ENTITLED AN ORDINANCE VACATING AND ABANDONING THAT
PORTION OF A 20-FOOT UTILITY EASEMENT LYING WEST OF
THE UTILITY EASEMENTS RUNNING ALONG THE EASTERLY
SIDES OF . LOT' 13, BLOCK .2, AND LOTS 141 271 AND 281
BLOCK 4, OF.THE COLONIAL MANOR..ADDITION TO THE CITY
OF BEAUMONT, TEXAS, AS SHOWN ON'THE.APPROVED FINAL
PLAT OF SAID ADDITION.
BE IT ORDAINED, BY THE CITY OF BEAUMONT,;TEXAS:
That that portion of a 20-foot utility easement conveyed by Harold
D. Arnold to The City of Beaumont by instrument dated February 171
1959, which lies west of the utility easements running along the:
easterly sides of Lot 13., Block 2, and Lots 14, 27, and 281.Block 4,
of Colonial Manor Addition to The City of Beaumont, as shown on the
approved Final Plat of said Addition, be, and the,same is hereby,
vacated and abandoned, and that title to such property -shall revert
to and become the property of the persons entitled thereto, 'as pro- .
vided.by law, and The City of Beaumont hereby relinquishes any and
all right, title and interest it had or might have -had in and to such
utility easement°
PASSED by the City Council this �` day of August, A. D.
1959.

to the City of Beaumont
Request is nerewith made of the City that it formally abandon that cer-
tain 201 utility easement lying across the Bast end of Block 22 of Van Wormer 2nd
Addition to the City of Beaumont conveyed to the city by Harold ll. Arnold by instru-
ment wider date of February 17,, 1959 and of record in the office of the county
d.erk of Jefferson County, Texas under File No. 5e1y15. For reasons for tnis request
which is made on behalf of the owner of said property, B M T Builders, Inc., we
cite the following:
1. Blocks 22 through 27 of Van Wormer 2nd as reflected by plat of record are being
replatted by the owners thereof as a part of Colonial Manor Addition to the
City of Beaumont, and all necessary utility easements are reflected by and upon
said plat, the instant 2U1 easement being shown on said plat as a 101 easement,
2, setters from all utility company users are on hand with the City clerk reflecting
their acquiescence.
3. The conveyance to the city was made by a former owner under date of February
17, 1959, same date as date of conveyance_ to B M T Builders, Inc. who took
title to same as innocent purchasers for valte��without notice, and in conse-
quence the City has no legal title to such easement.
We request that such abandonment be as follows:
All of those portions of Block 22 of Van Wormer 2nd incorporated within that
certain easement heretofore granted to the City of Beaumont by Harold D. Arnold by
instrument under date of February 17, 1959 and of record in the.office.of the county
clerk of Jefferson County, Texas under File No. 521515 which are not incorporated
within easements reflected by plat of Colonial Manor Addition to the City of Beaumont
approved by the City Flaming & Zoning Commission under date of May /, 1959.

to Hildebrandt Bayou.

The -City Water Department has -no water lines in the original
201 easement along the east property line of the Colonial Manor Addition
and adajenct to Hillebrandt Bayou from Russell Place.Addition to M.P.
right of way. "
The City has no plans to install any water line in this 201
easements and has no objection to its being abandoned.
