HomeMy WebLinkAboutORD 7-TV„ ------- +---- AN ORDINANCE ENTITLED AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF BEAUMONT ON TITS 21st DAY OF JUNE, 1947, TO DE- TERMINE WHETHER OR NOT THE CITY COMMISSION OF THE CITY OF BEAU- MONT SHALL BE AUTHORIZED TO ISSUE SERIAL BONDS OF SAID CITY FOR THE PURPOSES AND IN THE AMOUNTS AS FOLLOWS: WATERWORKS REVENUE BONDS IN THE AMOUNT OF $210001000 AND PLEDGING THE REVENUE OF THE CITY'S WATERWORKS SYSTEM TO THE PAYMENT THEREOF; SERIAL BONDS OF THE CITY OF BEAUMONT IN THE AMOUNT OF $2,0009000 FOR THE PURPOSE OF IMPROVING, EXTENDING; AND REPAIRING THE STREETS AND HIGHWAYS OF THE CITY OF BEAUMONT AND THE LEVYING OF A TAX IN PAYMENT THEREOF; SERIAL BONDS OF THE CITY OF BEAUMONT IN THE AMOUNT OF $1.,000,.000 FOR -THE. -PURPOSE OF IMPROVING, -:EXTENDING, AND REPAIRING THE STORM SEWERS OF THE CITY OF BEAUMONT AND THE LEVYING OF A TAX IN PAYMENT THEREOF; -SERIAL BONDS OF THE CITY OF BEAUMONT IN THE AMOUNT OF $500,000 FOR THE PURPOSE OF IM- PROVING, EXTENDING, AND REPAIRING THE SEWERAGE SYSTEM OF THE CITY OF BEAUMONT 4ND THE LEVYING'OF A TAX IN PAYMENT THEREOF; SERIAL BONDS OF THE CITY OF BEAUMONT IN THE AMOUNT OF $3259000 FOR THE PURPOSE OF BUILDING, IMPROVING, REPAIRING, AND EQUIP- PING FIRE STATIONS, AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLIANCES, AND ACQUIRING NECESSARY SITES THEREFOR, AND THE LEVYING OF A TAX IN PAYMENT THEREOF; SERIAL BONDS OF THE CITY OF BEAUMONT IN THE AMOUNT OF $275,000 FOR THE PURPOSE OF BUILD- ING, IMPROVING, REPAIRING, AND EQUIPPING POLICE STATIONS, AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLIANCES, AND AC- QUIRING NECESSARY SITES THEREFOR, AND THE LEVYING OF A TAX IN PAYMENT THEREOF; SERIAL BONDS OF THE CITY OF BEAUMONT IN THE A- MOUNT OF $759000 FOR THE PURPOSE OF ENLARGING, IMPROVING, RE- PAIRING AND EQUIPPING THE PUBLIC LIBRARY BUILDING, AND THE PUR- CHASE OF NECESSARY APPURTENANCES AND APPLIANCES THEREFOR, AND THE LEVYING OF A TAX IN PAYMENT THEREOF; MAKING CERTAIN FIND- INGS AS TO THE ADVISABILITY AND NECESSITY OF ISSUING SAID BONDS AND MAKING THE IMPROVEMENTS THEREIN CONTEMPLATED; NAMING THE TIME AND PLACE OF HOLDING SAID ELECTION AND APPOINTING OFFICERS THEREOF; PROVIDING THE MANNER OF HOLDING SAID ELECTION AND GIV- ING.NOTICE THEREOF; AND DECLARING AN EMERGENCY. WHEREAS, the City Commission of the City of Beaumont has found and determined, and hereby finds and.determines, that in the public interest it is advisable, expedient, and neces- sary to issue serial bonds of said City to provide funds neces- sary for the public improvements herein mentioned, especially in view of the fact that the City has recently extended its limits so as to include within said limits approximately twenty additional square miles of territory, in which additional terri- tory not heretofore included within the limits of the City of Beaumont, there are many inhabitants and many residential and business buildings and property,, necessitating public services and improvements mentioned in this ordinance, and the public improvements existing within the original limits of the City of.Beaumont, as well as its waterworks system, will of necessi- ty have to be improved, repaired., and extended to meet the ne- cessities not only of the properties and inhabitants residing within the original corporate- -limits of the City-- of- -Beaumont,- - - but as well as those residing within the limits of the City of Beaumont as extended-, and such improvements, extensions, and. repairs are necessary to protect the public property, the public health, the public safety, and promote the public wel- fare of the City of Beaumont and its inhabitants; and that the improvements, extensions and repairs of the City waterworks system, the streets and highways, the sewerage system, the storm sewers, the public library, the fire stations, and the police station, should be made and completed at the earliest practicable time, and that the existing necessity for such is urgent and imperative; and, - 1 - 6-3_190 WHEREAS, the City Commission of the City of Beaumont finds and determines -that under the terms of the Charter of the City of Beaumont, Section 11 thereof, the City of Beau- mont has the exclusive right to erect, own, maintain, and operate waterworks, to make additions thereto and improve- ments and extensions thereof within and outside the city limits, and to acquire the necessary rights -of -way