AN ORDINANCE _,4 i 3 ENTITLED AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF BEAUMONT ON THE 21st DAY OF JUNE, 1947, TO DETERMINE WHETHER OR NOT THE CITY COMMISSION OF THE CITY OF BEAUMONT SHALL BE AUTHORIZED TO ISSUE SERIAL BONDS OF SAID CITY FOR THE PURPOSES AND IN THE AMOUNTS AS FOLLOWS: WATER- WORKS REVENUE BONDS IN THE AMOUNT OF $2,000,000 AND PLEDGING THE REVENUE OF THE CITY"S WATERWORKS SYSTEM TO THE PAYMENT THEREOF; SERIAL BONDS OF THE CITY OF BEAUMONT IN THE AMOUNY OF $2,000,000 FOR THE PURPOSE OF IMPROVING, EXTENDING, AND REPAIRING THE STREETS AND HIGHWAYS OF THE CITY OF BEAUMONT AND THE LEVYING OF A TAX IN PAYMENT THEREOF; SERIAL BONDS OF THE CITY OF BEAUMONT IN THE AMOUNT OF $1,000,000 FOR THE PURPOSE OF IMPROVING, EXTEND- ING, AND REPAIRING THE STORM SEWERS OF THE CITY OF BEAUMONT AND THE LEVY- ING OF A TAX IN PAYMENT THEREOF; SERIAL BONDS OF THE CITY OF BEAUMONT IN THE AMOUNT OF $500,000 FOR THE PURPOSE OF IMPROVING, EXTENDING, AND REPAIR- ING THE SEWERAGE SYSTEM OF THE CITY OF BEAUM NT AND THE LEVYING OF A TAX IN PAYMENT THEREOF; SERIAL BONDS OF THE CI Y OF BEAUMONT IN THE AMOUNT OF $325,000 FOR THE PURPOSE OF BUILDING, IMPROVING, REPAIRING, AND EQUIPPING FIRE STATIOI91S, AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLIANCES, AND ACQUIRING NECESSARY SITES THEREFOR, AND THE LEVYING OF A TAX IN PAYMENT THEREOF; SERIAL BONDS OF THE CITY OF BEAUMONT IN THE AMOUNT OF x"275,000 FOR THE PURPOSE OF BUILDING, IMPROVING, REPAIRING, AND EQUIPPING POLICE STATIONS, AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLIANCES, AND ACQUIRING NECESSARY SITES THEREFOR, AND THE LEVYING OF A TAX.IN PAYMENT THEREOF; SERIAL BONDS OF THE CITY OF BEAUMONT IN THE AMOUNT OF x75,000 FOR THE PURPOSE OF ENLARGING, IMPROVING, REPAIRING AND EQUIPPING THE PUBLIC. LIBRARY BUILDING, AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLI- ANCES THEREFOR, AND THE LEVYING OF A TAX IN PAYMENT THEREOF; MAKING CERTAIN FINDINGS AS TO THE ADVISABILITY AND NECESSITY OF ISSUING SAID BONDS AND MAK- ING TIE IMPROVEMENTS THEREIN CONTEMPLATED; NAMING THE TIME AND PLACE OF HOLDING SAID ELECTION AND APPOINTING OFFICERS THEREOF; PROVIDING THE MANNER OF HOLDING SAID ELECTION AND GIVING NOTICE THEREOF; AND DECLARING AN EMER- GENCY. WHEREAS, the City Commission of the City of Beaumont has found and determined, and hereby finds and determines, that in the public interest it is advisable, expedient, and necessary to issue serial bonds of said City to provide funds necessary for the public improvements herein mentioned, es- pecially in view of the fact that the City has recently extended its limits so as to include within said limits approximately twenty additional square miles of territory, in which additional territory not heretofore included within the limits of the City of Beaumont, there are many inhabitants and--"-- many nd�-_many residential and business buildings and property, necessitating public services and improvements mentioned in this ordinance, and the public im- provements existing within the -original limits of the City of Beaumont, as well as its waterworks system,:will of necessity have to be improved, re- paired, and extended to meet the necessities not only of the properties and inhabitants residing within the original corporate limits of the City of Beaumont, but as well as those residing within the limits of the City -of Beaumont as extended; and such improvements, extensions, and repairs are necessary to protect the public property, the public health, the public safety, and promote the public welfare of the City of Beaumont and its inhabitants; and that the improvements, extensions and repairs of the City waterworks system, the streets and highways, the sewerage system, the storm sewers, the public library, the fire stations, and the police station, should be made and completed at the earliest practicable time, and that the existing necessity for such is urgent and imperative; and, WHEREAS, the City Commission of the City of Beaumont finds and determines that under the terms of the Charter of the City of Beaumont, Section 11 thereof, the City of Beaumont has the exclusive right to erect, own, maintain, and operate waterworks, to make additions thereto and im- provements and extensions thereof within and outside the city limits, and to acquire the necessary rights-of-way for the use of said City and its inhabitants, and to regulate the same, prescribe rates for water furnished, and to make such rules and regulations with reference thereto as the City may deem expedient; and to do anything whatsoever necessary to operate and maintain said works, and to compel the owners of property and agents of said owners to pay all charges for water furnished upon such property; and, WHEREAS, under Section 11, Paragraph (2), of the Charter of the City of Beaumont, it is provided that, "All