ENTITLED AN ORDINANCE AMENDING ARTICLE 63-24 OF THE CODE
OF THE CITY OF BEAUMONT PROVIDING.FOR THE PURPOSE OF
BONDS AND.INSURANCE REQUIRED AS A PREREQUISITE TO ISSUANCE
OF TAXICAB LICENSE; PROVIDING A SEPARABILITY CLAUSE; PRO-
VIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES
INCONSISTENT OR CONTRARY TBERETO AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BEAUMONT:
That Article 63-24 of the Code of the City of Beaumont be
and the same is hereby amended to read as follows;
Section 1
Article 63-24. Purpose of Bonds and Insurance.- The
above described public liability insurance, surety
bonds and securities shall be for the protection of
the passengers of said vehicles and for the public,
but shall not cover personal injuries -sustained by
the servants, agents or employees of the persons so
f iling the same.
Section 2
Separability and Savings Clause.- If any section, sub-
section, sentence, clause, phrase, or portion of this
ordinance is for any reason held invalid or unconstitu-
tional by any court of competent -jurisdiction, such
section, sub -section, sentence, clause, phrase or portion
shall be deemed a separate, distinct and independent pro-
vision and such holdings shall not affect the validity or
constitutionality of the remaining portion thereof.

All ordinances or parts of ordinances inconsistent or
contrary hereto are hereby expressly repealed:

The fact that the Commissioner of Insurance of the State of
Texas has declared. that the provision of Article 63-24 of
the present Code which provides that suit may be brought
directly against the insurance company providing public
liability insurance on taxicabs is inconsistent with the
policy of the Insurance Department of.the State, and has
refused to accept the endorsement of the present-insuror to
that effect-, and- that -the insuror will cancel -the insurance
if they are not permitted to withdraw such endorsement from
said insurance policy, creates an imperative public emer-
gency for the preservation of the public property -and wel-
fare, necessitating the suspension of the rule requiring
Ordinances to be read on three .several days before their
final passage, wherefore, said rule is hereby suspended and
this Ordinance shall become effective -from and after -its
passage.
PASSED by.the affirmative vote of all members of the City
Commission this the day of , May, A.D., 1947.
