AN ORDINANCE
ENTITLED AN ORDINANCE AMENDING SEC. 12--2 OF THE
CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING
THE VACATION LEAVE BENEFITS FOR CITY EMPLOYEES AND
PROVIDI.NG THE RULES TO BE FOLLOWED IN GRANTING AND
RECEIVING SUCH VACATION LEAVE; AMENDING THE CODE
OF ORDINANCES OF BEAUMONT, TEXAS, BY ADDING SEC.
12-2.1, PROVIDING FOR HOLIDAYS TO BE OBSERVED FOR
CITY.'EMPLOYEES; AMENDING SEC. 12-3 OF THE CODE OF
ORDINANCES OF BEAUMONT, TEXAS, BY PROVIDING FOR
SICK LEAVE FOR CITY EMPLOYEES AND PROVIDING THE
RULES TO BE FOLLOWED IN GRANTING AND RECEIVING SUCH
SICK LEAVE; AMENDING THE CODE OF ORDINANCES OF BEAU-
MONT, TEXAS., BY ADDING SEC. 12-3.1, PROVIDING FOR
EMERGENCY LEAVE, MILITARY LEAVE, AND LEAVE FOR JURY
DUTY; AND REPEALING ALL ORDINANCES AND PARTS OF
ORDINANCES IN CONFLICT HEREWITH.
F BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
I.
That Section 12-2 of the Code of Ordinances of Beaumont,
Texas, is hereby amended to read as follows:
"Section 12--2. Same - Vacation leave.
ttAll permanent full-time employees of the City,
except classified employees under the Firemen's and
Policemen's Civil Service Act, shall be allowed vaca-
tion leave with full pay in accordance with the fol-
lowing rules and policy:
"(a) Such employees shall earn one working
day vacation for each calendar month of service, so
as to total twelve (12) working days vacation for each
twelve (12) calendar months of service. Employees
shall receive one additional working day vacation for
every five (5) full calendar years of continuous serv-
ice with the city. Employees who earn fifteen (15)
days of sick leave as provided for in Section 12-3, in
a calendar year, and who do not use more than five (5)
days of sick leave during said year, will have two (2)
extra working days added to their_ vacation for the -
following year; however, this shall not apply to sick
leave earned prior to January 1, 1961.
tt(b) An employee who enters the service
before the 16th or leaves after the 15th of the month
shall earn a day of vacation.for that month.
It(c) Employees may accumulate vacation leave
of not more than twenty-four (24) working days.
tt(d) No vacation leave shall be taken in any
calendar year unless such vacation was accumulated as
of the first day of January of that year. No vacation
leave can be taken by an employee until that employee
has completed .one year of'service with the city, and
then only such vacation leave as was accumulated as of
the first day of January.

tt(b) An employee who enters the service
before the 16th or leaves after the 15th of the month
shall earn a day .of sick leave for that month.
tt(c) Employees may accumulate sick leave
of not more than ninety (90) working days.
tt(d) Sick leave begins to accrue upon em-
ployment., but may not be used by an employee until
that employee has completed one year of service with
the city.
tt(e) An employee shall not be entitled to
be paid for unused sick leave upon termination of em-
ployment with the city.
n(f) Sick leave may be used only for absence
from duty because of personal illness, legal quarantine
or illness in the immediate family. Immediate family
shall include -father, mother, husband, wife, child,
father-in-law, mother"in-law, brother or sister, or any
relative living in the same household; however, sick
leave shall not be used for absence due to pregnancy
or complications thereof.
tt(g) Absence because of illness in employees
immediatefamily must be verified by certificate issued
by a private physician.
It(h) City employees who are absent from work
because of illness are responsible for having their
absence reported to their department head by not later
than 9:00 otclock a.m. of the day of absence. Any city
employee who fails to follow this regulation shall be
penalized by having his sick leave charged to leave
without pay. The absenteeism because of illness of
city employees will be spot. -checked from time to time
by the health department.
It(i) After .an employee's accumulated sick
leave has been exhausted, and when requested, accrued
vacation leave may be used as sick leave. When absence
due to illness exceeds the amount of paid leave earned
and authorized, the pay of the employee shall be dis-
continued until he returns to work.
tt(j ) Employees who consistently use their
sick leave as it is earned, or who fail to accumulate
it, may be dismissed from the service.
tt(k) Employees who become ill during the
period of their vacation may request that their vacation
be temporarily terminated and the time of illness charged,
to sick leave. Vacation days unused may then be taken
later in the year at such time as may be designated by
the -employee's department head. The department head may
require satisfactory proof of illness.
tt(1) Upon return to duty after a period of
sick leave an employee shall sign a certificate .of ill-
ness confirming the number of days he was absent with
pay.

tt(e) Employees who have completed twelve
(12) months:service with the city shall be paid for
any earned but unused vacation upon termination of
their service with the city not to exceed twenty --four
(24) days. Employees who leave the employment of
the City before completing twelve (12) months service
shall not be entitled to any vacation pay.
It(f) Department heads will develop vacation
schedules in conformance with the policy of scheduling
vacations over as wide a period as possible, in order
to obviate the need for a temporary increase in per-
sonnel . tt
II.
That the Code of Ordinances of Beaumont, Texas, is hereby
amended by adding a section to be numbered Section 12-2.1, which
said section reads as follows:
"Section 12.-2.1. Same w Holidays.
It(a) The following are designated as holidays
to be observed for all city employees occupying
permanent positions:
(1)
New Year's Day;
(2)
Texas Independence Day;
(3)
Good Friday;
(4)
Memorial Day;
(5)
Independence Day;-
(6)
Labor Day;
(7)
Thanksgiving Day;
(8)
Christmas Day.
st(b) If the holiday falls on a Sunday, it will
be observed on Monday; if the holiday falls on Sat-
urday, it will not be observed.
t'(c) Holidays falling in the vacation period
of an employee will not be counted as part of the -
vacation leave of that employee.tt
That Section 12--3 of the Code of . Ordinances of Beaumont,
Texas, is hereby amended t-o read as follows:
''Section 12-3. Same - Sick leave.
ttAll permanent full --time employees of the city,
except classified employees under the Firemen's and
Policemen's ,Civil Service Act, shall be allowed sick
leave with full pay in accordance with the following
rules and policy:
"(a) Such employees shall earn one working
day of sick leave for each calendar month of service,
with an extra working day of sick leave for each four
(4) calendar months..of service, so as to total fifteen

IV.
That the Code .of Ordinances of Beaumont, Texas, is hereby
amended by adding a section to be numbered Section 12.-3.1, which
said section reads as follows:
"Section 12-L3.1. Same .- Emergency leave, military
leave, and jury duty.
If(a) All employees except part. -time, seasonal
and temporary employees, may be granted emergency
leave with pay for a period not to exceed three (3).
days in case of death in their immediate family, as
defined in Section 12-.3. This leave shall be charged
against employees? sick leave. Part --time, seasonal,
and temporary employees may be granted a leave of
absence without pay in such cases.
t?(b) Employees in permanent positions who are
ordered by competent military authority to short
tours of military duty, not to exceed fifteen (15)
days annually, shall be paid their regular pay
while on such leave.
It(c) Employees who are required by due process
of, law to render jury service shall receive their
regular pay during such peri.od.tt
V.
All ordinances or- parts -of ordinances in conflict herewith
are hereby repealed.
