AN ORDINANCE
AN ORDINANCE AUTHORIZING THE CLOSING AND ABANDONING
OF THAT PORTION OF CALDER.ROAD IN.THE CITY OF BEAU-
DIONT LYING BETWEEN THE NORTHEASTERLY AND SOUTHWESTERLY
RIGHT-OF-WAY LINES OF THE MISSOURI-PACIFIC RAILROAD
COMPANY'S NEW RIGHT OF.WAY LOCATED AND STAKED ON THE
GROUND, SUBJECT TO THE RIGHT TO.MAINTAIN EXISTING
UTILITIES THEREIN, IF ANY®
WHEREAS, as part of The City of Beaumont's overall grade
separation program, the main line of the Missouri Pacific Railroad
Company is being relocated so as to cross Calder Avenue Extension,
or, as it is now called, Calder Road, at a point adjacent to Forest
Park Addition to The City of Beaumont, which relocation will eliminate
a number of grade crossings along the present right of way of the
Missouri Pacific Railroad Company, including the present crossing at
grade over Calder Road; and,
ITHEREAS, because of said.relocation of said Railroad line,
Calder Road is being diverted at that point onto the Old Sour Lake
Road, thus permitting the closing of that portion of Calder Road which
is occupied by the new right of way of the Missouri Pacific Railroad
Company, and thus avoiding another grade crossing; and,
WHEREAS, it appears to the City Council that the closing of
that portion of said Calder Road which is.to be occupied by -the relo-
cated right of way of the Missouri Pacific Railroad will be to the
best interest of -The City of Beaumont and will be of great benefit to
the public, and that, therefore, said portion of said street lying
within the right of way'should be vacated and abandoned;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT;
TEXAS: -
That that portion of Calder Road in The City of Beaumont lying between
the northeasterly and southwesterly right-of-way lines of the Missouri
Pacific Railroad Company's new right of way, as now located and staked
on the ground, be, and the same is hereby, vacated and abandoned, sub-
ject to the right to use and maintain existing utilities therein, if
any; and that the title to said portion of said street herein vacated
and abandoned shall revert to and become the property of the parties
entitled thereto, as provided by law, subject to the right of. the
Missouri Pacific Railroad Company to maintain and operate a railroad
thereon, including any.and all operations necessary.in connection
therewith.
