HomeMy WebLinkAboutORD 50-Rbe a �1 1 y�, AN ORDINANCE ENTITLED AN ORDINANCE ORDERING A SPECIAL ELECTION TO.BE HELD IN THE CITY OF BEAUMONT TO DETERMINE WHETHER OR NOTA "PARKING METER" ORDINANCE PASSED BY THE CITY COMMISSION SHALL BE REPEALED; SETTING THE -DATE THEREOF; PROVIDING THE PLACES AT WHICH SAID ELECTION SHALL BE HELD AND DESIGNATING THE PLACES.WHERE THE VOTERS SHALL VOTE; APPOINTING JUDGES TO PRESIDE OVER SAID ELECTION; PROVIDING THC MANNER OF HOLDING SAID ELECTION;.PROVIDING THE ISSUES TO BE SUBMITTED AND -FORM OF BALLOT; PROVIDING FOR NOTICE_ OF SAID_ELECTION. WHEREAS, on the 10th day of June, A.'D., 1947, the City Commission of the.City of Beaumont passed an ordinance entitled; "AN ORDINANCE RELATING TO TRAFFIC AND REGULATING THE USE.OF PUBLIC STREETS AND HIGHWAYS OF THE CITY OF BEAUMONT; CREATING AND DEFINING PARKING.METER. ZONES IN THE CITY OF BEAUMONT; PROVIDING FOR THE INSTALLATION, OPERATION AND MAINTENANCE OF MECHANICAL DEVICES TO REGULATE.PARKING IN.SAID PARKING METER ZONES; REQUIRING THE DEPOSIT OF COINS FOR THE USE OF PARKING METERS; PROVIDING FOR THE ENFORCEMENT HEREOF, PRESCRIBING THE PARKING OF VEHICLES AND.DE- FINING SAME AND MAKING IT UNLAWFUL TO USE THE STREETS OR PORTIONS OF THE STREETS SO DESIGNATED FOR PARKING EXCEPT THROUGH THE USE OF PARKING INTERS; -PROVIDING FOR THE IMPOUNDING OF VEHICLES IN VIOLATION HEREOF; PROVIDING A SCHEDULE OF FINES FOR VIOLATION OF PARK- ING LIMITS IN PARKING METER ZONES; REPEALING, IN PART, ORDINANCES INCONSISTENT HEREWITH; PROVIDING A PENALTY FOR VIOLATION HEREOF; PROVIDING FOR THE COLLECTION -OF THE FUNDS, DEPOSITED IN THE INTERS" and, WHEREAS, on the 10th day of June, A. D., 1947, the Council of the City of Beaumont approved by a majority vote said ordinance; and, WHEREAS, within thirty (30) days after the passage of the r 9 ordinance and the approval of same by the Council, twenty-five (25%) percent of the number of qualified voters voting at the last pre- ceding regular municipal election filed with the City Clerk a peti- 12 tion requesting that the said ordinance be submitted to a vote of the electors of the City of Beaumont for their approval or rejection; and, - WHEREAS, it is the opinion of the City Commission of the City of Beaumont that the petitioners have complied with the provisions of the Charter of the City of Beaumont and that, therefore, the - Commission should provide for submitting the question to the elec- tors at a special election within the time specified by the Charter of the City of Beaumont, which said Charter provision provides that an election shall be held not more than six (6) months nor less than thirty (30) days after the receipt by the Commission of the Clerkis certificate on the petitions filed with her; and WHEREAS, the Charter of the City of Beaumont further provides that if the ordinanc.e be not approved by a majority of those vot- ing thereon it shall be deemed repealed, otherwise it shall re- main in force and effect. NOW, THEREFORE, BE IT -ORDAINED BY THE CITY COMMISSION OF - THE CITY OF BEAUDIONT m 1® That an election be held in the City of Beaumont on the 31st day of July, A® D., 1947, at which election there shall be sub- mitted to the qualified voters of the City of Beaumont the follow- ing proposition; Shall the ordinance passed by the City Commission of the City of Beaumont on the 10th day of June, A. D., 1947, providing for the installation, opera- tion and maintenance of parking meters in the City of Beaumont be approved? 