NOTICE OF.SAID ELECTION.
WHEREAS, on the-13th-day of January, A, D., 1948, the
City Commission of -the- City of -Beaumont passed an -ordinance en-
titled;
'BAN ORDINANCE ESTABLISHING ZONING REGULATIONS
AND DISTRICTS IN ACCORDANCE WITH A COMPREHENSIVE
PLAN AND REGULATING AND REDISTRICTING THE HEIGHT,
NUMBER OF STORIES AND SIZE OF.BUILDINGS AND OTHER
STRUCTURES,.THE PERCENTAGE OF. LOT THAT MAY BE
OCCUPIED, THE SIZE OF YARDS, COURTS AND OTHER
OPEN -SPACES, THE DENSITY OF POPULATION, THE LOCA-
TION AND USE OF BUILDINGS,- STRUCTURES AND LAND
FOR TRADE INDUSTRY, _ RESIDENCES AND OTHER PURPOSES,
AND DIVIDING THE CITY OF BEAUMONT INTO DISTRICTS
AND REGULATING AND REDISTRICTING THE ERECTION,
CONSTRUCTION, RECONSTRUCTION, ALTERATION, REPAIR
OR USE OF BUILDINGS; , STRUCTURES- OR LAND WITHIN

WHEREAS, on'the' 13th day of January, A. D. 1948, the
Council of the City of :Beaumont approved by a majority vote said
ordinance; and, -
WHEREAS, on March 3, 1948 more than three hundred (300)
qualified voters of the City of Beaumont filed with the -City
Clerk a petition requesting that.the'said ordinanc-e be submitted
to _a vote of the electors of the City of Beaumont for their ap-
proval or rejection;, and;
WHEREAS, it'is
the opinion of the
City
Commission of
the City of Beaumont
that the petitioners
have
complied with
the provisions of the Charter of the City of Beaumont and that,
therefore, the Commission should provide for submitting the
question to the ,electors -at an election within the time specified
by the -Charter of the City of Beaumont, which said Charter pro-
vision provides that 'an election sha.11..be held not more than
ninety (90) days -after. the receipt by the Commission of. the Clerk's
certificate on the petitions filed -with her; and,
WHEREAS, the Charter of the City of Beaumont further pro-
vides that if the ordinance be not approved by a majority of
those voting thereon it shall.be deemed. repealed, otherwise it
shall remain in. force and effect;
NO1'V; -THEREFORE. BE IT ORDAINED BY THE CITY
COMMISSION.OF THE CITY OF BEAUMONT
Section 1.
That an.election be held in the City of Beaumont'on the
13th day of -April, A.D. 1948, at which election -there shall be
submitted to -the qualified voters of the City of Beaumont the
following proposition;. _.
Shall the ordinance passed by the City Commis-
sion of the City of Beaumont on the 13th day of
January, A. D.,-1948, providing.for the estab-
lishment of zoning regulations -and districts in
the City of Beaumont be approved?
Section- 2.
That said election shall be -held in the. City of Beaumont
at the following places, to wit; .
-French School (High School);-Junker School;
Central Fire Station; Averill.School; Beaumont
. High School; City Hall; Sabine Pass Fire Station;
Ogden School; David Crockett Junior_High School;
South Park Elementary School; -Giles School;
Hebert.High School, and Edwards School.

That all voters residing in County Voting Precinct No.
1 shall vote at the French High School Building; that all voters
residing in County Voting Precinct No. 2 shall vote at the
Jur..ker School Building; that all voters residing in ,County Voting
Precincts Nos. 3, 6. and 7 shall vote at Central Fire- Station
Building; that all'.voters residing in _County Voting Precinct No.
4 and' all that portion of. County Voting Precinct No. 47' dying
within the City of Beaumont shall vote at the Aver -ill School
Building; that .all voters -residing in County Voting Precinct No.
5-and.all that portion of County Voting Precinct No. 50 lying
withintheCity of Beaumont shall vote at the Beaumont High
School Building; that..all voters residing in County Voting Pre-
cincts Nos. 8 and-9 shall vote-at.the City Hall; that all voters
residing in Gounty Voting Precincts Nos. 10, 139 and 14 shall
vote at the Sabine Pass Fire Station; that all voters residing
in County Voting Precinct: No. t4, _shall vote at the Ogden School
-Building; that all voters residing in County Voting Precinct No.
12 shall-vote..at David Crockett Junior-High'School Building;
that all voters residing in County. Voting Precinct 1J0.. 15 and
all that portion of -County Voting Precinct No. 42 -lying 'tithir_
the City of Beaumont shall vote -at the South -Park Elementary
School Building; that all voters residing in County Voting Pre-
cinct No. 16 and .all that portion of County Voting Precinct No.
43.1ying within the City of Beaumont shall vote at the Giles
School Building; that all _voters residing .in County Voting Pre-
cinct No. 17-shall vote at the Hebert High School Building;
that all voters residing in -County Voting Precincts Nos. 18 and
19 shall vote.at.the Edwards School Building.
Section.3.
The following named persons are appointed presiding
judges for their respective -voting .boxes with the authority_ to
select and appoint their own clerks;

Section 5.
All voters desiring to vote for the approval of.the
ordinance providing for the establishment of Zoning regulations
and districts in the City of Beaumont shall run 'a _line through
and across the.paragraph on said ballot containing the words

"Against the Ordinance"; and all voters desiring to repeal said
ordinance shall run -a line through and across the paragraph on
said.ballot containing -the words "For the Ordinance."
Section. 6.
" Should, at said election, .'a majority of the, qualified
voters ,voting at the election,vote against the said ordinance,
then the said. ordinanc.e shall' be- deemed -to have been- repealed,
otherwise, it shall remain in ;force,
Section 7.
That a copy of thi-s ordinance signed by the Mayor -of the
City of Beaumont and, attested.,by- the .City. Clerk, of the City of
Beaumont shall, -serve -as a proper and sufficient notice of" said
election, and.the-Mayor-is hereby directed to -cause a copy of
thi-s ordinance; signed by himself and attested by. the City Clerk,
to .be posted .at each of the plac e.s- herein designated for holding
said election"at least thirty (30)-days prior to the -date of
holding said election in the manner. required by law.

