WHEREAS, a petition has been presented to the City Council of The City of Beaumont by the owner of all of the property abutting Villiva Lane extending from the East right-of-way line of the Kansas City Southern Railway Company to the West right--of-way line of the Kansas City Southern Railway Company, in the City of Beaumont, Jef- ferson County, Texas, requesting that said portion of Villiva Lane be vacated and abandoned; and, WHEREAS, it appears to the City Council that it is to the best interest of The City of Beaumont and benefit to the public that the above described portion of Villiva Lane be vacated and abandoned; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That that portion of Villiva Lane extending from the East right -of. -way line of the Kansas.City'Southern Railway Company to the West right- of-way line of the Kansas City Southern Railway Company be, and the same is hereby, authorized to be vacated and abandoned, and that title to said vacated and abandoned portion of Villiva Lane shall revert -,to and become the property of the parties entitled thereto, as provided by law. ORANGE AND NEWTON COUNTIES, TEXAS RE: The Kansas City Southern Railway Company- Villiva Lane Crossing; OB&T File 951 City Council City of Beaumont City Hall Beaumont, Texas Gentlemen: IVV,�4 Y The Kansas City Southern Railway Company respectfully requests that the City of Beaumont, acting by and through the City Council, by ordinance, vacate and close that portion of Villiva Lane, a public street in the City of Beaumont, which crosses the Kansas City Southern Railway Company's 100 foot right of way, said portion beginning at the west boundary line of the said 100 foot right of way, and c6ntinuing for a distance of 100 feet to the east boundary line of said right of way-) The Kansas City Southern Railway Company is the only property owner adjacent to such portion of Villiva Lane. Villiva Lane formerly ran from the Port Arthur Highway across The Kansas City Southern Railway Company's right of way to a point near the Neches River. That portion of Villiva Lane from the east right of way line of The Kansas City Southern Railway Company to the Neches River has been previously vacated and closed by Order of the Commissioner's Court of Jefferson County dated July 28, 1958, and filed in the Minutes of such Court. That portion of such road from the Port Arthur Highway across the west boundary line of The Kansas City Southern Railway Company's right of way to the east boundary line of such right of way is still open to the public. Schmidt in zoning meeting, Beaumont, Texas, on July 16, hearing on application to close Villiva Lane in that City. ,then Villiva Lane is closed, Kansas City Southern proposes to expand its present yard in what is known as the Chadson area. This will be an expansion of approximately 600 cars. T-Then this work is completed our repair track will be in the Villiva Lane area, as well as our yard office, which is now located at College Street. This will eliminate some switching in the College Street area due to all cuts of cars received from connections at this location being moved to the Chaison Yard and switching performed there. The switch- ing now performed at north end of our Chaison Yard will be done in the area of Villiva Lane.