for the use of said City and its inhabitants, and to regulate the same, prescribe rates for water furnished, and to make such rules and regulations with reference thereto as the City may deem expedient; and to do anything whatsoever necessary to operate and maintain said works, and to compel the owners of property and agents of said owners to pay all charges for' water furnished upon such property; and, WHEREAS, under Section 11, Paragraph (2), of the Charter of the City of Beaumont, it is provided.that, "All receipts and revenues derived from the operation of the water- works shall constitute a separate and sacred fund, which shall never be diverted or drawn upon directly or indirectly, or through any means or under any guise or disguise whatsoever, for any other purpose than the extension, improvement, oper- ation., maintenance, repair and betterment of the waterworks supply; but the City Commission may appropriate or pledge such receipts and revenues for the purpose of extending, improving, operating, maintaining and bettering -the water plant and mains and water supply, also for the purpose of discharging or re- tiring the indebtedness of the city that may be incurred or accrued for waterworks purposes."; and, WHEREAS, it is provided under Article 1111, et seq., of the Revised Civil Statutes of the State of Texas, and amend- ments thereto, that all cities and towns in the State of Texas, including the City of Beaumont, shall have power to mortgage and encumber the- income of the water systems, to evidence the obligations thereof by the issuance of bonds, notes, or warrants, to secure the payment of funds for the purpose of improving, en- larging, extending, or repairing said system, and that no such obligation of any such system shall ever be a debt of any such city, but solely a charge upon the properties and revenues of the system so.encumbered, and shall never be reckoned in de- termining the power of -the City to issue bonds for any purpose authorized by law; and, WHEREAS, the City Commission of the City of Beaumont .. now finds and determines that there is present urgent public need and necessity of improving, extending, and repairing the waterworks system of the City of Beaumont in order to render to the inhabitants thereof the same character of service as heretofore rendered by said waterworks system to the inhabit- ants thereof, and that the amount of money required at this time.for the purpose of making the necessary extensions, im- provements, and repairs of such waterworks system will greatly exceed.the current income of said.waterworks system, and it has become necessary to borrow money and to issue bonds and to pledge and encumber the future -income and revenues of the -water- works system for the payment thereof, without attempting to en- cumber the properties of the waterworks system, and without in- curring -any debt of the City of Beaumont, and without -providing for the levy of any property tax to pay the same; and, WHEREAS, the City Commission of the City of Beaumont finds and determines that the City of Beaumont has power and authority, under Section 18, of the Charter of the City of Beaumont, by a vote of the majority of the qualified taxpay- ing voters voting thereon, to issue bonds for the purpose of - 2 - L JD - t q q_-°, improving, extending, and repairing the streets and highways of the City of Beaumont, and to build, repair, and purchase, or otherwise acquire sewerage systems:, storm sewers, police stations, fire stations, libraries, and such other appurte- nances and appliances as may be necessary and proper to carry out any of the purposes above stated, and for any other public improvements which the City may deem expedient, necessary and beneficial to the advancement of the City; and, WHEREAS, the City Commission of the City of Beaumont finds and determines that it is expedient, beneficial, and necessary to the advancement of the City to construct the im- provements mentioned in this ordinance, and to -improve, extend, and repair the streets and highways,_the sewerage system, and the storm sewers of the City, and to build, improve, repairs and equip fire stations, and purchase necessary appurtenances, appliances and sites therefor; and to build, improve, repair, and equip police stations and purchase necessary appurtenances, appliances and sites therefor; and enlarge, improve, repair, and equip the public