WHEREAS, the City of Beaumont is the owner of a tract of land in the David Brown Survey, Jefferson County, Texas, acquired by general warranty deed from the Trustees of the Caswell Trust dated the 19th day of September, 1936, recorded in Vol. 4233 Page 227, more .fully described as follows; All that certain tract, piece or parcel of land lying and being situated in Jefferson County, Texas, a part of the David Brown survey, and des- cribed by metes and bounds as follows, to -wit; Beginning at the waterls edge of the Neches River, where the W. Boundary line of an easement or right of way 60 ft. wide, which was decreed and awarded to the defendants, Anna E. Caswell, et alp in the decree of the District Court of Jefferson County, Texas, on Nov. 22, , 1886, in the consolidated cases Nos. 876 and 895, in said Court, styled respectively Amanda Cartwright vs. John C. Craig, and Amanda Cartwright vs. Anna E. Caswell, et al, a certified copy of said decree being recorded in Vol. 1, on Pages 6 to 10, of the Deed Records of Jefferson County, Texas, meets the waters edge of -the Neches River; thence S. along the W. boundary line of the 60 ft. ease- ment above referred to, 3724 ft. for corner; thence S. 89 deg. C. Caswell 971.06 acre tract in the David Brown League, more particularly described as follows; .- Beginning - Beginning at a point where the east boundary line of Carroll Avenue intersects the north right- of-way line of the Kansas City Southern Railroad Spur tra_c_k; thence southeasterly with the north right-of-way line of the I%ansas City Southern Railroad spur track, which is on a 5 degree curve to the right, 200.91 to a corner in the north right-of-way line of said spur track; which corner has an off -set of 19.3t from a line 2001 long drawn through the point of beginning and at right angles to the east line of Carroll Avenue; thence north 8 deg. 10 min. east 615.71 more or less, to the Neches River; thence westerly and along the meanders of the Neches River to the east line of Carroll Avenue; thence south 1 deg. 2 rain. west and along the east line of Carroll Avenue 1281 more or less, to a corner; thence south 0 deg. 10 min. west and along the east line of Carroll Avenue 466.61 to the place of beginning; WHEREAS, by ordinance dated the 7th day of January, 1947, duly passed by the City Commission of the City of Beaumont, said tract has been formally abandoned as a site for wharves and docks for the City of Beaumont " and as a site for improve- ments and equipment for such use; and, WHEREAS, the hereinafter described tracts are a part of said 94.5 acre tract sometimes known as.the Caswell Tract; and, WHEREAS .9 the Halliburton Oil Well Cementing Company, a corporation, has offered to purchase the hereinafter des- cribed property for the sum of Forty-two Thousand Four'Hundred One (yp42,401.00) Dollars, which is in accord with the appraised value as found by the Beaumont Real -Estate Board; and, WHEREAS, the City Commission of the City of Beaumont is of the opinion that the said sum is a full, fair and reasonable value of said property; and-, WHEREAS, the City Commission of the City of Beaumont is of the opinion that it is to the best interest of the City of Beaumont that the hereinafter described tracts of land be' sold to the Halliburton Oil Well Cementing Company for the sum of Forty-two Thousand Four Hundred One (442,401.00) Dollars; and, -2- WHEREAS, the City Commission has reached an agree- ment with the said Company, -a corporation, incorporated in Delaware, with its principal office in Duncan, Oklahoma, and 4 having a permit to do business in Texas, for the sale and conveyance of the hereinafter described tracts to such cor- poration upon the terms and conditions hereinafter set forth; NOVI, THEREFORE, BE IT ORDAINED by the City Commission of the City of Beaumont that the hereinafter described property be sold to Halliburton Oil Well Cementing Company for Forty- two Thousand Four Hundred One (542,401.00) Dollars, and that the Mayor and City Clerk be, and they are hereby authorized and directed to execute to Halliburton Oil Well Cementing Company., -.a corporation, with its principal office in Duncan, Oklahoma, a general warranty deed for the land described and on the conditions and provisions here specified, to -wit: THE STATE OF TEXAS ) COUNTY OF JEFFERSON ) IMOW ALL, TEEN BY_ THESE PRESENTS That the City of Beaumont, acting herein by and through its Mayor and City Clerk, hereunto duly author- ized, of the County of Jefferson, State of Texas, for and in consideration of the sum of Forty-two Thousand Four Hundred One 042,401.00) Dollars cash to it in hand paid by Halliburton Oil Well Cementing Company, a private corporation, have GRANTED, SOLD and CONVEYED, and by these presents do GRANTI. SELL and CONVEY., unto the said Halliburton Gil Well Cementing Company, a private corporation, having its principal office at Duncan, Oklahoma, all those certain tracts and parcels of land situated in the County of Jefferson, State of Texas, a part of the David Brown Survey and a part of that certain tract conveyed by the Trustees of the Caswell Trust to the City of Beaumont by deed dated September 19, 1936, recorded Vol. 423, Page 227, deed records of Jefferson_ County, Texas, which deed is here referred to for a more particular description, and being more specifically described as follows, to -wit; TRACT 1; From a point where the center line of Buford.Street as established in the Neches River Park Addition to the City of Beaumont, projected eastward, intersects with the east line of the said tract conveyed by the Trustees of the Caswell Trust to the City of Beau -cont by deed dated Septem- ber 19, 1936, recorded in Volume 423, Page 227, Deed Records, Jefferson County, Texas, and herein- after sometimes referred to as the Caswell Tract, said point