PARKING METER ZONES IN.THE CITY OF.BEAUMONT; PROVIDING FOR THE.INSTALLA- TION OPERATION AND MAINTENANCE -OF MECHANICAL DEVICES TO REGULATE.PARKING IN -SAID PARKING METER.ZONES; RE- QUIRING -THE DEPOSIT OF COINS FOR THE USE OF PARKING METERS; PROVIDING.FOR THE.ENFORCEMENT HEREOF; PRE- SCRIBING THE -PARKING OF VEHICLES AND.DEFINING SAME AND MAKING IT UNLAWFUL TO USE.THE STREETS OR PORTIONS OF THE. STREETS SO DESIGNATED FOR PARKING EXCEPT THROUGH THE.USE OF PARKING-METERS;-PROVIDING.FOR THE IMPOUNDING OF VEHICLES IN -VIOLATION HEREOF; -PROVIDING -A SCHEDULE OF FINES.-FOR.VIOLATION OF PARKING LIMITS IN PARKING. - METER ZONES; REPEALING, IN PART, ORDINANCES INC.ONSIST- ENT HEREWITH; PROVIDING A PENALTY FOR VIOLATION HEREOF; PROVIDING -FOR THE COLLECTION OF. THE FUNDS. DEPOSITED IN THE METERS. BE IT ORDAINED BY THE CITY COIVMISSION OF THE CITY OF BEAUMONT, TEXAS; Section 1. The word "vehicle" as used herein shall mean any device in, upon or by which any person or property is or may be transported upon a street or highway. The words "park" or "parking" when used herein shall mean the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in load- ing or unloading passengers or merchandise. The word "person" shall mean and include an individual, firm, partnership or corporation. The word "operator" shall mean and include every invidivual who shall operate a vehicle as the owner thereof or as the agent, employee, or permittee of the owner. The words "loading zone", when used herein shall mean a space or section of the curb and adjacent street, set aside for exclusive use of loading or unloading of persons, merchandise, supplies and materials. Section 2. That'the parts of streets in the City of Beaumont, Texas, described in Section 1.7 of this ordinance and established as park- ing meter zones, and in said zones and such other parking meter zones as may be hereafter created by ordinance of the City of Beaumont, the City is authorized to have installed parking meters and is authorized to cause parking meter spaces to be designated in accordance with the provisions of this ordinance. When signs are erected, or curbs are painted giving notice thereof or parking meters are installed, no vehicle shall remain parked for longer than twenty-four (24) minutes at any time be- tween the hours of 8:00 A.M., and 6:00 P.M., of any day except Sundays within the district or upon any of the streets described in Parking Meter Zone No. 3 as established by Section 17 of this ordinance, nor for longer than one (1) hour at any time between the hours of 8:00 A.M., and 6:00 P.M., of any day except Sunday within the district or'�L pon any.of the streets described in Parking Meter Zone No. l as established by Section 17 of this ordinance, nor for longer than two (2) hours at any time between the hours of 8:00 A.M., and 6:00 P.M., of any day except Sundays within the district or upon any streets described in Parking Meter Zone No. 2 as established by Section 1,7 of this ordinance. Section 3, The Chief of Police or such officers or employees of the City of Beaumont as he may select are hereby authorized to install or place parking meters in such parking meter zones hereby created or to be created by other ordinances of the City of Beaumont. Such parking meters shall be placed upon the curb alongside of or next to individual parking places to be designated as hereinafter pro- vided. The Chief of Police or such officers or employees above re- ferred to shall provide for the installation, regulation, control, operation, and use of the parking meters provided for in this ordinance and shall maintain said meters in good workable condi- tion. Each said parking meter shall be so set as to display a signal showing legal parking upon the deposit of a coin of the United States therein for a period of time conforming to the park- ing limit set out in Section 16 of this ordinance or hereafter prescribed by the ordinances of the City of Beaumont for the part -2- ��III 6t e 6-16-161901 of the street upon which said meter is placed; and each meter shall by its device clearly set out and continue operation from the time of depositing such coin until the expiration of the time fixed by said schedules in the ordinance as the parking limit for the part of the street upon which said meter is placed. Each said meter shall also be so arranged that upon the expiration of said parking limit it will indicate by a mechanical operation and the dropping of proper signal that the lawful parking period as fixed by the ordinance of the City of Beaumont has expired. Section 4. When any vehicle shall be parked in any space alongside of or next to which there is located under this ordinance a parking meter, the owner, operator, manager, or driver of said vehicle shall, upon entering /aid marked parking space, immediately deposit either a five- -'cent (5¢) coin or one or more one cent (1X) coins of the United States in the.slot made therefor in the parking meter alongside of or next to said parking space, and