RATES TO BE CHARGED BY UNITED -GAS CORPORATION, ITS SUCCESSORS
AND ASSIGNS, -IN THE CITY OF BEAUMONT, FOR NATURAL GAS AND
NATURAL GAS SERVICE, FURNISHED .BY IT, CONTAINING DEFINITIONS,
FIXING THE EFFECTIVE DATES OF GAS RAT ES ,PRE'SCRIBED IN THIS
ORDINANCE, AND REPEALING ALL ORDINANCES IN CONFLICT.
�IHEREA.S, on or -about August,12, 1958, the United
Gas Corporation completed its,presentation of its-4pplication
for an increase in rates'to be charged for natural gas.and
natural gas.service in the City -of Beaumont in.a public hearing
accorded to said Company; and
WHEREAS, the City Council having heard and fully
considered the evidence adduced at said hearing, recognizes
that the rates now being charged'by United.Gas,Corporation
for natural gas and natural gas service -in the City of- Beaumont
should be increased, NOW, THEREFORE,
BE IT ORDAINED 'BY THE CITY OF BEAUMONT:
SECTION 1.
The United Gas. Corporation, its successors and
assigns (hereinafter sometimes referred to as the "Company`),
is hereby authorized to place in effect the following schedules
of rates within the corporate limits of the City of Beaumont
for the supply of natural gas and natural gas service:
RESIDENTIAL RATES
NET 1,10NTHLY RATE
$1.50 per month -which includes the use of 600 cubic feet
9-1/2,� per 100 cubic feet for the next 5,400 cubic feet
7-1/4� per 100 cubic feet for the next 10,000 cubic feet
5-1/21� per 100 cubic feet for all additional gas used.
Minimum Monthly Bill: $1.50.

Bills shall be rendered on a.monthly basis
and are due and payable within ten_"(10) days from
the date of bill.-

$2.00 per month, -which includes the use of 600 cubic feet

5-1/2� per 100 cubic feet for all additional gas used.

and are due.and payable within ten (10) days from.
the date of bill.
The.net monthly rates shown above, both residential
and commercial, are based upon the Company's 12-month average
unit cost of gas at the gate rate in effect on December 31.,
1957. Whenever such gate rate is increased or decreased
hereafter, the change in'such unit cost .will be,. passed along
by the . Company to its: _.customers (by the method set forth, in
Exhibit 1) by an adjustment in -such net monthly rates (except.
for -the first 600 cubic feet) after the Company has fi led with
the City Clerk a sworn statement-setting,'forth,the change in
such _unit cost and the adjusted consumer rates, both residential.
and commercial, which result therefrom'.`
The above schedules.of residential. rates and of
commercial rates, as adjusted in the manner hereinabove pro-
vided, are the highest rates that may charged. by United Gas
Corporation-, its successors and assigns, for residential'
consumers and commercial consumers within the City of Beaumont.
,Other lower residential rates and commercial rates maybe fixed
and determined from time to time by United Gas Corporation, its
successors and assigns,.for gas and gas service furnished to
residential consumers and commercial consumers.

(a) RESIDENTIAL. .CONSUIPIER. The term : "residential
consumer" as..used herein shall mean a customer or user.of
gas to whom service is supplied in a dwelling or a -residential
apartment for,uses usual in a home.
The terms "residential consumer" and "domestics
consumer" are consider'ed.to be synonymous.
Natural gas supplied by United,Gas.Corporation, its
successors and assigns; is for.the individual use of the
customer at one point of delivery and shall not be resold or
shared with others.
(b) CORDIERCIAL CONSUMER. The term, "commercial consumer"
as used herein shall mean a customer or user of gas engaging
in any.'Ausiness, professional,,' or institutional activity;.
for all unrestricted uses of gas, including cooking, heating,
refrigeration, water _heating, air conditioning and power.
Natural gas.supplied by United Gas Corporation, its
successors and assigns, is for the. individual use of the
customer at one point of delivery and shall not be resold
or shared.with others.
SECTION 3.
The maximum rates and charges prescribed in this
ordinance for residential consumers and commercial consumers
shall apply'as maximum;rates.,and charges to all gas used by
such consumers -to whom such rates are applicable after their
regular meter reading dates commencing on the day next follow-
ing the effective date of this ordinance, 'viz, the date of
passage -of this ordinance.

SECTION 4.
All ordinances or parts of ordinances in conflict
herewith are repealed to the -extent of the conflict only.
SECTION 5.
That nothing in this ordinance contained shall be
construed as in any manner, now or hereafter, limiting or
modifying -the right and power'&f.the City Council, under. -
the law.to regulate the rates .charged by,United'Gas Corporation,
its successors and assigns, within the City of.Beaumont.

ADJUSTMENT OF NET MONTHLY CONSUMER RATES
AS A _RESULT OF CHANGES IN COST OF GAS
The net monthly consumer rates, both residential and commercial
shown in the foregoing ordinance ("base rates-")- are predicated
upon the cost of gas purchased for the Company's Beaumont
Distribution System at the city gate rate in effect as of
December 31, 1957 (".base cost of gas"). whenever the.cost
of gas purchased for the Company's Beaumont Distribution
System is increased or decreased as a result of an increase
or decrease.in the aforesaid city gate rate the consumer.
rates (except for the first 600 cubic feet)- will'be increased
or decreased above or below such base rates (such adjusted
consumer rates to.'be applied to all bills rendered after
the expiration of thirty days following such city gate rate
change) in an amount determined as follows: (1) the "base
cost" of gas shall be•determined by applying the city -.gate
rate in effect as,of December 31, 1957 to the billing volumes
of gas purchased during the 12 months immediately preceding
the month in which.a change in.the city gate rate occurs;
(2) The "adjusted cost" of" gas shall be determined by
applying the revised city gate rate to the billing volumes
of gas purchased for the same 12 month period; and (3) The
amount.of the increase or decrease -per 100 cubic feet in
the consumer rates shall be determined'by dividing the
difference between the."adjusted cost"- and the "base cost"
of gas purchased.,for,-the Beaumont Distribution.System by
the actual volume of gas purchased during the.same'12.months
period.
if, as a result of any decrease. -in the city•gate rate, the.
Company receives a,refund of any -amount paid for gas which
is,.purchased'arter the effective date of such base rates,
the consumer rates adjusted as provided above which would
otherwise be in'effect will be reduced during a 12 calendar
month period ,thereafter by .an amount :per. '100 cubic feet
determined by dividing the amount of such refund by the
total volume of gas.purchased during the 12.months immediately
preceding the month durin.gwhich such refund was received
by the Company.
Before any adjusted'consumer.rate is applied to any con-
Sumer's bill the Company shall file with the City Clerk
a sworn statement setting forth the change in such unit
cost and, -the adjusted consumer rates., both 'residential
and commercial, which result therefrom.-
