STREET WITHIN THE LIMUTS HEREINBEL ET DESCRIBED; ACCEPTING THE BID OF TROTTI & THO:'SON, INC. FOR THE CONSTRUCTION OF SAID I1iPROVEI;(ENTS AS THE LOWEST AND. BEST RESPONSIBLE BID. THEREFOR; AWARD- ING A CONTRACT TO SAID TROTTI & THOI,:SON, INC. UPON SAID BID FOR SAID I0ROVEIIENTS; FAKING APPROPRIATION -OF FUNDS FOR THE PAYMENT SF THE CITY OF BEAUMONT'S SHARE OF THE -COST OF SAID IMPROVEKENTS ; APPROVING THE CONTRACT, PEREPRMANCE AND MAINTENANCE BONDS EXECUTED BY SAID CONTRACTOR AND ITS SURETY FOR SAID I12ROVE11ENTS , AND AUTHORI Z- ING THE CITY MANAGER AIM CITY CLERK TO EXECUTE AND ATTEST SAID CONTRACT FOR, AND ON BEHALF OF THE. CITY OF, BEAUMONT . BE IT'ORDAINED BY THE CITY OF BEAUMONT SECTION 1. The City Council of the City of Beaumont) Texas hereby finds and determines. - (A) That the City Commission of the City of Beaumont, being the then governing body of, said City, has here- tofore received- and: copened in public meeting, bids for the improvement of north Street, from the West, Line of Eleventh Street to the East Line of Calder Place Addition, pursuant to advertisements for such bids published for the length of time -and in the manner as required 'by last and the Charter of said City, which bids Trere by said City Commission referred to the City Manager for tabulation and recommendation:; and (b) That thereafter said City Manager did make recommendation to said City Commission at -its meeting held on March..23, 1948, recommending that the,bid of Trotti & Thomson, Inc., in the sum of 58,120.58 for the construction of�said improvements be accepted, and pursuant to which recommendation said City Commis- sion did,accept said bid as being the loigest and best bid by responsible bidder for. the construction of said improvements; and (c) That thereafter, the City Engineer prepared-dfid filedwith the City Council an estimate of the portion of the costs of_said improvements to be paid by the City of Beaumont, said estimate being the sum of 2 s?z 6. 90 ; and it is hereby found and ,.de t—ei-m—ined that there are ,available funds on hand in the treasury of said City of Beaumont sufficient to cover said costs to the City of Beaumont and available for appropriation for such use; and (d) That said Trotti & Thomson, Inc. has exe- cuted a proper contract, Performance Bond and Maintenance Bond, said bonds being executed by an acceptable Surety Company, all pursuant to its bid proposal and in accordance with the Notice to Bidders and General Specifications, all of which are in the form and manner as required by late and the Charter of said City; and that said Contract, Performance Bond and Ifaintenance Bond have been presented to and filed with the City Council and same are found to be in due and proper form and acceptable to the City Council. SECTION 2. That the bid of Trotti & Thomson, Inc. for the construc- tion of said improvements in the sum of $58,120.58 be, and the same is hereby accepted as the loMest and best bid by a responsible bidder, and the contract for the construction of said improvements is hereby awarded to the said Trotti & Thomson, Inc. upon said bid. SECTION 3. That said Trotti & Thomson, Inc., having already executed and submitted to the City Council fox -its approval the Contract, Performance Bond and M-aintenance Bond as required by the Notice to Bidders and the General Specifications for the construction of said improvements, such Contract, Performance and I;raintenance Ponds are hereby approved and accepted as in full compliance with all require- ments of the late and the .Charter of said City and of the Notice to Bidders and General Specifications covering said improvements, and that the Surety on said Performance and Maintenanae Bonds be, and the same are hereby approved and accepted; further, that the City Manager and City Clerk of the City of Beaumont, Texas, are hereby authorized and directed to execute and attest said. Contract for and on behalf of the City of Beaumont, Texas.
