AN ORDINANCE
AN ORDINANCE AUTHORIZING THE CLOSING AND ABANDONING
OF PORTIONS OF V STREET, BRYON STREET, AND LEVERT
STREET FROM THE NORTH RIGHT -OF WAY LINE OF THE RELO-
CATED MISSOURI PACIFIC RAILROAD COMPANY'S IdIAIN LINE
TO THE NORTH LINE OF THE EXISTING RIGHT.OF WAY OF
THE TEXAS AND NEW ORLEANS RAILROAD COMPANY IN THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, SUBJECT
TO THE RIGHT TO MAINTAIN EXISTING UTILITIES THEREIN,
IF ANY,
VIHEREAS, as part of The City of Beaumont's overall grade
separation program, the main line of the Missouri Pacific Railroad
Company is being relocated from a point just east of Elizabeth to
a connection with the present right of way of the Texas and New
Orleans Railroad Company's main line near V Street, said relocation
being for the purpose of eliminating a.number of grade crossings
along the present right of way of the Missouri Pacific Railroad Com-
pany; and,
_ ti(fflEREAS,.the relocated railroad line crosses V Street, Bryon
Street and Levert Street just north of where said streets deadend at
the Texas :and New Orleans Railroad Company's main line right of way;
and,
WEEREAS, the City Council is of the opinion that although
said streets are not now -opened and used at the location where the
Missouri Pacific Railroad relocated right of way crosses said streets,
that in order to prevent future railroad crossings at grade at said
places it is to the best interest of The City of Beaumont and its
citizens and of great public benefit that.said streets be vacated
and abandoned from the north right-of-way line of the relocated Mis-
souri Pacific Railroad right of way to the north line of the Texas
and New Orleans Railroad Company's right of way;
NOWY THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT,
TEXAS:
That for the purpose of preventing future.grade crossings in The
City of Beaumont that the portions of V Street, Bryon Street and
Levert Street in The City of Beaumont from the north line of the
relocated Missouri Pacific Railroad Company's main line right of
way to the north line of the existing Texas and New Orleans Rail-
road Company's right of way be, and the same are hereby, vacated
and abandoned, subject to the right to use and maintain existing
utilities thereon, if any, and that the title to said portions of
said streets herein vacated and abandoned shall revert to and become
the property -of the parties entitled thereto, as provided by laws
subject to the right of the Missouri Pacific Railroad Company to
maintain and operate a railroad thereon,,including any and all oper-
ations necessary in connection therewith.