AN ORDINANCE
ENTITLED AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE
HELD IN THE CITY OF BEAUMONT TO DETERMINE WHETHER OR NOT
A "ZONING" ORDINANCE PASSED BY THE CITY COMMISSION SHALL
BE REPEALED; SETTING THE.DATE THEREOF; PROVIDING THE
PLACES AT WHICH SAID ELECTION SHALL BE HELD AND DESIG-
NATING THE PLACES WHERE THE VOTERS SHALL VOTE; APPOINTING
JUDGES TO PRESIDE OVER SAID ELECTION-; PROVIDING THE MANNER
OF HOLDING SAID ELECTION; PROVIDING THE ISSUES TO BE SUB-
MITTED AND FORM OF BALLOT; -PROVIDING FOR NOTICE OF SAID
ELECTION.
WHEREAS, on the 13th day of January, A. D., 1948,-.the City Commission of
the City of Beaumont passed an ordinance entitled:
"AN ORDINANCE ESTABLISHING ZONING REGULATIONS AND DISTRICTS
IN ACCORDANCE WITH A COMPREHENSIVE PLAN AND REGULATING AND
REDISTRICTING THE HEIGHT, NUMBER OF STORIES AND SIZE OF
BUILDINGS AND OTHER STRUCTURES, THE PERCENTAGE OF LOT THAT
MAY BE OCCUPIED, THE SIZE OF YARDS, COURTS AND OTHER OPEN
SPECES, THE DENSITY OF POPULATION, THE LOCATION AND USE OF
BUILDINGS, STRUCTURES AND LAND FOR TRADE INDUSTRY, RESIDENCES
AND OTHER PURPOSES, AND DIVIDING THE CITY OF BEAUMONT INTO
DISTRICTS AND REGULATING AND REDISTRICTING THE ERECTION,
CONSTRUCTION, RECONSTRUCTION, ALTERATION, REPAIR OR USE OF
BUILDINGS, STRUCTURES OR LAND WITHIN SUCH DISTRICTS AND PRO-
VIDING UNIFORM REGULATIONS FOR THE SEVERAL CLASSES OR KINDS
OF BUILDINGS OR STRUCTURES AND USES WITHIN THE RESTRICTIVE
DISTRICT, AND ADOPTING A ZONING MAP DISCLOSING THE SEVERAL
DISTRICTS AND USE AREAS AND THE RESTRICTIONS,AND LIMITATIONS
AND PROVISIONS APPLICABLE TO SUCH DISTRICTS AND AREAS; AND
PROVIDING FOR A BOARD OF ADJUSTMENT AND DEFINING THE POWERS
OF SAME. "
and,
WHEREAS, on the 13th day of January, A. D., 1948, the Council of
the City of Beaumont approved by a majority vote said ordinance; and,
WHEREAS, on March 3, 1948 more than three hundred (300) qualified
voters of the City of Beaumont filed with the City Clerk a petition requesting
that the said ordinance be submitted to a vote of the electors.of the City of
Beaumont for their approval or rejection; and,
WHEREAS, it is the opinion of the City Commission of the City of Beau-
mont that the petitioners have complied with the provisions of the Charter of
the City of Beaumont and that, therefore, the Commission should provide for sub-
mitting the question to the electors at an election within the time specified by
the Charter of the City of Beaumont, which said Charter provision provides that
an election shall be held not more than ninety (90) days after the receipt by
the Commission of the Clerk's certificate on the petitions filed with her; and,
WHEREAS, the Charter of the City of Beaumont further provides that
if the ordinance be not approved by a majority of those voting thereon it shall
be--deemed-repealed, otherwise it shall remain in -force and effect.
NOVI, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BEAUMONT:
1.
That an election be held in the City of Beaumont on the 13th day
of April, A. D., 1948, at which election there shall be submitted to the
qualified voters of the City of Beaumont the following proposition:
Shall the ordinance passed by the City Commission of the
City of Beaumont on the 13th day of January, A. D., 1948,
providing for the establishment of zoning regulations and
districts in the City of Beaumont be approved?

All voters desiring to vote for the approval of the ordinance pro-
viding for the establishment of zoning regulations and districts in the City
of Beaumont shall run a line through and across the paragraph on said ballot
containing the words "Against the Ordinance"; and all voters desiring to
repeal said ordinance shall run a line through and across the paragraph
on said ballot containing the words "For the Ordinance."

Should, at said election, a majority of the qualified voters
voting at the election vote against the said ordinance, then the said
ordinance shall be deemed to have been repealed, otherwise, it shall re-
main in force.
7.
That a copy of this ordinance signed by the Mayor of the City
of Beaumont and attested by the City Clerk of the City of Beaumont shall
serve as a proper and sufficient notice of said election, and the Mayor
is hereby directed to cause a copy of this ordinance, signed by himself
and attested by the City Clerk, to be posted at each of the places herein
designated for holding said election at least thirty (30) days prior to
the date of holding said election in the manner required by law.