the said parking space may then be used by such vehicle during the parking time limit provided by the ordinances of the City of Beaumont for the part of the street in which said parking space is located and for which such deposited coin or coins is payment. If said vehicle shall remain parked in any such parking space beyond the parking limit fixed by the ordinances of the City of Beaumont, for such parking space and for which such deposited coin or coins is payment, the parking meter shall display a sign showing illegal parking and in that event such vehicle shall be considered as parked overtime and beyond the period of time as fixed by the ordinances of the City of Beaumont, and the parking of a vehicle overtime shall be a violation of this ordinance and punished as hereinafter set out. Section 5. It shall be unlawful and an offense for any person to permit a vehicle to remain or be placed in any parking space alongside of or next to which any parking meter is placed while said meter is displaying a signal showing that such vehicle shall have been al- ready parked beyond the period of time fixed by the ordinances of the City of Beaumont for such parking space. The display of a sign showing illegal parking by any parking meter, while a vehicle is -3- parked in a parking space adjoining said parking meter, shall be prima facie evidence that said vehicle has been parked over- time and beyond the period of time fixed by this ordinance. Section 6. It shall be the duty of each police officer to take the license number of any vehicle which is over -parked as provided in this ordinance; the officer shall indicate the State where the license was issued, the time and date of such over -parking, and the make of the vehicle, and shall issue in writing on a form pro- vided by the City a notice to answer to the charge of over -parking within forty-eight (48) hours during the hours and at the place specified in the notice. Section 7. Any vehicle parked in any parking space in any parking meter zone shall be parked with the hood of such vehicle alongside of or next to the parking meter in such parking space and shall be parked within the lines marked on the street for such parking space as provided hereinafter. Section 8. The Chief of Police or such officers or employees of the City as he shall select shall place lines or marks on the curb or on the street about or alongside of each parking meter to designate the parking space for which said meter is to be used and each such vehicle parked alongside of or next to any parking meter shall park within the lines or markings so established. It shall be unlawful and an offense to park any vehicle across any such line or marks or to park said vehicle in such way that the same shall not be wholly within the area so designated by such lines or markings on the street's surface. Section 9. It shall be unlawful and an offense to deposit or cause to be deposited in any parking meter any slug, device or substitute for a five cent (5/) coin or one cent (1/) coin of the United States. Section 10. It shall be unlawful and an offense for any unauthorized per- son to deface, injure, tamper with, open, or wilfully break, destroy, or impair the usefulness of any parking meter installed under this ordinance. -4- Section 11. The United States coins required to be deposited, as provided herein, are hereby charged and levied as police regulation, super- vision and inspection fees to cover the cost of installation, main- tenance, inspection, operation, control and use of parking spaces and parking meters described herein and involved in checking up and regulating the parking of vehicles in the parking meter zones created hereby. Section 12. The Chief of Police or such officers or employees as he may designate are hereby authorized to establish such loading zones as are necessary for the conduct of business, to omit parking meters from such loading zones, and to properly mark such zones. It shall be unlawful for any operator to stand or park a vehicle in a loading zone for the purpose of loading or unloading passengers for a period in excess of two minutes. The use of loading zones for the loading or unloading of merchandise shall be confined to the handling of heavy or bulky materials. All such loading or unloading must, be performed in an expeditious manner and no vehicle may remain in a loading zone for a period of time greater than necessary to expeditiously load or unload the same, nor while the operator thereof is soliciting or engaged otherwise than the loading and unloading of the vehicle, except that a reasonable time shall be allowed for giving or se- curing a delivery receipt. It shall be unlawful for any operator of a vehicle in his possession or under his control to violate any of the provisions of this section. The provisions of this section shall apply only between the hours of 8;00 A.M., and 6;00 P.M., on days other than Sundays. Section 13. A notice of over -parking may be presented to the Traffic Bureau