AN ORDINANCE
ENTITLED. AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY
OF BEAUMONT INDEPENDENT SCHOOL DISTRICT, OF JEFFERSON COUNTY, -TEXAS, ON THE
lst DAY OF NOVEMBER, 1947, TO DETERMINE WHETHER OR NOT THE CITY COMMISSION
OF THE CITY OF BEAUMONT SHALL BE AUTHORIZED TO LEVY AND COLLECT FOR THE
CURRENT YEAR AND ANNUALLY THEREAFTER FOR THE CITY OF BEAUMONT INDEPENDENT
SCHOOL DISTRICT, OF JEFFERSON COUNTY, TEXAS, &,TAX UPON ALL TAXABLE PROPERTY
IN THE CITY OF BEAUMONT INDEPENDENT SCHOOL DISTRICT, OF JEFFERSON COUNTY,
TEXAS, FOR THE MAINTENANCE OF THE PUBLIC SCHOOLS -THEREIN AT A RATE NOT TO
EXCEED $1.50 ON THE $100 VALUATION OF ALL TAXABLE PROPERTY IN SAID DISTRICT;
AND TO DETERMINE WHETHER OR NOT THE CITY COMMISSION OF THE CITY OF BEAUMONT
SHALL BE AUTHORIZED TO ISSUE SERIAL BONDS OF THE CITY OF BEAUMONT INDEPENDENT
SCHOOL DISTRICTS OF --SON COUNTY -TEXAS THE AMOUNT OF $2,956,bob TO
PROVIDE FUNDS TO CONSTRUCT PUBLIC FREE SCHOOL BUILDINGS OF MATERIALS OTHER
THAN WOOD AND TO REPAIR EXISTING PUBLIC FREE SCHOOL BUILDINGS OF OTHER THAN
WOOD MATERIAL, AND TO PURCHASE NECESSARY EQUIPMENT THEREFOR; AND TO PUR-
CHASE OR OTHERWISE ACQUIRE THE NECESSARY GROUNDS THEREFOR, SAID BONDS TO
MATURE SERIALLY IN SUCH INSTALLMENTS AS MAY BE FIXED BY THE CITY COMMISSION
OVER A PERIOD OF YEARS, NOT TO EXCEED 25 YEARS FROM THEIR DATE, BEARING IN-
TEREST NOT TO -EXCEED 4 o PER ANNUM, AND TO LEVY A TAX IN PAYMENT THEREOF;
MAKING CERTAIN FINDINGS AS TO THE NECESSARY OF ISSUING SAID BONDS AND MAKING
TEE IMPROVEMENTS THEREIN CONTEMPLATED; NAMING THE TIME AND PLACE OF HOLDING
SAID ELECTION AND APPOINTING OFFICERS THEREOF; . PROVIDING THE MANNER OF
HOLDING SAID ELECTION AND. GIVING NOTICE THEREOF; AND DECLARING AN EMERGENCY.
WHEREAS, there has-been submitted to the Board of Trustees of the
City of Beaumont Independent School District, of Jefferson County, Texas,
and to.the City Commission of the City of Beaumont, Texas, a petition signed
by Mrs. V. E. Karnes and 283.others, being more than twenty resident property
tax -paying voters residing within the City of Beaumont Independent School
District, of Jefferson County, Texas, who own taxable property in said dis-
trict and who have duly rendered the same for taxation, requesting the
governing body of the City of Beaumont to order an election in said district
at the earliest practicable time, for the purpose of submitting to the
resident qualified property tax -paying voters of said School District who
own taxable property in said district.and who have duly rendered the same
for taxation, for their action thereon, the proposition of authorizing the
governing body of the City of Beaumont to levy and collect for the current
year and annually thereafter, for the City of Beaumont Independent School
District, of Jefferson County, Texas, a tax on all taxable property in said
district for the maintenance of public schools therein, at a rate not to
exceed $1.50 on the $100 valuation of all taxable property in said district;
and,
WHEREAS, there has been presented to the Board of.Trustees of
the City of Beaumont Independent School District, of Jefferson County, Texas,
and to the.City Commission of the City of Beaumont, Texas, a petition
signed by Jennie Glen and 282 others, being more than twenty (20)