being south eighty-nine (89) degrees forty (40) minutes forty (40) seconds east eleven hundred seventy-nine and forty-eight one hundredths -(1179.48), feet from a monument marking the inter- -3- section of the center lines of Carroll and Buford Streets, and two thousand sig; hundred and sixty- nine one hundredths (2600.69) feet north of the southeast corner of the said Caswell Tract; thence due north thirty (30) feet along the east line of the said Caswell Tract to a concrete monument in the north line of -Buford Street, as extended, for the beginning corner of the tract herein described; THENCE along the first course due north one thousand sixty-eight and thirty-one one hundredths (1068.31) feet along the east line of the said Caswell Tract to an iron pipe on the water's edge of the south bank of the Neches River, said iron pipe being one hundred (100) feet north of a con- crete reference monument in the last described line (said line being the west boundary line of the sixty (60) foot strip awarded to the defendants, Anna E. Caswell, et al, in the decree of the District Court, Jefferson County, Texas, on november 22,'1886., in the consolidated cases Nos. 876 and 895, in said court, styled respectively Amanda Cartwright vs. John_ C. Craig, and Amanda Cartwright vs. Anna E. Caswell, et al, a certified copy of which decree is recorded in Volume 1, pages 6 to 10; of the Deed Records of Jefferson County, Texas); THENCE along the meanders of the water's edge of'the south bank of the Neches River, the follow- ing three courses and distances; South sixty-six (66) degrees seven (07) minutes forty (40) seconds west seventy-four and forty-three one hundredths (74.43) feet to an iron pipe; thence south eighty- six (86) degrees seven (07) minutes forty (40) seconds -west sixty (60) feet to an iron pipe; thence south seventy-six (76) degrees forty-eight (48) minutes forty (40) seconds west two hundred seven and fifty one hundredths (207.50) feet to an iron pipe, said iron pipe being due north one hundred twenty five (125) feet from a concrete reference monument in the next described line; THENCE due south for a distance of nine hundred eighty-five and twenty one hundredths (985.20) feet along a line parallel to and three hundred thirty (330) feet distant westward from the east line of the said Caswell Tract to a concrete monument in the north line of Buford Street; THENCE south eighty-nine (89) degrees forty (40) minutes forty (40) seconds east three hundred thirty ( 330 ) feet along the noiath .line of Buford Street, to the monument marking the place of beginning; CONTAINING in area seven and seven hundred fifty- one one thousandths (7.751) acres of land more or less. TRACT 2; From a point where the center line of Buford as established in the Neches River lark Addition to the City of Beaumont projected eastward, intersects with the east line of the said tract conveyed by the Trustees of the Caswell Trust to the City of Beaumont by deed dated September 19, 1936, recorded in Volume 423, page 227, Deed Records, Jefferson County, Texas, and hereinafter sometimes referred to as the Caswell Tract, said point being S. eighty-nine (89) degrees forty (40) minutes forty (40) seconds eleven hundred seventy-nine and forty-eight one hundredths (1179.48) feet from a monument marking the intersection of the -4- center lines of Carroll and Buford Streets, and two thousand six hundred and sixty-nine one hundredths (2600.69) feet north of the southeast corner of the said Caswell Tract; thence due south thirty (30) feet along the east line of the Caswell Tract, herein- before identified, to a concrete monument in the south line of Buford Street, as extended, for the beginning corner of this tract; THENCE along the first course due south for a distance of seven hundred ninety-eight and sixty- one one hundredths (798.61) feet along the east line of the said Caswell Tract toa concrete monu- ment, said monument marking the point of curve of the east line of the right-of-way of the Taxarkana and Fort Smith Railway Company, which right-of-way is more specifically described in right-of-way deed from Nirs. A. E. Caswell, et al, to Texarkana and Fort Smith Railway Company dated April 20, 1911,.re- corded in Volume 128, Page 426, Deed Records of Jefferson County, Texas, herein referred to for further description; THENCE along the northeasterly line of the right-of-way of the Taxarkana and Fort Smith Rail- way Company above referred to, same being a curve, to the left from a tangent from the south, said curve extending in a northwesterly direction and. having a radius of eleven hundred sixty-five and three one hundredths (1165.03) feet and a central angle of forty three (43) degrees twenty-three'(23) minutes and thirty-four (34) seconds for a distance measured along the arc, of eight hundred thirty-two and thirty-three one hundredths (83.33) feet to a monument which marks the intersection of the north- easterly right-of-way line of the Taxarkaha and Fort Smith Railway Company with the south line of Buford Street; THENCE south eighty-nine (89) degrees forty (40) minutes forty (40) seconds east, a distance of three hundred eighteen and forty-five one hundredths (318.45) feet along the south line of Buford Street to the monument marking the place of beginning. C. S. RR has a spur running through, the Southwestern portion of this tract, which would serve any industries located on this tract. The portion of this property comprising about 60 to 80 acres on the West side next to the Neches River has been filled in to an average depth of about 13 feet, and some.. filling in has been done East of this last mentioned area. All of the land not so filled in is subject to over -flow whenever there is a rise iri the river. This property has suffered in value because of its inaccessibility.