receipts and revenues derived from the operation of the waterworks shall constitute a separate and sacred fund, which shall never be diverted or drawn upon directly or indirectly, or through any means or under any guise or disguise whatsoever, for any other purpose than the extension, improvement, operation, maintenance, re- pair and betterment of the waterworks supply; but the City Commission may appropriate or pledge such receipts and revenues for the purpose of ex- tending, improving, operating, maintaining and bettering the water plant and mains and water supply, also for the purpose of discharging or retiring the indebtedness of the city that may be incurred or accrued for water- works purposes";and, WHEREAS, it is provided under Article 1111, et seq., of the Revised Civil Statutes of the State of Texas, and amendments thereto, that all cities and towns in the State of Texas, including the City of Beaumont, shall have power to mortgage and encumber the income of the water systems, to evidence the obligations thereof by the issuance of bonds, notes, or warrants, to secure the payment of funds for the purpose of improving, en- -3 larging, extending, or repairing said system, and that no such obligation of any such system shall ever be a debt of any such city, but solely a charge upon the properties and revenues of the system so encumbered, and shall never be reckoned in determining the power of the City to issue bonds for any purpose authorized by law; and, WIEREAS, the City Commission of the City of Beaumont now finds and determines that there is present urgent public need and necessity of improv- ing, extending, and repairing the waterworks system of the City -of Beaumont in order to render to the inhabitants thereof the same character of service as heretofore rendered by said waterworks system to the inhabitants thereof, and that the amount of money required at this time for the purpose of making the necessary extensions, improvements, and repairs of such waterworks system will greatly exceed the current income of said waterworks system, and it has become necessary to borrow money and to issue bonds and to pledge and encumber the future income and revenues of the waterworks system for the pay- ment thereof, without attempting to encumber the properties of the water- works system, and without incurring any debt of the City of Beaumont, and without providing for the levy of any property tax to pay the same; and, WHEREAS, the City Commission of the City of Beaumont finds and de- termines that the City of Beaumont has power and authority, under Section 18, of the Charter of the City of Beaumont, by a vote of the majority of the qualified tax -paying voters voting thereon, to issue bonds for the pur- pose of improving, extending, and repairing the streets and highways of the City of Beaumont, and to build, repair, and purchase, or otherwise acquire sewerage systems, storm severs, police stations, fire stations, libraries, and such other appurtenances and appliances as may be necessary and _proper to carry out any of the purposes above stated, and for any other public im- provements which the City may deem expedient, necessary, and beneficial to the advancement of the City; and, T s MREAS, the City Commission of the City of Beaumont finds and de- termines that it is expedient, beneficial, and necessary to the advance- ment of the City to construct the improvements mentioned in,this ordinance, and to improve, extend, and repair the streets and highways, the sewerage system, and the storm sewers of the City, and to build, improve, repair, and equip fire stations, and purchase necessary appurtenances, appliances and sites therefor; and to build, improv®, repair, and equip police stations and purchase necessary appurtenances, appliances and sites therefor; and enlarge, improve, repair, and equip the public library and to purchase necessary appurtenances and appliances therefor; now, therefore, BE IT ORDAINED BY THE CITY COIVlMiSSION OF TBE CITY OF BEAUMONT s Section 1 That an election be held in the City of Beaumont, Texas, on the 21st day of June, 1917, which is not less than fifteen nor more than thirty days from the date of the passage of this ordinance, at which election the following propositions shall be submitted separately to the qualified electors of said City who own taxable property in said City and who have duly render- ed the same for taxation, and all electors shall vote in the election pre- cinct of their residence. Section 2 The first proposition to be submitted at said election shall be the following; PROPOSITION NO. 1 SHALL the City Commission of the City of Beaumont, Texas, be authorized to issue serial bonds of said City, being revenue bonds, in the amount of $2,000,000, for the purpose of constructing improvements, enlargements, ex- tensions and repairs to the