AN ORDINANCE
ENTITLED AN ORDINANCE AUTHORIZING THE PROPER
OFFICIALS OF THE CITY OF BEAUMONT TO EXECUTE AND
DELIVER FOR AND ON BEHALF OF THE CITY OF BEAU-
MONT A QUITCLAIM DEED CONVEYING ALL OF THE CITY'S
RIGHT, TITLE AND INTEREST IN AND TO TWO TRACTS
OF LAND IN THE C. WILLIAMS LEAGUE, JEFFERSON
COUNTY, TEXAS, TO AMELIA DEVELOPMENT CORPORATION.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
That C. H. LeBlanc,.Mayor, be, and he is hereby, authorized to
executeeand deliver for and on behalf of The.City of Beaumont
a quitclaim deed to Amelia Development Corporation, conveying
all of the Cityfs right, title and interest in and to.two tracts
of 1and,hereinafter described as follows:
TRACT NO. 1:
A part of a 100..foot right of way of the former
location of the Missouri Pacific Railroad in the
C. Williams League, Jefferson County, Texas;_
TRACT NO. 2:
A portion of Calder Avenue in The City of Beau-
mont, lying adjacent to and south of the present
Calder Road and adjacent to and North of the
Missouri Pacific Railroad's right of way, and
being a portion of the. old abandoned Calder Road;
and the City Clerk is hereby authorized to attest to said in-
strument and,to affix the seal of The City of Beaumont thereto.

COMMENT:
Back in 1957, at the time the City was purchasing the
new right of way for the Missouri Pacific main line reloca-
tion, it was determined that_a part of the new right of -way
would be through Forest Park Addition which was being developed
by the Amelia Development Corporation and M. L. Lefler, Jr.
The negotiations for the purchase of this property by
the City was carried on by Mrs. Brockman, as. City Manager,
and the City Council direct with Mr. Lefler. This office did
not handle the purchase " that particular tract.
Under date of June 7, 1957: Amelia Development Corpor-
ation, by M. L. Lefler, Jr.., wrote a letter to Mrs. Brockman
stating in part:
"In line with and in confirmation of discussion
had with the Council on May 28, 1957, our under.—
standing of the expressed intent of the parties
to such meeting is as. follows:1t
Some eleven items were discussed, one -of which was that the
City would pay the Company $'8b,000.00 in cash; the City in
addition agreed to do many things, one of which was to quit-
claim "all portions of Calder as"it exists west of the pro-
posed Calder Extension along the Old Sour Lake Road -and east
of the west boundary of the Addition, as well as all portions
of railroad right of way shown on said plat west of the Sour
Lake Road and adjacent to said Addition.south of the center-
line of said present railroad right of way."
Under date of June 12, 19573 Mrs.. Brockman, as City
Manager, addressed a.letter to Amelia Development Corporation,
attention M. L. Lefler, Jr., wherein she stated in part:
"Your letter of .June 7th correctly states your
proposition made to the City Council with refer-
ence to purchase of right of way through your
Addition for the relocation of the Missouri Pac-
ific Railroad. It is my understanding that the

COMMENT:
City Council informally agreed to your proposal
and authorized me to deal with you on such a
basis, and to purchase the right of way -when -
money from the bond issue is available.tt
Recently we received from the attorneys for the Amelia
Development Corporation a quitclaim deed from the City to
Amelia Development Corporation of two tracts of land, together
with field notes and plat prepared by C. A. Kohler. We re-
ferred these field notes, together with a copy of the agree-
ment of 1957, to Mr. Balmer and they were approved with a
slight variance in one of the calls. The quitclaim deed is
being corrected,to take care of that matter.
Mr. Balmer calls our attention to the fact that there
are various utilities in this area and that, also, the Mis-
souri Pacific right of way is now in our Master Street Program.
The quitclaim from the City will be subject to any existing
utilities, but,I don't know what we can do about that part of
the MoPac right of way that is in the Master Street Program,
because undoubtedly the agreement of the City Manager was
part of the consideration for the conveyance of the property
we received from Amelia Development Corporation.
I am -enclosing herewith the Resolution authorizing the
execution of this quitclaim, which should be presented to the
City Council.