library and to purchase necessary appurte- nances and appliances therefor; now, therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT: Section 1 That an election be held in the City of Beaumont, Texas, on the 21st day of June, 1947, which is not less than fifteen nor more than thirty days from the date of the -passage of this ordinance, at which election the following propositions shall be submitted separately to the qualified electors of said City who own taxable property in said City and who have duly render- ed -the same for taxation:, and all electors shall vote_ in -the e- lection precinct of their residence. Section 2 The first proposition to be submitted at said election shall be the following: PROPOSITION NO.,1 SHALL the City Commission of the City of Beaumont, Texas, be authorized to issue serial bonds of said City, being revenue bonds, in the amount of $2,000,000, for the purpose of constructing improvements, enlargements, extensions and repairs to the City's waterworks system, said bonds maturing serially in such installments as may be fixed by the City Commission over a period of years, not to exceed thirty (30) years from their date, bearing interest at a rate. not to exceed four per cent (4%) per annum, to be issued in accordance with and se- cured in the manner provided in Article 1111 to 1118, both in- clusive, of the Revised Civil Statutes of Texas, 1925, as a- mended, each bond to -be conditioned -that -the holder thereof__ shall never have the right to demand payment of said obli- gation out of funds raised or to be raised by taxation, se- cured by an exclusive first lien on and pledge of the reve- nues and income of the City's waterworks system after deduction of reasonable operation and maintenance expenses. Section 2a In the event said waterworks revenue bonds are author- ized, no such obligation of such waterworks system shall ever be a debt of the City of Beaumont, but solely a charge upon - 3 - the revenues and income of the waterworks system, and shall never be reckoned in determining the power of the City of Beaumont to issue any bonds for any purpose authorized by law; and said bonds shall each have printed thereon the follow- ing: "The holder hereof shall never have the right to demand payment of this obligation out of any funds raised or to be raised by taxation". Section 3 The second proposition to be submitted at said election shall be the following: PROPOSITION NO. 2 SHALL the City Commission of the City of Beaumont, Texas, be authorized to issue serial bonds of said City, in the amount of $2,000.,0001 for the purpose of improving, ex- tending., and repairing the streets and highways of the City of Beaumont, said bonds maturing serially in such install- ments as may be fixed by the City Commission, over a period of years,'not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed four per cent (4�) per annum9 and shall there be annually levied, assessed, and collected, while said bonds or any of them are outstanding, an annual ad valorum tax on all taxable propertyin the City of Beaumont sufficient to pay the interest on all of said bonds and create a sinking fund sufficient to retire the same at maturity. Section 4 The third proposition to be submitted at said election shall be the following: .PROPOSITION NO. 3 SHALL the City Commission of the City of Beaumont, Texas, be authorized to issue serial bonds of said City, in the amount of $1,000,000, for the purpose of improving, ex- tending, and repairing the storm sewers of the City of Beau- mont, said bonds maturing serially in such installments as may be fixed by the City Commission over a period of years, not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed four per cent (4%) per an- num, and shall there be annually levied, assessed, and col- lected, while said bonds or any of them are outstanding, an annual ad.valorem tax on all taxable property in the City of Beaumont sufficient to pay the interest on all of said bonds and create a sinking fund sufficient to.retire the same at maturity. Section 5 The fourth proposition to be submitted at said e- lection shall be the following: PROPOSITION NOo 4 SHALL the City Commission of the City of Beaumont, Texas, be authorized to issue serial bonds of said City, in the amount of $500,000, for the purpose of improving, extend- ing, and repairing the sewerage system of the City of Beaumont, said bonds