City's waterworks system, said bonds maturing i serially in suchl'installments as may be fixed by the City Commission over a 1. period of years, not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed four per cent (1V) per annum, to be issued in accordance with and secured in the manner provided in Article 1.111 to 1118, both inclusive, of the Revised Civil Statutes of Texas, 1925, as amended, each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obligation out of funds raised or to be raised by taxation, secured by an exclusive first lien on and pledge of the revenues and income of the City's waterworks system after deduction of reasonable operation and maintenance expenses. Section 2a In the event said waterworks revenue bonds are authorized, no such obligation of such waterworks system shall ever be a debt of the City of Beaumont, but solely a charge upon the revenues and income of the waterworks system, and shall never be reckoned in determining the power of the City of - 4 - Beaumont to issue any bonds for any purpose authorized by law; and said bonds shall each have printed thereon the followings "The holder hereof shall never have the right to demand payment of this obligation -out of any funds raised or to be raised by taxation". Section 3 The second proposition to be submitted at said election shall be the following: PROPOSITION N0, 2 SHALL the City Commission of the City of Beaumont, Texas, be authorized to issue serial bonds of said City, in the amount of y�2,000,000, for the purpose of improving, extending, and repairing the streets and high- ways of the City of Beaumont, said bonds maturing serially in such install- ments as may be fixed by the City Commission, over a period of years, not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed four per cent (L�1) per annum, and shall there be annually levied, assessed, and collected, while said bonds or any of them are outstanding, an annual ad valorem tax on all taxable property in the City of Beaumont sufficient to pay the interest on all of said bonds and create a sinking fund sufficient to retire the same at maturityo Section 4 The third proposition to be submitted at said election shall be the following; PROPOSITION N0. 3 SHALL the City Commission of the City of Beaumont, Texas, be author- ized to issue serial bonds of said City, in the amount of $1,000,000, for the purpose of improving, extending, and repairing the storm sewers of the City of Beaumont, said bonds maturing serially in such installments as may be fixed by the City Commission over a period of years, not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed four per cent (LV.) per annum, and shall there be annually levied, assessed, and collected, while said bonds or any of them are outstanding, an annual ad valorem tax on all taxable property in the City of Beaumont sufficient to pay the interest on all of said bonds and create a sinking fund sufficient to retire the same at maturity. - 5 - Section 5 The fourth proposition to be submitted at said election shall be the following: PROPOSITION N0. 4 SHALL the City Commission of the City of Beaumont, Texas, be author- ized to issue serial bonds of said City, in.the amount of $500,000, for the purpose of improving, extending, and repairing the sewerage system of the City of Beaumont, said bonds maturing serially in such installments as may be fixed by the City Commission, over'a period of years, not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed four per cent (Wo) per annum, and shall there be annually levied, assessed, and collected, while said bonds or any of them are outstanding, an annual ad valorem tax on all taxable property in the City of Beaumont sufficient to pay the interest on all of said bonds and create a sinking fund sufficient to retire the same at maturityo Section 6 J, The fifth proposition to be submitted at said election shall be the following: PROPOSITION NO. 5 SHALL the City Commission of the City of Beaumont, Texas, be author ized to issue serial bonds of said City, in the amount of $325,000, for the purpose of building, improving, repairing, and equipping fire stations, and the purchase of necessary appurtenances and appliances, and acquiring neces- sary sites therefor, said bonds maturing serially in such installments as may be fixed by the City Commission, over a period of years, not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed four per cent (L;) per annum, and shall there be annually levied, assessed, and collected, while said bonds or any of them are outstanding, an annual ad valorem tax on all taxable property in the City of Beaumont sufficient to pay the interest on all of said bonds and create a sinking fund sufficient to retire the same at maturity, Section 7 The sixth proposition to be submitted at said election shall be the followings - 6 - HVj