HomeMy WebLinkAboutORD 61-CCAN ORDINANCE AN ORDINANCE AUTHORIZING THE CLOSING AND.ABANDON' ING OF OCONEE LANE, SUBJECT TO THE RIGHT'OF THE CITY OF BEAUMONT TO PLACE AND MAINTAIN UTILITIES AND TO -HAVE PLACED AND MAINTAINED UTILITIES THERE- IN. WHEREAS, a petition signed by -the owners of all of the property abutting Oconee Lane has been presented to the City Coun- cil of The,City of'Beaumont.requesting.that Oconee Lane .be vacated and abandoned; and, WHEREAS, said petition has been referred to the City Plan- ning and Zoning Commission for examination and approval, and the same has been approved by said Commission; and, WHEREAS, it appears to the City Council that it.is to the best interest of The City of Beaumont and benefit to the public that Oconee Lane be vacated and abandoned; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT,.TEXAS: That Oconee Lane be, and the same is.hereby, vacated and abandoned; subject to the right of The City of Beaumont.to place and maintain utilities, and to have placed and maintained utilities therein; and that title to said vacated and abandoned street shall revert to and become the property'of -the parties entitled thereto, as provided by law. 1960 PASSED by the City Council this 5th day of January, A. December 1, 1959 The City Planning and Zoning Commission City of Beaumont, Texas' Gentlemen: We, the undersigned, who are the sole property owners on both sides of Oconee Lane respectively petition that it be closed. Oconee Lane runs for one block only from 11th Street on the East to 12th Street on the West, a distance of four -hundred eighty-three (483) feet. The new Holliday Inn occupies the property on the North side of Oconee and is buying .the Votava property on the South side of Oconee. Holliday Inn plans to begin construc- tion of an additional one hundred (100) r-ooms on the Votaw property in January, 1960. Oconee Lane is a sixty (6.01) foot right-of-way with only the center twenty-two (22') feet hard surfaced. The other parts of the right-of-way on both sides of the center are mainly unsightly ditches, used for nothing. If Oconee is officially closed Holliday Inn will black -top Oconee from property line to property line on both sides (60'). The- present twenty-two (221) feet of roadway will be kept open by Holliday Inn and available for public use from 1 lth to 1.2th Streets. The other portions of- Oconee which are now unused will then be available for customer parking as well as public parking. The City will retain all present easement rights in Oconee.