maturing serially in such installments as may be fixed by the City Commission, over a period of years, not to -4- ex - ceed thirty (30) years from their date, bearing.interest at a rate not to exceed four per cent (476) per annum, and shall there be annually levied,'assessed, and collected, while said bonds or any of them are outstanding, an annual ad valorem tax on all taxable property in the City of Beau- mont sufficient to pay the interest on all of said bonds and create a sinking fund sufficient to retire the same at maturity. ✓' ���� Section 6 The fifth proposition to be submitted at said election shall be the following: _ PROPOSITION NO. 5 SHALL the City Commission of the ,City of Beaumont, Texas, be authorized to issue serial bonds of said City, in the amount of $325,000, for the purpose 'of building, improv- ing, repairing, and equipping fire stations., and the purchase of necessary appurtenances and appliances, and acquiring neces- sary sites therefor, said bonds maturing serially in such in- stallments as may be fixed by the City Commission, over a per- iod of years, not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed four per cent (4J) per annum, and shall there be annually levied, assessed, and collected, while said bonds or any of them are outstanding, an annual ad valorem tax on all taxable property in the City of Beaumont sufficient to pay the interest on all of said bonds and create a sinking fund sufficient to retire the same at maturity. Section 7 The sixth proposition to be -submitted at said election shall be the following: PROPOSITION NO. 6 SHALL the City Commission of the City of Beaumont, Texas, be authorized to issue serial bonds of said City, in the amount of $275,000� for the purpose of building, improv- ing, repairing, and equipping police stations, and the pur- chase of necessary appurtenances and appliances., and acquir- ing necessary sates therefor, said bonds maturing serially, in such installments as may be fixed by the City Commission, over. a period of years, not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed four per cent (4%) per annum, and shall there be annually levied, as- sessed, and collected, while said bonds or any of them are outstanding, an annual ad valorem tax on all taxable property in the City of Beaumont sufficient to pay the interest on all of said bonds and create a sinking fund sufficient to retire the same at maturity. Section 8 The seventh proposition to be submitted at said election shall be the followings PROPOSITION NO. 7 SHALL the City Commission of the City of Beaumont, Texas, be authorized to,issue serial bonds of said City, in the amount of $759000, for the purpose of enlarging, improv- -5- ing, repairing, and equipping the public library building, and the purchase of necessary appurtenances and appliances therefor, said bonds maturing serially, in such installments as may be fixed by the City Commission,over a period of years, not to exceed thirty (30) years from their date, bearing inter- est at a rate not to exceed four per cent (4%) per annum, and shall there be annually levied, assessed, and collected, while said bonds or any of them are outstanding, an annual ad valor- em tax on all taxable property -in the City of Beaumont suf- ficient to pay the interest on all of said bonds and create a sinking fund sufficient to retire the same at maturity® Section 9 The -question as to whether or not the City Commission of the City of Beaumont shall be authorized to issue said ser- ial bonds, or any of them, shall be submitted separately on the ballot as to each of the above seven propositions, and the bal- lots to be used in said election shall be printed and furnished by the.City of Beaumont, as provided by law, and each ballot shall have printed thereon the following: OFFICIAL BALLOT FIRST PROPOSITION FOR THE ISSUANCE OF THE 1ATERWORKS REVENUE BONDS AND THE PLEDGING OF THE REVENUES OF THE CITY'S WATERWORKS SYSTEM TO THE PAYMENT THEREOF. AGAINST THE ISSUANCE OF THE WATERWORKS REVENUE BONDS AND THE PLEDGING OF THE REVENUES OF THE CITY'S WATERWORKS SYSTEM TO THE PAYMENT THEREOF. SECOND PROPOSITION FOR THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF-BEAUMONT FOR THE PURPOSE OF IMPROVING, EXTEND- ING AND REPAIRING THE STREETS AND HIGHWAYS OF THE CITY OF BEAUMONT, AND THE LEVYING OF A TAX IN PAY- MENT THEREOF. AGAINST THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE PURPOSE.OF IMPROVING, EXTENDING AND REPAIRING THE STREETS AND HIGHWAYS OF THE CITY OF BEAUMONT, AND THE LEVYING OF A TAX IN PAYMENT THEREOF. THIRD PROPOSITION FOR THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE PURPOSE OF IMPROVING, EXTEND- ING AND REPAIRING THE STORM SEWERS OF THE CITY OF BEAUMONT, AND THE LEVYING OF A.TAX IN PAYMENT THEREOF. AGAINST THE ISSUANCE OF THE SERIAL BONDS OF THE -- CITY OF BEAUMONT FOR THE PURPOSE OF IMPROVING, EXTENDING, AND REPAIRING THE STORM SEWERS OF THE CITY OF BEAUMONT, AND THE LEVYING OF A TAX IN PAYMENT THEREOF. FOURTH PROPOSITION FOR THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE PURPOSE OF IMPROVING, EXTEND- ING AND REPAIRING THE SEWERAGE SYSTEM OF THE CITY OF BEAUMONTS AND THE LEVYING OF.A TAX IN PAYMENT THEREOF. /AGAINST THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE.PURPOSE OF IMPROVING9 EXTENDING AND REPAIRING THE SEWERAGE SYSTEM OF THE CITY OF BEAUMONT, AND THE LEVYING OF A TAX IN PAYMENT THEREOF. FIFTH PROPOSITION FOR THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT-FOR THE PURPOSE OF BUILDING, IMPROVING, REPAIRING AND EQUIPPING FIRE STATIONS, AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLIANCES, AND ACQUIRING NECESSARY SITES THERE„- FOR, AND THE LEVYING OF A TAX IN PAYMENT,THEREOF. AGAINST THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE PURPOSE OF BUILDING, IMPROVING, REPAIRING AND EQUIPPING FIRE STATIONS, AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLIANCES, AND ACQUIRING NECESSARY SITES THERE- FOR, AND THE LEVYING OF A TAX IN PAYMENT THEREOF. SIXTH PROPOSITION FOR THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE PURPOSE OF BUILDING, IMPROV- ING, REPAIRING, AND EQUIPPING POLICE STATIONS, AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLIANCES, AND ACQUIRING NECESSARY SITES THERE- FOR9 AND THE LEVYING OF A TAX IN PAYMENT THEREOF. AGAINST THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE PURPOSE OF BUILDINGS IM- PROVING, REPAIRING, AND EQUIPPING POLICE STATIONS, AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLIANCES, AND ACQUIRING NECESSARY SITES THEREFOR9 AND THE LEVYING OF A TAX IN PAYMENT THEREOF. SEVENTH PROPOSITION FOR THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE PURPOSE OF ENLARGING, IMPROV- ING, REPAIRING, AND EQUIPPING THE PUBLIC LIBRARY BUILDING, AND THE PURCHASE OF NECESSARY APPURTE- NANCES AND APPLIANCES THEREFOR9 AND THE LEVYING OF A TAX IN PAYMENT THEREOF. AGAINST, THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE PURPOSE OF ENLARGING, IMPROVING, REPAIRING9 AND EQUIPPING THE PUBLIC LIBRARY BUILDINGS AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLIANCES THEREFOR, AND THE LEVYING OF A TAX IN PAYMENT THEREOF. Section 10 Concerning each proposition, out with black ink, or black pencil, pressions on the ballot, thus leaving his vote on such proposition. - 7.- each voter shall mark one of the above ex - the other as indicating Section 11 Said election shall be held in each of the legal voting precincts within the City of Beaumont, and also -in each fractional legal voting precinct in said City where only a portion of such precinct is within the City, and the following places therein respectively are hereby desig- nated polling places in the voting precincts of said City,. and the following -named persons are hereby appointed offi- cers of said elections (1) In Voting Precinct No. 1, said election shall be held at the French High School Building, and T. B. Hensley is -hereby -appointed- presiding, judge to hold said election, - with authority to appoint his assistants and clerks. (2) In Voting Precinct No. 2, said election shall be held at the Junker School Building, and Mrs. J. E.'Ray is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (3) In Voting Precinct No. 3, said election shall be held at the Gladys Street Fire Station, and Mrs. L. E. Downs is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (4) In Voting Precinct No. 4, said election shall be held at the Averill School Building, and-W. L. Seibert is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (5) In Voting Precinct No. 5, said election shall be held at the Beaumont High School Building, and Spencer Blain is hereby appointed presiding judge to hold said e- lection,_ with authority to -appoint his assistants and clerks. (6) In Voting Precinct No. 6, said election shall be held at the Dick