PROPOSITION NOo 6 SHALL the City Commission of the City of Beaumont, Texas, be author- ized to issue serial bonds of said City in the amount of $275,000, for the purpose of building, improving, repairing, and equipping police stations, and the purchase of necessary appurtenances and appliances, and acquiring necessary sites therefor, said bonds maturing serially, in such installments as may be fixed by the City Commission, over a period of years, not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed four per cent (4j) per annum, and shall there be annually levied, assessed, and collected, while said bonds or any of them are outstanding, an annual ad valorem tax on all taxable property in the City of Beaumont sufficient to pay the interest on all of said bonds and create a sinking fund sufficient to retire the same at maturitye Section 8 The seventh proposition to be submitted at said election shall be the following: PROPOSITION NO. 7 SHALL the City Commission of the City of Beaumont, Texas, be author- ized to issue serial bonds of said City, in the amount of $75,000, for the purpose of enlarging, improving, repairing, and equipping the public library building, and the purchase of necessary appurtenances and appliances therefor, said bonds maturing serially, in such installments as may be fixed by the City Commission, over a period of years, not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed four per cent (W.) per annum, and shall there be annually levied, assessed, and collected, while said bonds or any of them are outstanding, an annual ad valorem tax on all taxable property in the City of Beaumont sufficient to pay the interest on all of said bonds and.create a sinking fund sufficient to retire the same at maturitym Section g The question as to whether or not the City Commission of the City of Beaumont shall be authorized to issue said serial bonds, or any of them, shall be submitted separately on the ballot as to each of the above seven proposi- tions, and the ballots to be used in said election shall be printed and fur- nished by the City of Beaumont, as provided by law, and each ballot shall have printed thereon the following: - and that the improvements; extensior_s and repairs of the City -waterworks system, the streets and highways, the sewerage system, the storm sewers, the public library, the fire stations, and the police station, should be spade and completed at the earliest practicable time, and that the existing necessity- for such is urgent and imperative; SEVENTH PROPOSITION FOR TBE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF-BEAUMONT FOR THE PURPOSE OF ENLARGING, IMPROVING,.REPAIRING, AND EQUIPPING THE PUBLIC LIBRARY BUILDING, AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLIANCES THEREFOR, AND THE LEVYING OF A TAX IN PAYMENT THEREOF. AGAINST THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE PURPOSE OF ENLARGING, IMPROVING, REPAIR- ING, AND EQUIPPING THE PUBLIC LIBRARY BUILDING, AND THE PURCHASE OF NECESSARY APPURTENANCES AND APPLIANCES THEREFOR, AND THE LEVYING OF A TAX IN PAYMENT THEREOF. Section 10 Concerning each proposition, each voter shall mark out with black ink, or black pencil, one of the above expressions on the ballot, thus leaving the other as indicating his vote on such proposition. Section 11 Said election shall be held in each of the legal voting precincts within the City of Beaumont, and also in each fractional legal voting precinct in saidCity where only a portion of such precinct is within the City, and the following places the respectively are hereby designated palling places in the voting precincts of said City, and the following - named persons are hereby appointed officers of said elections: (1) In Voting Precinct No. 1, said election shall be held at the French High School Building, and T. B. Hensley is hereby appointed presid- ing judge to hold said election, with authority to appoint his assistants and clerks. (2) In Voting Precinct No. 2, said election shall be held at the Junker School Building, and Mrs. J. E. Ray is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (3) In Voting Precinct No. 3, said election shall be held at the Gladys Street Fire Station, and Mrs. L. E. Dovnns is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (4) In Voting Precinct No. 4, said election shall be held at the Averill School Building, and W. L. Seibert is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and ®9- clerks. (5) In Voting Precinct No. 5, said election shall be held at the Beaumont High School Building, and Spencer Blain is hereby appointed pre- siding judge to hold said election, with authority to appoint his assist- ants and clerks. (6) In Voting Precinct No. 6, said election shall be held at the Dick Dowling Junior High School Building, and Mrs. E. W. Doty is hereby appointed presiding judge