CITY. GOVERNMENT AND PROVIDING A SII\TKING FUND TO MEET THE PAYMENT OF ALL BONDED INDEBTEDNESS OF THE CITY OF BEAUMONT AND THE PAYMENT OF ACCRUING INTEREST -THEREON; AND FOR THE PURPOSE OF PROVIDING FOR THE MAINTENANCE OF THE PUBLIC FREE SCHOOLS AND THE ERECTION, C ON- STRUCTION AND EQUIPMENT OF THE PUBLIC FREE SCHOOL BUILDINGS OF THE BEAUMONT INDEPENDENT SCHOOL DISTRICT AND PROVIDING A SINKING FUND TO MEET THE PAYMENT,OF ALL BONDED INDEBTEDNESS'OF THE BEAUMONT INDEPENDENT SCHOOL DISTRICT AND THE PAY t +NT OF ACCRUING IN`T`EREST THEREON; APPORTIONING THE TAXES TO BE LEVIED TO T HE VARIOUS DEPART- 10ENTS N.A-ED AND FOR THE PURPOSES SET FORTH; PROVIDING FOR THE PAYMENT OF OCCUPATION TAX AND PROVIDING A SAVINGS CLAUSE; AND DECLARING -AN EMERGENCY. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT, TEXAS: Section 1 That there shall be and is hereby levied and shall be assessed and collected for the year 1947,,for'municipal purposes only, an ad valorem tax of One and 67/100 (01.67) Dollars on each One Hundred Dollars worth of property located within the present City limits of the City of Beaumont, made taxable.by law, which said taxes when collected shall be, according to Section 16 of the Charter of the City of Beaumont, apportioned among the funds and departments of the city government of the City.of Beaumont and for the purpose hereinafter set forth as follows, to -wit; For the General Fund $1.12 For the purpose of paying the accruing interest and to provide a sinking fund for the payment of the entire bonded indebtedness of the City of Beaumont for all purposes, except the school bonded indebtedness of the Beaumont In- dependent School District .55 Section 2 That there shall be and is hereby levied and shall be assessed and collected for the year 1947 for the maintenance of the schools and. the erection, construction and equipment of the public free school buildings of the Beaumont Independent School District a tax of 95/100 ($.95) Cents on each One Hundred Dollars worth of property lying and - being situated within the present limits of the Beaumont Independent School District; and there shall be and is hereby levied and shall be assessed and collected for the year 1947, a tax of 18/100 ($.18) Cents on each One Hundred Dollars worth of said property to take care of the interest and sinking fund on the school bonded indebtedness of the City of Beaumont within the present limits of the Beaumont Independent School District. r Section 3 I That there shall b e and is hereby levied and there shall be collected on all occupations and callings on which an occupation tax is levied by the State of Taxas, a sum, equal to one-half of the amount so levied by the State of Texas, on each respective occupation or calling in the City of Beaumont. Section 4 If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconsti- tutional by any court of competent jurisdiction, such section, sub- section, sentence, clause, phrase or portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 5 There being no Ordinm ce in effect levying the taxes for the year 1947, and the taxes for said year will soon become due and payable, an immediate public emergency exists, necessitating the suspension of the rule requiring ordinances to be read on three separate days before passage, wherefore, said rule is here suspended and it is enacted that this ordinance shall be in full force and effect from and after its passage and.publication. AND PROVIDING A.SAVINGS CLAUSE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT, TEXAS® Section 1 - That the tax of fifty-five cents ($.55) on each one hundred dollars valuation of all taxable property w ithin the limits of the City of Beaumont heretofore levied for interest and sinking fund accounts other than bond accounts of the Beaumont Independent School District school bond accounts, and ordered collected by an Ordinance passed by the City.Commission of the City of Beaumont on the 9th day of September, 1947, be and the same is hereby apportioned among the various interest and sinking funds as follows; To the interest and sinking fund of Airport Bonds No. 1, dated July 1, 1929 - Five and five -tenths mills (.0055). To the interest and sinking fund of School Bonds 1922, dated October 1,.1922-- Three Cents and Two Mills ($.0320) To the interest and sinking fund of School House Building and Repair Bonds No. 7, dated May 1, 1924 - One Cent and One Mill ($.0110). c To the interest and sinking fund of SchoolHouse Building Bonds No. 8, dated September 1, 1924 - Two Mills (".0020). To the interest and -sinking fund of School Bonds Series A, dated May 1, 1928 Six Cents and Seven -Mills (.0670-). Section 3 That the City Tax Assessor and Collector is hereby instructed to prorate the said sums so assessed according to the provisions of the Ordinance, and to so present his statement and report to the.Direetor of Finance that said officer may be able to place all collections made under said tax to the credit of the proper fund, and that the same may not be diverted or used for any other purpose. Section 4 If any section, subsection, sentence, clause, phrase or portion of this Ordinance.is for.any reason held invalid or unconstitutional by any court of competent jurisdiction_, such section, subsection, sentence, clause, phrase or portion shall be deemed a separate, distinct and in- dependent provision and such holding shall not affect the validity of the remaining portions -thereof. Section 5 The fact that no apportionment has been made -of the assessments levied to provide for the interest and sinking fund for the bonded indebtedness of the City of Beaumont, creates an imperative public emergency necessitating the suspension of the rule requiring ordinances to be read on three separate meetings before their passage, wherefore, said rule is hereby suspended and this Ordinance shall take effect and be -in force from and after its passage and publication. 1(4 . .