Dowling Junior High School Building, and Mrs. E. W. Doty is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (7) In Voting Precinct No. 7, said election shall be held at the Central Fire Station, and Mrs. G. K. Rafferty is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (8) In Voting Precinct No. 8, said election shall be held at the City Hall, and Geo. J. Todd is hereby appointed presiding judge to hold said election, with authority to ap point his assistants and clerks. (9) In Voting Precinct No. 9, said election shall be held at the Fletcher School Building, and R. L. Brown, Jr., is hereby appointed presiding judge to hold said e- lection, with authority to appoint his assistants and clerks. (10) In Voting Precinct No. 10, said election shall be held at the Court House, and F. E. Carroll is hereby.ap- pointed presiding judge to hold said election, with authori- ty to appoint his assistants.and clerks. (11) In Voting Precinct No. 11, said election shall be held at the David Crockett Junior High School Building, and F. L. Fisher is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (12) In Voting Precinct No. 12,'said election shall be held at the Ogden School Building, and.Mrs. C. E. Drake is hereby appointed -presiding judge to hold said election, with authority to appoint her assistants and clerks. (13) In Voting Precinct No. 13, said election shall be held at the Sabine Pass Avenue Fire Station, and Mrs. P. B. Derr ---is hereby appointed-pres-iding-- judge --to hold -said -election, with authority to appoint her assistants and clerks. (14) In Voting Precinct No. 14, said election shall be held at the Magnolia School Building, and E. A. Godwin is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (15) In Voting Precinct No. 15, said election shall be held at the South Park Elementary School Building,'and E. E. Garrison is hereby appointed presiding judge to hold said election, with authority to appoint his assistants -and clerks. (16) In Voting Precinct No. 16, said election shall be held at the Giles School Building, and R. E. Withers is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (17) In Voting Precinct No. 17, said election shall be held at the Hebert Colored School Building, and A. L. Price is -hereby appointed presiding judge to hold said election,, with authority to appoint his assistants and clerks. (18) In fractional part of Voting Precinct No. 18, lying within the City of Beaumont, Texas, said election shall be held at the Edwards School Building, and J. M. Brinson is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (19) In fractional part of Voting Precinct No. 19, lying within the City of Beaumont, Texas, said election shall be held at 4905 Voth Road, and Frank Allen is hereby appointed presiding judge to hold said election, with authority to ap- point his.assistants and clerks. (42) In fractional part of Voting Precinct No. 42, lying within the City of Beaumont, Texas, said election shall be held at the Lamar College Administration Building, and G. W. Glezen is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (43) In fractional part-of'Voting Precinct No. 439 lying within the City of Beaumont., Texas, said election shall be held at the Triangle Grocery, Fannett Road and Donahue Streets, and Roy Saleme is _hereby appointed presiding judge to hold said election, with authority to appoint his assist- ants and clerks. cn 3-Jr (47) In fractional part -of Voting Precinct No. 47, lying within the City of Beaumont, Texas, said election shall be held at St. Anne's School Building, and Mrs. Eugene L. Seale is hereby appointed presiding judge to hold said election9 with authority to appoint her assistants and clerks. (50) In fractional part of Voting Precinct No. 509 lying within the City of Beaumont, Texas, said election shall be held at the Beaumont Tourist Courts, on College Street Ex- tension, and Mrs. J. P. McCarter is hereby appointed presiding judge to hold said election, with authority to appoint her as- sistants and clerks. -- - ---Section 12 Said election shall be held under the provisions of and in accordance with the laws governing the issuance of municipal bonds in cities, as provided in the Constitution and General Laws of the State of Texas, and the manner of holding said election and making returns thereof shall be governed by the laws of the State of Texas governing general elections; and only