AN ORDINANCE
AUTHORIZING THE PROPER OFFICIALS OF THE CITY OF
BEAUMONT TO EXECUTE AN EASEMENT TO MISSOURI PACIFIC
--RAILROAD COMPANY OUT OF LOT 8, BLOCK 14 OF THE VAN
,,TORMER SECOND ADDITION TO THE -,CITY OF BEAUMONT..
BE IT ORDAINED. BY THE. CITY, OF BEAUMONT, TEXAS
That the Mayor be, and 'he' is -'hereby, .authorized. to execute and' de-
liver for and on behalf of'The City of Beaumont an easement and
right of way to construct, ma.intain and operate a railroad, and all
accessories, including:'destern Union pole lines, and all signals
and.signal'lines, upon the following described land:
A tract ,=of land out- of the .Noah Tevis Survey in the
City of"Beaumont, Jefferson County, Texas, described
. as -'follows, to wit:.__ ---
BEGINNING at the southwest corner'of Lot No, 8,.Blocic
14 of the Van Wormer Second Addi,i ion to the City. of
Beaumont, Jefferson County, Texas, according to the
map and plat of record in the' office of the county,
`clerk -of said County;
THENCE south along the east line of 13th Street ex-
tended 61.5 feet to stake -for corner in the north
right-of-way line of the T&NO Railroad Company.
THENCE in an easterly direction along the north right-
of-way line of said Railroad Company 141.4 feet to
stake for corner;
THENCE north and parallel to 13th.Street extended 43.4
feet to stake in the south line -of Lot No. 81 Block 14
of the Van Wormer Second Addition;
THENCE west along the south line of Lot No. 8, 140
feet to place of beginning;
and the City Clerk is hereby authorized to attest -to said instrument
and to affix the seal of The City of Beaumont thereto.

lines, upon the.following described land:

road right of way by the Texas and New Orleans Railroad
Company, and which property is subject to an easement
now held by. Texas and New Orleans Railroad Company, such
property hereby, quitclaimed' being adjoining and adjacent. -
to the following described property

THAT The City of Beaumont,, Texas, a municipal corporation
domiciled in Jefferson County,.Texas, for and in consideration of
the sum of One ($1.00) Dollar to it in hand paid, and other good and
valuable consideration received from Missouri Pacific Railroad Com-
pany, a corporation, -has GRANTED, SOLD and CONVEYED, and by these
presents does GRANT, SELL and. CONVEY unto the said Missouri Pacific
Railroad Company an easement and right pf way to construct, maintain
and operate a railroad, and all accessories, including Western Union
pole lines, and all signals and signal lines, upon the following de-
scribed land situated in the City of Beaumont, Jefferson County,
Texas, to wit:
A tract of land out of the Noah Tevis Survey in the
City of Beaumont, Jefferson County, Texas, described
as follows, to wit:
BEGINNING at the southwest corner of Lot No. 8, Block
14 of the Van Wormer Second Addition to the City of
Beaumont, Jefferson County, Texas according to the
map and plat of record in the office of the county
clerk of said County;
THENCE south along the east line of 13th Street ex-
tended 61.5 feet to stake for corner in the north
right-of-way line of the T&NO Railroad Company;
THENCE in an easterly direction along the north right-
of-way line of said Railroad Company 141.4 feet to
stake for corner;
THENCE north and parallel to 13th Street extended 43.4
feet to stake in the south line of Lot No. 8, Block 14
of the Van Wormer Second Addition;
THENCE west along the south line of Lot No. 80 140
feet to place of beginning.
It is understood that this grant is made subject to the
easement now held by Texas and New Orleans Railroad Company upon the
above described property.
TO HAVE AND TO HOLD the aforesaid easement, rights and appur-
tenances thereto in anywise pertaining unto the said Missouri Pacific
Railroad Company, its successors and assigns, and The City of Beau-
mont does hereby bind itself, its successors and assigns, to warrant

THENCE in an easterly direction along the north right-
of-way line of said Railroad. Company 141.4 feet to

tenances thereto in anywise pertaining unto the said Missouri Pacific
Railroad Company, its successors and assigns, and The City of Beau-

and forever defend all and singular the said easement to the said

Missouri Pacific Railroad Company, its successors and assigns,
against every parson whomsoever lawfully claiming or to claim the
same or any part thereof
if, the Grantee or its successors and assigns shall permanently
abandon the easementgranted hereby and cease to use it for railroad
purposes, the rights hereby granted shall thereby revert to Grantor,
or Grantor's successors and assigns, free and discharged from the
easement granted hereby, whereupon Grantor, its successors and as.
signs, shall have the same title to the above described property as
though these presents had not been executed. In such event, however,
any improvements placed thereon by the said Grantee, its successors
and assigns, may be removed from the premises.
