AN ORDINANCE
ENTITLED AN ORDINANCE DETERMINING THAT CERTAIN STEPS
HAVE HERETOFORE.BEEN TAKEN IN CONNECTION WITH THE
ADVERTISING -FOR, AND RECEIVING OF BIDS FOR THE IM-
PROVEMENT OF -CERTAIN DOWNTOWN STREETS HEREINBELOW
DESCRIBED AND LATER TO BE.DESIGNATED BY THE GOVERN-
ING BODY -OF THE CITY. OF. BEAUMONT; DETERMINING THAT
THERE EXISTS A NECESSITY.FOR THE IMPROVEMENTS NAMED
HEREINBEL OW AND FINDING THAT SAME.SHOULD BE ACCOM--
PLISHED; AFFIRMING -THE CITY COUNCILIS. ACCEPTANCE
OF.THE,BID OF-TROTTI.& THOMSON, INC.; BY MOTION ON
APRIL 20, 194$2 AND RATIFYING THE CONTRACT ENTERED
INTO -AS DIRECTED IN THAT SAME MOTION; AND MAKING.
APPROPRIATION OF FUNDS FOR THE PAYMENT OF SAID IM-
PROVEMENTS.WHOLLY.BY-THE CITY OF BEAUMONT.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
SECTION 1.
The City Council of the City of Beaumont, Texas, hereby
finds and determines:
(a) That the City Commission of the City of Beaumont,
being the then governing body of said City, has hereto-
fore advertised for bids for the improvement of certain
downtown streets, said improvements consisting of laying
one and one-half (1-1/2) Hot Mix Asphaltic Concrete on
the following streets, to -wit: -
Main and Pearl Streets from Calder Avenue
to Blanchette Street, Orleans Street from
Broadway to Blanchette Street, Park Street
from Laurel Avenue to Blanchette Street,
Willow Street from Calder Avenue to Laurel
Avenue, Calder Avenue -from Main Street to
Magnolia Avenue-, Broadway and Liberty Ave-
nue from Main Street to Willow Street,
Laurel Avenue from Orleans Street to Willow
Street, Crockett, Bowie, Fannin, Forsythe,
Wall, College, Milam, and Franklin Streets
from Main Street to Neches Street, and such
other streets as may later be designated
by the governing Body of the City; and
(b) That such advertisements for bids were published
for the length of time and in the manner as required
by law, and the Charter of said City; and
(c) That the bids advertised for were opened and
read at the meeting of the City Council on April 20,
1948.
SECTION 2.
(a) That there exists a necessity fo

(b) That the same should be accomplished accord-
ing to. the Plans and Specifications prepared by the
City Engineer of the City of Beaumont for the im-
provement of same, which Plans and Specifications
are hereby approved.
SECTION 3.
(a) That the City manager made recommendation on
April 20, 1948, at a regular meeting of the City
Council, that the bid .of'Trotti & Thomson Inc.,
received on that date in the amount of $1�7,300.00
for paving the downtown streets described hereinabove
be accepted; that the City Council, by motion, ac-
cepted the bid after the.City Manager's recommenda-
tion on April 20, 1948; that the City Attorney was
instructed to prepare the contracts and that the
City Manager was authorized to execute the contract
as prepared with Trotti & Thomson, Inc.; and
(b) That the acceptance by motion is hereby af-
firmed.and the contract as prepared by the City At-
torney and executed by and between the City Manager
on behalf of the City of Beaumont and Trotti &
Thomson, Inc., is hereby ratified.
SECTION 4.
That there is hereby appropriated out of STREET AND
HIGHWAY BOND FUND, SERIES 1947, the sum of $187, 300.00 , t o
pay the cost of the improvements as set out in Items 2,-4
and 6 of the Bidder's Proposal, and proper warrants are here-
by authorized to be,issued in said amount, or so much there-
of as may be necessary against said fund to pay and discharge
the obligations of the City of Beaumont arising under said
contract.
