HomeMy WebLinkAboutORD 23-S9 V-? AN ORDINANCE AN ORDINANCE AUTHORIZING THE VACATING AND, CLOSING OF AUGUSTA STREET WITHIN THE CITY':OF BEAUMONT FROM SOUTH IRVING STREET.WEST.ONE,_ HALF BLOCK. WHEREAS, a petition signed by S. K. Long, attorney for Paul W. Bergmann, the owner of Lot Nine (9) in Block Four (4) of the Morning View Addition to the City of Beaumont, has been presented to the City Commission of the City of Beaumont, requesting that Augusta Street be closed from South Irving Streetwest one half block; and, WIiEREAS, according to said petition, heretofore in the year 1924, Augusta Street from South Irving Street west was closed by order of ,the Jefferson County Commissioner's Court �i and was placed on the tax roll as Lot No. Nine (9), Block Four (4) of the Morning View Addition, and that since that date the tax units in which the property is located has been collecting taxes on said property and said Street has been closed since that time; and, WHEREAS, the said petition further -states that prior to the year.1924, Augusta Street extended one half block w est of South Irving Street, at which time a petition was presented to the,Jefferson County Commissioner's Court requesting that the street be closed, and said Court acted favorably upon this request, and the property was placed upon the tax rolls of both. i the South Park Independent School District and the County; and WHEREAS, examination of the minutes of the,Commissioner's Court for the County of Jefferson failed to disclose any order entered by said Court, and that due to the fact that said pro- perty is now within the City limits of the City of Beaumont, it is necessary that anordinance be passed officially closing this portion of said Augusta Street in order that the record title.of this property may be cleared; and, WHEREAS, said petition has been referred to the Plan- ning and Zoning Commission for examination and approval, and the same has been approved by said Commission; and, WHEREAS, said petition and the facts contained there- in has been duly considered by the City Commission, and it appearing to the City Commission that the request of said pro- perty owner should be granted and that an ordinance should be enacted vacating and closing said Street, as above described; -NOW, THEREFORE, BE IT ORDAINED BY THE CITY COM- MISSION OF THE CITY OF BEAUMONT: that Augusta'Street, within the City of Beaumont, from South Irving Street west one half block (also being now known as Lot Nine (9) Block Four (4) of Morning View Addition to the City of Beaumont) be and the same is hereby authorized to be vacated and closed. Will you please prepare the necessary resolution for approval by the City Commission. I am attaching 3 copies of the sketch of that block and three copies of excerpts of the Planning and Zoning Commission minutes of Janu— ary 22, 1948, one each for your Tile and two each for the Clerk's office which should accompany -the -resolution. Bergmann and would show this Honorable Board that he is now :the owner of Lots One and Two in ' Block Two and I.,ot Nine in Block Four of the Morningview Addition to the City of Beaumont.' That the said above described property is a part of the territory taken within the city limits of the City of Beaumont and that hereto- fore, to wit, in the year 1924, Augusta Street from.south Irving west was closed by order of the Commissioner's Court and was placed on the tax roll as Lot No. Nine on Block Four of Morningview Addition, and that since that date the tax units in which the property was located has been collecting taxes on said property and the street has been closed since that time. Your p(titioner purchased his home from John Gray and it seemingly has been overlooked at previous examinations of -the title to this property of the failure of the Commissioner's Court records to dis- close the order of the Commissioner's Court closing said Augusta Street from south Irving west. Prior to 1924, Augusta Street extended one-half block west of south Irving at which time a petition was presented. to the Commissioner's Court requesting that the street be closed and upon acting favorably upon said request, property was placed upon the tax rolls of both the South Park school district and the county.