resident property taxpaying voters residing within the -City of Beaumont
Independent School District, of Jefferson County, Texas, who own taxable
property in said district, and who have duly rendered the same for taxation,
requesting the City Commission to order an election in said district at the
earliest date practicable, for the purpose of submitting to the resident
qualified property taxpaying voters of said district, who own taxable pro-
perty in -said district-,_ and who have- duly rendered the.-_ same_for--taxation,- - - --- -
for their action thereon, the proposition to determine whether the City
Commission of the City of Beaumont shall be authorized,to issue serial bonds
of said City of Beaumont Independent School District, of Jefferson County,
Texas, in the amount of two million nine hundred fifty-six thousand dollars
($2,956,000), to provide funds to construct public free school buildings
of materials other than wood, and to repair existing public free school
buildings of other than wood material, to purchase equipment therefor, and
to purchase or otherwise acquire the necessary -grounds therefor; said bonds
to mature serially in such installments as may be fixed by the City Commission
over a period of years, not to exceed twenty-five (25) years from their date,.
and bearing interest at a rate not to exceed four per cent (4%) per annum;
and,
WBEREAS, the City Commission of the City of Beaumont, Texas, has,
examined said petitions and finds and determines that each of said petitions
is signed by more than twenty qualified property taxpaying voters, residing
within the City of Beaumont Independent School District, of Jefferson County,
Texas, who own taxable property in said district, and who have duly rendered
the same for taxation; and further finds and determines that it is necessary
for the maintenance of the public free schools in the City of Beaumont Inde-
pendent School District, of Jeff�rson County, Texas, to levy a tax not to
exceed $1.50 on the $100 valuation of all taxable property in said district
by reason of the fact that increases in teachers' salaries and increases in
prices for supplies and maintenance of the public free schools in said dis-
trict have made it imperative that such additional tax be levied for the
maintenance of the schools.in said district. And the City Commission of the
City of Beaumont further finds that the public free school buildings in said
district on account. of recent increase in population are wholly inadequate
to take care of the scholastics in said district, and additional buildings

and school facilities are imperative; and further that the existing build-
ings in said district are in serious need of repair, and that said facilities
should be constructed and said buildings should be repaired and completed
at the earliest practicable date, and that the existing necessity for such
is urgent and imperative;, now, therefore:
BE IT ORDAINED BY THE CITY COMUSSION OF

SECTION 1
That an election be held in the City of Beaumont Independent School
District, of Jefferson County, Texas, on t� 1st'-'day''of° November; 1947, which
is not less than fifteen days nor more than thirty days from the date of the
passage of this ordinance, at which election the following propositions shall
be submitted separately to the qualified electors of the City of Beaumont
Independent School District, of Jefferson County, Texas, who own taxable
property in said school district and who have duly rendered the same for
taxation, and all electors shall vote in the election precinct of their res-
idence.
SECTION 2
The first proposition to be submitted at said election shall be
the following:
FIRST PROPOSITION
Shall the City Commission of the City of Beaumont, Jefferson
County, Texas, have the power to levy and collect for the current year and
annually thereafter for the City of Beaumont Independent School District,
of Jefferson County, Texas, a tag upon all taxable property in the City of
Beaumont Independent School District, of Jefferson County, Texas, for the
maintenance of public schools therein, at a rate not to exceed $1.50 on the
$100 valuation -of all taxable property in said district.
SECTION 3
The second proposition to be submitted at said election shall
be the following:
SECOND PROPOSITION
Shall the City Commission of the City of Beaumont, Texas, be
authorized to issue serial bonds of the City of Beaumont Independent School
District, of Jefferson County, Texas, in the amount of two million nine
hundred fifty-six thousand dollars ($2,956,000), to provide funds to con-
struct public free school buildings of materials other than wood, and to

repair existing public free school buildings of other than wood material,
and to purchase necessary equipment therefor, and to purchase or otherwise
acquire the necessary grounds therefor, said bonds to mature serially in
such installments as may be fixed by the City Commission over a period of
years, not to exceed twenty-five years from their date, bearing interest
not to exceed four per cent (4%) per annum, and shall there be annually
levied, assessed, and collected for the current year and annually thereafter
while said bonds or any of them are outstanding and unpaid an annual ad valcrem
tax on all taxable property in the City of Beaumont Independent School District,
of Jefferson County, Texas, sufficient to pay the interest on all of said
bonds and to create a sinking fund to pay the principal thereof as same be-
comes due.
SECTION 4
The question as to whether or not the City Commission of the City
of Beaumont shall be authorized to levy a maintenance tax of not to exceed
$1:50 on the $100 valuation of all taxable property in the City of Beaumont
Independent School District, and the question as to whether or not the City
Commission of the City of Beaumont shall be authorized to issue said serial
bonds shall be submitted separately on the ballot as to each of the above
propositions. The ballot to be used for the election shall be printed and
furnished by the City of Beaumont Independent School District, as provided
by law, and each ballot shall have printed thereon the following:

PUBLIC FREE SCHOOL BUILDINGS OF MATERIAL OTHER THAN.WOOD AND
REPAIRING EXISTING PUBLIC FREE SCHOOL BUILDINGS.OF OTHER THAN
WOOD MUMIAL, AND PURCHASING NECESSARY EQUIPMENT THEREFOR,
AND PURCHASING OR OTHERWISE ACQUIRING THE NECESSARY GROUNDS
THEREFOR; AND THE LEVYING OF A TAX IN PAYMENT THEREOF . .
AGAINST THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF
BEAUMONT INDEPENDENT SCHOOL DISTRICT FOR THE PURPOSE OF
CONSTRUCTING PUBLIC.FREE SCHOOL BUILDINGS OF MATERIAL OTHER
THAN WOOD AND REPAIRING EXISTING PUBLIC FREE SCHOOL BUILDINGS
OF OTHER THAN WOOD -MATERIAL,, AND -PURCHASING NECESSARY EQUIP-
MENT THEREFOR, AND PURCHASING OR OTHERWISE ACQUIRING THE' .
NECESSARY GROUNDS,THEREFOR; AND THE LEVYING OF A TAX IN PAY-
MENT THEREOF

SECTION 5
Concerning each proposition, each voter shall mark out with
black ink or black pencil one of the above expressions on the ballot,
thus leaving the other as indicating his vote on such proposition.
SECTION 6
Said election shall be held in each of the legal voting precincts
within the City of Beaumont Independent School District, of Jefferson County,
Texas, and also in each of the fractional legal voting precincts in said
school district where only a portion of such precinct is within said school
district; and the following places therein, respectively, are hereby
designated polling places in the voting precincts in the City of Beaumont
Independent School District, of Jefferson County, Texas, and the follow-
ing named persons are hereby appointed officers of said election:
(1) In Voting Precinct No. 2, said election shall be held
at the Junker School Building, and Mrs. James E. Ray is hereby appointed
presiding judge to hold said election, with authority to appoint her assist-
ants and clerks.
(2) In Voting Precinct No. 3, said election shall be held at
the Gladys Street Fire Station, and Mrs. L. E. Downs is hereby appointed
presiding judge to hold said election, with authority to appoint her assist-
ants and clerks.
(3) In Voting Precinct No. 4, said election shall be held at
the Averill School Building, and C. L. Rutt is hereby appointed presiding
judge to hold said election, with authority to appoint his assistants and
clerks.
(4) In Voting Precinct No. 5, said election shall be held at
the Beaumont High School Building, and Spencre-r-=Bla-i-n is%ereby appointed
presiding judge to hold said election, with authority to appoint
assistants and clerks.
(5) In Voting Precinct No. 6, said election shall beheld at
the Dick Dowling Junior High School Building, and Mrs. Elmon W. Doty is
hereby appointed presiding judge to hold said election, with authority to
appoint her assistants and clerks.
(6) In Voting Precinct No. 7, said election shall be held at
the Central Fire Station, and Mrs. Geo. Rafferty is hereby appointed
presiding judge to hold said election, with authority to appoint her assist -
arts and clerks.

(7) In Voting Precinct No. 8 said election shall be held at the
City Hall, and Morzis=-Smith is hereby appointed presiding judge to hold said
election with authority to.appoint hirs assistants and clerks.
(8). In fractional part of Voting Precinct No. 9 lying within the
City of Beaumont Independent School District, of Jefferson County, Texas,
said election shall be held at the Fletcher School Building, and R. L.
- zs--hereb _�appointed-Presi ing Judge to hold"said election -with -
authority to appoint his assistants and clerks.
(9)- In Voting Precinct No.' 10 said election shall be held at the
Jefferson County Court House, and Y. E. Carroll is hereby appointed presiding
judge to hold said election with authority to appoint his assistants and
clerks.
(10) In fractional part of Voting Precinct No. 11 lying within -
the City of Beaumont Independent School District, of Jefferson County,
Texas, said election shall be held at the David Crocket Junior High School
Building, and F. L. Fisher is hereby appointed presiding judge to hold said
election with authority to appoint his assistants and clerks.
(11) In fractional part of Voting Precinct No.,12 lying within
the City of Beaumont Independent School District, of Jefferson County,
Texas, said election shall be held at the Ogden School -Building, and Pairs.
C. E. Drake is hereby appointed presiding judge to hold said election with
authority to appoint her assistants and clerks.
(12) In Voting Precinct No. 13 said election shall be held -at
the Sabine Pass Avenue Fire Station, and Mrs. B. P. Derr is hereby appointed
presiding judge to hold said election with:. -authority to appoint her assist-
ants and clerks.
(13) In fractional part of Voting. -Precinct No. 14 lying within
the City of Beaumont Independent School District, of Jefferson County, Texas,
said election shall be held at the Magnolia School Building, and Mrs. -Fred
Driehs is hereby appointed presiding judge to hold said election with author-
ity to appoint her assistants and clerks.
(14) In fractional part of Voting Precinct No. 15 lying within
the}City of Beaumont Independent School District, of Jefferson County,,Texas,
said election shall be held at 619 Washington Boulevard, and Geo. C. Debney
is hereby appointed presiding judge to hold said election with authority to
appoint his assistants and clerks:

(15) In fractional part of Voting Precinct No. 16 lying within
the City of Beaumont Independent School District, of Jefferson County, Texas,
said election shall be held at 1203 Washington Boulevard, and W. C. Books
is hereby appointed presiding judge to hold said election with authority to
appoint his assistants and clerks.
(16) In fractional part of Voting Precinct No. 47 lying within
- - -the City of Beaumont Independent School District, of Jefferson County, Texas,
said election shall be held at St. Anne's School Building, and Mrs. Eugene
Seale is hereby appointed presiding judge to hold said election with author-
ity to appoint her assistants and clerks.
SECTION 7
Said election shall be held under the provisions of and in ac-
cordance with the laws governing the issuance of municipal bonds of cities,
as provided in the Constitution and General Laws of the State of Texas, and
under the laws governing the levying of a maintenance tax for public free
school buildings, and the manner of holding said election and:making returns
thereof shall be governed by the laws of the State of Texas governing general
elections, and only qualified electors of the City of Beaumont Independent
School District, of Jefferson County, Texas, who own taxable property in
said district and who have duly rendered the same for taxation, shall be
qualified to vote at said election, and all electors shall vote in the
election precincts of their residence.
SECTION 8
A copy of this ordinance, signed by the Mayor of the City of
Beaumont and attested by the City Clerk of the City of Beaumont, shall serve
as proper and sufficient notice of said election; and the Mayor is hereby
directed to cause one each of said notices to be posted in each of the election
precincts and fractional parts of election precincts within the City of
Beaumont Independent School District, and at the City Hall, such posting to
be not less than fifteen (15) full days prior to the date set for said
election, and he shall further cause said notice to be published on the same
days in each of two successive weeks in a newspaper of general circulation
published within the said City of Beaumont Independent School District, the
date of the first publication to be not less than fourteen (14)_L£ull days
prior to the date set for said election. The person posting said notices
shall make a return on the copy thereof showing the times and places of

posting, and the returns shall be filed in the office of the City Clerk
and shall be conclusive evidence of the posting of said notices. And the
affidavit of the publisher of the newspaper stating the days on which the
same was published shall be filed in the office of the City Clerk and shall
be conclusive evidence of the publication of said notice.
SECTION 9
The fact that the City of Beaumont Independent School District has
within recent years had a considerable increase in population and a con-
siderable increase in the number of scholastics; and the fact that the
teachers' salaries have been raised, and the prices of supplies and main-
tenance and materials have greatly increased; and the fact that the ex-
isting public free school buildings in said district are wholly inadequate
to care for the increased number of scholastics in said district; and the
fact that no bond issue has been voted in:, said district within recent years
for the repair of the school buildings in said district, and said school
buildings are in urgent need of repair, create an imperative public emergency
necessitating the suspension of the rule requiring ordinances to be read on
three separate days before their passage, and said rule is hereby suspended
and this ordinance shall take effect from and after the date of its passage.
PASSED this, the loth day of October, 1947, by the affirmative vote
of all members of the City Commission of the City of Beaumont, Texas.

To the Honorable City Commission,
City of Beaumont,
Beaumont,
Texas.
The Board of Trustees of the City of Beaumont Independent
School District herewith transmits a -petition signed by
Jennie Glen and 282 other persons requesting that an election
be held in the City of Beaumont Independent School District
at the earliest practical time to determine whether or not
bonds of the School District in the amount of $2,956,000.00
be issued for the purpose of purchasing sites, constructing
school buildings and purchasing equipment therefor and making
the necessary repairs to the existing buildings.
The Board of Trustees requests the City Commission to call
said election as prayed for in said petition on the first
day of November, 1947.