2. That said election shall be held in the City of Beaumont at the following places, to -wit: In the First Ward at; French High School Building Junker School Building Averill School Building Edwards 'School Building Central Fire Station In the Second Ward at: Beaumont High School Building (Senior) City Hall In the Third Ward at: David Crockett Junior High School Building Sabine Pass Fire Station South Park Elementary School Building Giles School Building Hebert School Building That all voters residing in County Voting Precinct No.' 1 shall vote in the French High School Building; that all voters residing in County Voting Precinct No. 2 shall vote at the Junker School Build- ing; that all voters residing in County Voting Precincts Nos. 3, 6 -2- ., and 7 shall vote in the Central Fire Station building; that all voters residing in County Voting Precinct No. 4 and all that portion of County Voting Precinct No. 47 lying within the boundaries of the City of Beaumont shall vote at the Averill School Building; that all voters residing in County Voting Precinct No. 5 and that part of County Voting Precinct No. 50 lying within the boundaries of the City of Beaumont shall vote at the Beaumont High School Building; that all voters residing in County Voting Precincts Nos. 8 and 9 shall vote at the City Hall; that all voters residing in County Voting Precincts Nos. 10, 13 and 14 shall vote at Sabine Pass Fire Station; that all voters residing in County Voting Pre- cincts Nos. 11 and 12 shall vote at David Crockett Junior High School Building; that all voters residing in County Voting Pre- cinct No. 15 and that portion of County Voting Precinct No. 42 lying within the boundaries of the City of Beaumont shall vote at South Park Elementary School Building; that all voters residing in County Voting Precinct No. 16 and that portion of County Voting Pre- cinct No. 43 lying within the boundaries of the City of Beaumont shall vote at Giles School Building; that all voters residing in County Voting Precinct No. 17 shall vote at the Hebert School Build- ing; that all voters residing in that portion of County Voting Pre- cincts Nos. 18 and 19 lying within the boundaries of the City of Beaumont shall vote at the Edwards School Building. 3. The following named persons are appointed presiding -judges for their respective voting boxes in said wards with the authority, to select their own clerks; At the French High School Building, Mr. T. B. Hensley At the Junker School Building, Mrs. J. E. Ray At the Averill School Building, Mr. L. L. Rutt At the Edwards School Building, Mr. J. M. Brinson At the Central Fire Station, Mrs. G. K. Rafferty At the Beaumont High School Building, Mr. H. V. Scanlon At the City Hall, Mrs. Pat Burrell At the David Crockett Junior High School Building, Mr. F. L. Fisher At the Sabine Pass Fire Station, Mrs. B. P. Derr -3- At the South Park Elementary School Building, Mr. E. E. Garrison At the Giles School Building, Mrs. Vernon Bazine At the Hebert School Building, Mr. A. L. Price 4. That there shall be printed on the ballots to be used in said election the following; AN ORDINANCE RELATING TO TRAFFIC AND REGULATING THE USE OF PUBLIC STREETS AND HIGHWAYS OF THE.CITY OF BEAUMONT; CREATING AND DEFINING PARKING METER ZONES IN THE CITY OF BEAUMONT; PROVIDING FOR THE INSTALLA- TION, OPERATION AND MAINTENANCE OF MECHANICAL DEVICES TO REGULATE PARKING. All voters desiring to vote for the approval of the ordinance providing for the installation, operation and maintenance of park- ing meters in the City of Beaumont shall run a line through and across the paragraph on said ballot containing the words "Against the Ordinance"; and all voters desiring to repeal said ordinance shall run.a line through and across the paragraph on said ballot containing the words "For the Ordinance." 6. Should, at said election_, a majority of the qualified voters voting at the election vote against the said ordinance, then the said ordinance shall be deemed to have been repealed, otherwise, it shall remain in force. 7. That a copy of this ordinance signed by the Mayor of the City of Beaumont and attested by the City Clerk of the City of Beaumont shall serve as a proper and sufficient notice of said election, and the Mayor is hereby directed to cause a copy of this ordinance, -4- signed by himself and attested by the City Clerk., to be posted at each of the places herein designated for holding said elec- tion at least thirty (30) days prior to the date of holding said election in the manner required by law.