qualified electors of said City, who own taxable -property in said City and who have duly rendered the same for taxation, shall be qualified to vote at said election, and all electors shall vote in the election precinct of their residence. Section 13 A copy of this ordinance, signed by the Mayor of.the City of Beaumont and attested by the City Clerk of the City of Beaumont, shall serve as proper and sufficient notice of said election, and the Mayor is hereby directed to cause one each of said notices to be posted in each of the election precincts and fractional parts of election precincts within the City of -Beaumont, and at the City Hall, such posting to be not less than fifteen (15) full days prior to the date set for said election9 and he shall further cause said notice to be published on the same day in each of two successive weeks in a newspaper of general circulation published within said City, the date of the first publication to be not less than fourteen (14) full days prior to the date set for said election. And the person posting said notices shall make a return on the copy thereof, showing the times and places of posting, and the return shall be filed in the office of the City Clerk and shall be conclusive evidence of the posting of said notice, and the affidavit of the publisher of the news- paper, stating the days on which the same was published, shall be filed in .the office of the City Clerk and shall be con- clusive evidence of the publication of said notice. Section 14 The fact that the City of Beaumont has recently ex- tended its limits so as to include within said limits approxi- -ma:tely twenty-one additional square miles of territory, in which additional territory not heretofore included within the limits of the City of Beaumont there are many inhabitants and many residential and business buildings and property, necessi- tating public services and improvements mentioned in this. ordinance,nd the public improvements existing within the original limits of the City of Beaumont, as well as its water- works system, are inadequate to meet the necessities not only �\X�\ - 10 - of the properties and inhabitants residing within the original corporate limits of the City of Beaumont, but as well as those residing within the limits of the City of Beaumont as extended, and such improvements, extensions,and repairs are necessary to protect the public property, public health, public safety, and promote the public welfare of the City of Beaumont and its inhabitants; and the fact that the streets and highways of the City of Beaumont are badly in need of improvement, extending, repairing, opening and widening, so as to facilitate the mov- ing of traffic in the City, which is congested on present im- proved streets to such an extent as to be dangerous to life and limb; and the sewerage system and the storm sewers of the City of Beaumont are now wholly inadequate for the demands -------placed-upon- them ;---causing-congestion-of-the--sewe r-mains-and— _ resultant stagnation which is injurious to the health and lives of the people of the City of Beaumont; and it is necessary to construct additional fire stations.in order to protect the people of the City of Beaumont from fire hazards, the present system being wholly inadequate to meet the needs of the inhabit- ants of the City, and many inhabitants of the City are without water for domestic use, and many sections of the City are with- out water mains and plugs sufficient to fight fires which may break out in such sections and destroy the property of the citi- zens; and it is necessary to construct additional police'sta- tions and equipment in order to protect the people of Beaumont and to protect the property of its inhabitants; and the public library of the City of Beaumont is in need of repairs, the same being in such condition that it may be dangerous to life and limb; and the fact that the revenues of the City of Beaumont that may be raised by taxation, or any other means available to the City, are wholly inadequate to make the improvements, extensions, and repairs mentioned in this ordinance; each and all of which conditions create an imperative public emergency, necessitating the suspension of the rule requiringordinances to be read on three separate days before their passage, and said rule is hereby suspended, and this ordinance shall take effect from and after the date of its passage.
