3: That said Trotti & Thomson, Inc., having already executed and submitted to the City Council for its approval the Contract, Performance Bond, and Maintenance Bond as required by the Notice to Bidders and the General Specifications for the construction of said improvements, such Contract, Performance and Maintenance Bonds are hereby approved and accepted as in full compliance with all requirements of the law and the Charter of said City and of the Notice to Bidders and General Specifica- tions covering said improvements, and that the Surety on said -3- Performance and Maintenance Bonds be, and the same are hereby approved and accepted; further, that,the City Manager and City Clerk of the City of Beaumont, Texas, are hereby authorized and directed to execute and attest said Contract for and on behalf of the City of Beaumont, Texas. SECTI-ON 4.: That there is hereby,appropriated out of the Street and Highway Bond Fund, Series 1948, the sum of $66,710.82 to pay the City's portion of the cost of said improvements under the above Contract therefor, and proper Warrants are hereby auth- orized to be issued in said amount, or so much thereof as may be necessary against said fund to pay and discharge the obligations of the City of Beaumont, chargeable thereto under said Contract. SECTION 5: That the City Engineer of said City is hereby directed to prepare and file with the City Council estimates of the costs of such improvements and estimates of the amounts per front foot proposed to be paid by and assessed against the properties abutting upon each of said streets concerned in each of the,Eleven Units above set out and heretofore ordered im- proved, based upon the bid prices as per each Unit contained in the above described Contract, all as required by, and in accordance with, the provisions of the Acts of the First Called Session of the 40th Legislature of the State of Texas, 1927, Chapter 106, said Act being commonly known as Article 1105-b of the Revised Civil Statutes of the State of Texas, 1925, as amended, and the provisions of Article XIV, Section 2, of the Charter of the City of Beaumont. Included in the above estimated cost figure are the following: Amount to be paid by the City to Trottie & Thomson, Inc., $50,055.62 being 4016 of the total cost less Engineering fee of 82-f. Engineering fee of 82j of the total cost. 12,191.20 Amount,to be paid by the City to Trottie & Thomson, Inc., 4,494.00 being the amount owing by the City because of the City's ownership of property abutting on Guffey, North, and Fourth Streets. 66,74{?.82 The streets to be improved, also designated by Unit numbers as set out in the Contract Documents concerning these improvements, are the following: Unit 1: South Street, from the West property line of Mariposa Street Westward to 4.5 feet East of center line of Southern Pacific main line track near First Street.