to hold said election, with authority to appoint her assistants and clerks. (7) In Voting Precinct No. 7, said election shall be held at the Central Fire Station, and Mrs. G. K. A. Godwin is hereby appointed presid- ing judge to hold said election, with authority to appoint his assistants and clerks. Garrison is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. Withers is hereby appointed presiding Judge to hold said election, with authority to appoint his assistants and clerks. (17) In Voting Precinct No. 17, said election shall be held at the Hebert Colored School Building, and A. L. Price is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (18) In fractional part of Voting Precinct No. 18, lying within the City of Beaumont, Texas, said election shall be held at the Edwards School Building, and J. M. Brinson is hereby appointed presiding judge to hold said election, with authority to appoint his assistsnts and clerks® (19) In fractional part of Voting Precinct No. 19, lying within the City of Beaumont, Texas, said election shall be held at 4905 Voth Road, and Frank Allen is hereby appointed presiding judge to hold said election, with authority to appoint his assistants and clerks. (Li2) In fractional part of Voting Precinct No. L2, lying within the City of Beaumont, Texas, said eledtion shall be held at the Lamar College Administration Building, and G. W. Glezen is hereby appointed pre- siding judge to hold said election, with authority to appoint his assist- ants and clerkso (43) In fractional part of Voting Precinct No. 43, lying within the City of Beaumont, Texas, said election shall be held at the Triangle Grocery, Fannett Road and Donahue Streets, and Roy Saleme is hereby ap- pointed presiding judge to hold said election, with authority to appoint his assistants and clerkso �< l days on which the same was published, shall be filed in the office of the City Clerk and shall be conclusive evidence of the publication of said notice. Section 14 The fact that the City of Beaumont has recently extended its limits so as to include within said limits approximately twenty-one additional square miles of territory, in which additional territory not heretofore included within the limits of the City of Beaumont there are many inhabitants and many residential and business buildings and property, necessitating public services and improvements mentioned in this ordinance, and the public improvements existing within the original limits of the City of Beaumont, as well as its waterworks system, are inadequate to meet the necessities not only of the properties and inhabitants residing within the original co porate limits of the City of Beaumont, but as well as those residing within the limits of the City of Beaumont as extended, and such improvements, extensions, and repairs are necessary to protect the public property, public health, public safety, and promote the public welfare of the City ofZ-Beaumont and its inhabitants; and the fact that the streets and highways of the City of Beaumont are badly in need of improvement, extending, repairing, opening and widening, so as to facilitate the moving of traffic in the City, which is congested on present improvedstreets to such an extent as to be dangerous to life and limb; and the sewerage system and the storm sewers of the City of Beaumont -are now wholly inadequate for the demands placed upon them, causing congestion of the sewer mains and resultant stagnation which is in- curious to the health and lives of the people of the City of Beaumont; and it is necessary to construct additional fire stations in order to protect the people of the City of Beaumont from fire hazards, the present system being wholly inadequate to meet the needs of the inhabitants of the City, and mazy inhabitants of the City are without water for domestic use, and many sections of the City are without water mains and plugs sufficient to fight fires which may break out in such sections and destroy the property of the citizens; and it is necessary to construct additional police stations and equipment in order to protect the people of Beaumont and to protect the property of its inhabitants; and the public library of the City of Beaumont is in need of repairs, the same being in such condition that it may be dangerous to life and limb; and the fact that the revenues of the City of Beaumont that - 13 - may be raised by taxation, or any other means available to the City, are wholly inadequate to make the improvements, extensions, and repairs mentioned in this ordinance; each and all of which conditions create an imperative public emergency, necessitating the suspension c^ the_rule requiring ordinances to be'read on three separate days before their..passage, and said rule is here- by suspended, and this ordinance shall take effect from and after the date of its passage.