within twenty-four (24) hours and upon payment of the sum of One Dollar ($1.00) the complaint shall be considered as having been satisfied. When an over -parking notice shall not have been presented with- -5- in twenty-four (24) hours to the Traffic Bureau or when a vehicle shall have been impounded, the over -parking complaint shall be treated in the same manner now applying to traffic violations, nor shall the above provided fine apply to parking regulation violations committed in other than parking meter zones opposite which parking meters have been installed.. Section 14. In the event any vehicle shall be found standing or parked in or upon any regularly designated parking meter space, or in or upon any street within the parking meter zone established by this ordinance, in violation -of and contrary to any of the pro- visions of this ordinance, the same shall be a nuisance per se, and may be removed by any police officer and taken to some place designated by the Chief of Police for such purpose, and kept by such officer until application for its redemption shall be made by the owner or his duly authorized agent, who shall be entitled to the possession thereof upon payment to the City of Beaumont of the sum of Two Dollars ($2.00) together with all other costs of removal and storage that may have accrued thereon. In the event the vehicle impounded shall not be redeemed by its owner or his agent within five (5) days, then such vehicle shall be sold for such penalty, charges and costs, -in the manner provided by ordinances of the City of Beaumont for the sale of impounded stock. The remedy and impounding fee and costs, provided for in this ordinance, shall be cumulative of any and all other penalties provided by ordinances of the City. Section 15. It shall be the duty of the Chief of Police, with the approval of the City Manager, to designate some employee or employees of his department to make regular collections of the money deposited in said meters and to promptly deliver said money to the Assessor and Collector of Taxes, or to some person designated by the City Manager, and to take from the Assessor and Collector of Tames, or person so designated, a receipt for said money. In the event the money in the parking meter is contained in a sealed cylinder, then said sealed cylinders containing the -coins shall be delivered by the collector with the seals unbroken to the Assessor and Collector of Taxes. The person making the collections from the meters shall at the time he delivers the money to the assessor and Collector of Taxes, turn in a record by numbers of the meters from which the money was collected. Each person so designated to collect money from meters shall execute_.a fiduciary bond in the sum of One Thousand Dollars ($1000.) payable to the City of Beaumont, conditioned for the faithful per- formance of his duties in collecting and delivering all such moneys, which bond shall be executed by a corporate surety which has been duly authorized under the laws of Texas to execute such bonds. The premium for such bond shall be paid by the City. Section 16. Any person, firm or corporation who shall violate any of the provisions of this ordinance shall, upon conviction, be deemed guilty of an offense and fined not to exceed the sum of Two Hundred Dollars ($200.00). Any person who shall aid, abet or assist -in the violation of any of the provisions of this ordinance shall -be guilty 04 d- t7` of an offense and shall be fined not to exceed Two Hundred Dollars ($200.00). Any person, firm or corporation who shall violate any of the provisions of this ordinance shall be guilty of a misdemeanor and, upon conviction,.shall be fined not to exceed the sum of Two Hundred Dollars ($200.00). Section 19. It shall hereafter be unlawful for any operator in charge or control of any vehicle which has an over-all length of nine- teen (19) feet or more, or for any vehicle having a trailer attach- ed thereto, to park the same in a parking meter space in a parking meter zone established by this ordinance. Section 20. It shall be unlawful for any operator to stop or park any vehicle in his possession or under his control on the south side of Laurel Street between Orleans and Park Streets except for the purpose of loading or unloading passengers, and if for that pur- pose, not to exceed two (2) minutes. Section 21. All ordinances or parts of ordinances of the City of Beau - wont inconsistent with any of the terms and provisions of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistencies and in all other respects this ordinance shall be cumulative of other ordi- nances regulating and governing the subject .matter covered by this ordinance. Section 22. If any section or provision or part thereof in this ordinance shall be adjudged invalid or unconstitutional by any court of competent jurisdiction, such adjudication shall not affect the v alidity.of this ordinance as a whole or any section or provision thereof not adjudged invalid or unconstitutional.
